MIAMI SHORES VILLAGE
PLANNING AND ZONING BOARD MEETING
November 8, 1979
A regular meeting of the Miami Shores Planning & Zoning Board
was held at 7:30 p.m., November 8, 1979, at the Village Hall, with the
following members present:
Mr. J. Robert Stobs, Chairman
Mr. Albert R. Toussaint
Mrs. Roberta Johnson
Mr. J. S. Palmer
Absent: Mr. Gordon H. Moyer, Jr.
Mr. Frank LuBien, Public Works Director, was also present.
(1) Minutes of the meeting of October 25, 1979, were _approved
as written by motion made by Mrs. Johnson, seconded by Mr. Palmer and passed
unanimously.
(2) PUBLIC HEARING: PROPOSAL TO INSTALL SIDEWALKS ON EAST
SIDE OF N. E. 6th AVE. FROM 103rd STREET TO 107thSTREET.
Chairman Stobs stated that this is a public hearing for
the purpose of considering, at the request of the Village Council, the
installation of sidewalks or a bicycle path on the east side of N. E. 6th
Avenue between 103rd Street and 107th Street, for the safety of children
going to and from school. All property owners on the east side of N. E.
6th Avenue in this area had been notified of this hearing. Mr. Stobs opened
the floor to those who wished to speak in behalf of this proposal.
Mrs. Arthur Gosselin, 671 N. E. 105th St., spoke in support
of the proposal.
Mr. David Goodwin, 610 N. E. 105th St., spoke in favor of
having sidewalks.
Mrs. Bray stated she has two children going to the Country
Day School who would use this path.
Mrs. Alice Ryder, 10433 N. E. 6th Ave., spoke in favor of
a bike path.
Mr. Richard Thornton, 10401 N. E. 6th Ave., stated that he
has opposed this plan before but if he could be convinced that it would be
safer for the children, he would not object. He was concerned about four
trees that are just barely off the right-of-way which would probably have to
be moved. He also pointed out that the sidewalk on the west side of the
street should be fixed so that it will be easier for students to ride on this
side of the street.
Mrs. Pat Vignola, 1079 N. E. 94th St., has a child going to

Country Day School who must cross where cars are pouring out of 107th Street.
Mrs. Goodwin, 610 N. E. 105th St., wanted sidewalks or both sidewalks
and bike path, but asked the Board to recommend a sidewalk.
Mr. Thornton repeated that he didn't think he has any objection
to this if it would be safer for the kids.
•Mrs. John Holly, 9660 N. E. 5th Ave., spoke about the need fora
bike path on 6th Ave. to keep the bike riders from riding in the street.

The Chairman read a letter from Mr. Robert Jensen, 10555 N. E. 6th
Ave., supporting the proposal for sidewalks.
Mr. Ken Harris, Headmaster of the Country Day School, stated it is
imperative to have a bike path to protect the children going to the elementary
schools as well as the Country Day School.
Dr. Holly, 9660 N. E. 5th Ave., stated that the children should have
a hard surface to walk or ride on along 6th Ave.
The Board discussed with Mr. LuBien the possibility of root pruning
and moving the trees that may be too close to the right-of-way, inasmuch as
it may take the County some time before they start this project.
Mr. Toussaint then moved that the Board recommend to Council that
they pursue this project and endorse sidewalks or a bike path. Mrs. Johnson
wanted to include curbs but other members of the Board felt this should be
considered at another time. The motion was seconded by Mr. Palmer and passed
unanimously.
(3) Request for permit by Mr. Ben Pumo, to replace the roof at 1500
N. E. 101st Street with cedar shakes.
Attorney William Pierce and architect Wahl Snyder strongly
recommended approval of this type roof, claiming it superior to tile, as
well as the preference of the owner, Mr. Pumo.
Mr. Toussaint stated that the Board is bound by the ordinance
unless there is a hardship involved. He referred to similar cases that were
denied, Mr. Robert Villano, 1263 N. E. 93rd St., and Mr. Sabatino, 1301 N. E.
104th St., both were denied. Mrs. Johnson moved that the request be denied.
The motion was seconded by Mr. Toussaint and passed.
(4) Request for permit was made by Dr. & Mrs. Stewart Wald to
construct a trellis on the front of their home at 938 N. E. 96th St.
After discussion of this type trellis which is not specifically
covered in the Zoning ordinance, Mr. Toussaint moved that on the basis of the
plans and anticipated revision of the code, the Board recommend a variance
for the construction of this trellis. The motion was seconded by Mr. Palmer
and passed unanimously.

(5) On inquiry of Mr. LuBien the Board stated that flat
roof additions to flat roof houses must come before the Board.
(6) Zoning Ordinance review:
• Mr. Moyer's report on abandoned vehicles was read.
Mrs. Johnson reported on definitions for permitted
animals as well as restrictions on number. Care of birds was not
resolved.
Mr. Toussaint reported on construction and height of
hedges or fences on corner properties.
The meeting adjourned at 10:10 p.m.
