PLANNING AND ZONING BOARD MEETING
September 13, 1979
A regular meeting of the Miami Shores Planning & Zoning Board was
held at 7:30 p.m., September 13, 1979, at the Village Hall, with the follow-
ing members present:
Mr. Albert R. Toussaint, Chairman
Mr. Gordon H. Moyer, Jr.
Mr. J. Robert Stobs, II
Mr. J. S. Palmer
Absent: Mrs. Roberta Johnson
Mr. Frank LuBien, Public Works Director, was also present.
(1) Minutes of the meeting of August 23, 1979, were approved
as written by motion made by Mr. Palmer, seconded by Mr. Moyer and passed
unanimously.
(2) Request was made for approval of a tentative plat of
VAZQUEZ SUBDIVISION a replat of Lots 10, 11, 12, 13, & 14, Block 35, Miami
Shores Section One. This is the vacant property on the east side of N. E.
2nd Avenue between 101st and 102nd Streets. The lots are 130 ft. deep with
81 ft. frontages. Mr. Palmer moved that the tentative plat be approved.
The motion was seconded by Mr. Stobs and passed unanimously.
(3) Permit was requested to build on Lot 3, Block 19, Miami Shores
Section #1, by the owner, Mayor Henry Everett. Mr. LuBien asked the Board
to set parking requirements. Mayor Everett presented a survey of parking on
the Village and privately owned lots in the block under discussion, indicating
a 58% use over a 19 -day period.
Mr. Toussaint relinquished the chair to Mr. Moyer and moved
that the Board grant a parking variance and recommend to the Council that
there is adequate parking spaces available in the adjoining city lots, plus
a portion of Lots 4 and 5, and unmetered spaces on 97th Street, to meet the
requirement. The motion was seconded by Mr. Palmer and passed unanimously.
(4) A request was made for permit to construct a green house
by Mr. William B. Robinson, 517 N. E. 91st St. The construction is proposed
as a wood frame with plastic fiberglass type sides and roof. The size was
in excess of the permitted area. Mr. Stobs moved to table this for two weeks
and request an elevation as well as a sample, with colors, of the material to
be used. The motion was seconded by Mr. Palmer and passed unanimously.
(5) Approval was requested for installation of a parking area at
Tropical Chevrolet, to include paving, lighting, fencing and landscaping.
After discussion of the plan Mr. Toussaint relinquished the chair to Mr. Moyer
and moved approval of the parking lot paving, the concrete rail fence to be
continued to the north with a Carissa hedge or similar, as approved by the
Building Inspector, to be placed between the fence and sidewalk along the
entire length of the existing lot and the new lot, that the palms are to be

continued northly along the new lot, that the city -owned land immediately
north of parking area will also be landscaped to the satisfaction of the
Building Director, with adequate hose bibs or sprinkler system required to
cover the landscaped areas, subject to the Building Director's approval. The
motion was seconded by Mr. Palmer and passed unanimously. Further, the
Building Director was instructed to restrict the parking lot from use until
the landscaping and irrigation are in.
(6) A sketch was presented for permit to enclose a garage for
bathroom and living area by the owner, Mr. H. Jalali, at 113 N. W. 108th St.
This work had been completed without permit. Mr. LuBien reported several
irregularities that indicated possibility that the work was done to create
two living units. The owner was not present, and no action was taken pending
Mr. LuBien's follow-up on the zoning violation.
(7) Set dates for public hearings on 95th St. traffic and on
abandonment of N. E. 5th Ct. and 89th St.
September 27, 1979 - 95th Street traffic.
October 11, 1979 - Street abandonments.
(8) Private school ordinance - Mr. Stobs and his committee will
meet with the Village Attorney during the next week to discuss how school
zoning may be restricted in the residential zones.
(9) Review of Zoning Ordinance No. 270 - Chairman Toussaint
reiterated that ARTICLE I will not be changed. ARTICLE II - Definitions,
has been assigned to Mrs. Johnson, ARTICLE III AND IV, District Maps and
Schedule of Regulations - Mr. Toussaint will rework, and ARTICLE V was
assigned to Moyer and Mr. Palmer.
(10) The Village Clerk presented a letter to the Board received
on this date concerning zoning approval to use the cafeteria building and
adjoining property for a medical laboratory. The inquiry was made by
Dr. Leon Terrain, the prospective purchaser. The Board requested that the
interested parties be present at the next meeting to explain in detail how
this property would be used.
