10-11-1979 Regular MeetingMIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING October 11, 1979 A regular meeting of the Miami Shores Planning & Zoning Board was held at 7;30 p.m.,, October 11, 1979, at the Village Hall, with the follow- ing members present; Mr._ J. Robert Stobs, Chairman Mr, Gordon H. Moyer, Jr. (arrived late) Mr. Albert R. Toussaint Mrs., Roberta Johnson Mr. J. S. Palmer Mr. Frank LuBien, Public Works Director, was also present. (1) Minutes of the meeting of September 27, 1979, were approved as written by motion made by Mrs. Johnson, seconded by Mr. Palmer and carried. (2) PUBLIC HEARING: A request had—been made by Tropical Chevrolet for the Village to vacate that portion of the public right-of-way of N. E. 5th Court and N. E. 89th Street running from 87th Street to N. E. 6th Avenue. This hearing ahrffeen� puETicized in the October issue of the Village Hall News. On October 5, 1979, a letter had been received from Peter M. Feaman of Quinton, Lummus, Dunwody & Adams, attorneys for Tropical Chevrolet, requesting postponement of this petition based on developments between Tropical Chevrolet and the property owners who would acquire the right-of-way upon vacation by the Village. In order to hear those attending for this purpose Mr. Toussaint moved that the Board continue the hearing. The motion was seconded by Mrs. Johnson and passed unanimously. Mr. Saul Schaffer, 1 N. W. 89th St., El Portal, objected strenuously to closing the street which he stated he used frequently to avoid two bad intersections. He complained about Tropical's use of this street as a race track by sales and service personnel. He asked why the Village would close this street and give them all this valuable land and deprive the general public of the use of the streets. Chairman Stobs reported that the utility companies object to the closing until they can obtain an easement, and that he had received a letter from C. Lawton McCall, former Village Manager, objecting to the closing. Mr. Jack Fitzgerald, 79 N. W. 97th St., stated that he didn't think the land should be turned over to anyone gratis. Rena Hambleton, representing the trust of Reno Dallas, who leases one of the buildings to Tropical Chevrolet, stated that their building would lose access to the street. Mary Hyre, 530 N. E. 107th St., thought the Board should reject the idea and keep the street open. 10/11/79 -2- Jim Hyre, 530 N. E. 107th St., stated that he uses this street to go to Lindsay Lumber, and thought that if this goes through anyone can ask to have a street closed. Stanley Potakar, 637 N. E. 92nd St., lives overlooking these properties, and stated that we must stop the spreading of business; if we become too commercialized we will go down hill. We do not need the world's largest Chevrolet dealer in Miami Shores. It was pointed out that when Quayside opens up we will have the worst traffic congestion at 87th St. Mr. Potakar stated he was strongly against this and thought we should ask Tropical Chevrolet to move their body shop to a commercial area and just use the area for a show room, to be beautified and made a part of the Village Beautiful. Attorney Feaman stated that they are not requesting at this time to vacate the streets because they do not have an agreement with the Reno Dallas interests and Dr. Hayes; they are not ready at this time to continue the request because it is premature. Mr. Toussaint stated that in view of Mr. Feaman's withdrawal, he moved to discontinue the hearing but that the comments be made a part of the meeting along with the letters received. The motion was seconded by Mr. Moyer and passed unanimously. (3) Mr. Richard B. Smith, 353 Grand Concourse, requested permission to close in his garage for a family room. After a review of the plan which showed no outside entrance, Mr. Moyer moved that it be approved. The motion was seconded by Mrs. Johnson and passed unanimously. (4) Approval of flat roof addition for home of Mr. Jimmie L. Brown, 1210 N. E. 91st Terrace. Mr. LuBien reported this complies with the roofing ordinance in all respects but requires. Board approval. Mr. Toussaint moved approval of this flat roof addition. The motion was seconded by Mrs. Johnson and passed unanimously. It was noted from this plan that the pool setback is in violation as the sideyard requirement is 10 ft. from the pool deck. The Building Inspector was requested to have this applied for as a variance. (5) Pending request for permit to construct a green house by Mr. William B. Robinson, 517 N. E. 91st Street. Mr. Robinson presented his plan for a green house, 10 x 10 ft., to be covered with white fiberglass roof and sides. Mrs. Johnson moved that it be approved at 100 sq. in size. The motion died for lack of a second. Mr. Toussaint moved that it be approved with the white fiberglass covering, with a limitation of 80 sq. ft. The motion was seconded by Mr. Moyer and passed. (6) Other pending business. The Board asked Mr. LuBien about the zoning violations con- nected with enclosing a garage at 113 N. W. 108th St. Mr. LuBien reported • • 10/11/79 -3- he had sent a Notice of Violation to this resident. (7) Zoning Ordinance review: ARTICLE II - Definitions: Mrs. Johnson compared definitions with those in the minimum standards ordinance and pointed out where they should be made to conform. ARTICLE IV - District maps and Schedule of Mr. Toussaint reported that this is not ready. ARTICLE V - Mr. Moyer pointed out sections Section 501 (o) Used car lots. Section 504 - Signs Section 507 508 - Grades Section 516 -Accessory buildings Section 518 - Fences, hedges - materials, Area for trash storage.
