PLANNING AND ZONING BOARD MEETING
July 12, 1979
A regular meeting of the Miami Shores Planning & Zoning Board
was held at 7:30 p.m., July 12, 1979, at the Village Hall, with the following
members present:
Mr. Albert R. Toussaint, Chairman
Mr. Gordon H. Moyer, Jr.
Mr. J. S. Palmer
Absent: Mr. J. Robert Stobs
Mrs. Roberta Johnson
Mr. Frank LuBien, Public Works Director, and Mr. Sam Ackley,
Village Manager, were also present.
(1) Minutes of the meeting of June 28, 1979, were approved
as written by motion made by Mr. Palmer, seconded by Mr. Moyer and carried.
(2) PUB;IC HEARING - RECONSTRUCTION OF MIAMI AVENUE FROM
105th STREET TO 119 STREET.
Mr. Toussaint announced that at the request of residents
along Miami Avenue, this public hearing was scheduled to provide an opportunity
for the County and residents to further discuss the second phase of the
Miami Avenue reconstruction from 105th to 119th Street. At the last Planning
Board meeting Mr. Frank Reichert, 5 N, E. 107th Street, and his neighbors
living along Miami Avenue, asked that this work be stopped.
Representatives of the Dade County Public Works Department
were present and reviewed the history of the project as originating in the
1972 Decade of Bonds issue. Mr. Bill Powell stated that the bonds have been
sold for the project and the money is available to complete the job to 167th
Street by the year 2000. He stated that the traffic volume will need a four -
lane street within a few years.
It was announced that this is scheduled for a public hearing
before the County Commission on September 4, 1979.
The residents argued that they do not want the road widened,
that there are alternate routes available and that the traffic has decreased
in the last few years. However, they did want the sidewalks and street lights.
(3) Councilman Bowen regarding the roof ordinance.
Mr. Bowen appeared at this meeting to ask the Board to
re -consider present restrictions imposed by the new roof ordinance. He presented
colored slides of expensive homes designed for other than tile roofs and homes
having flat roof additions clearly visible from front and side streets, as well

large additions that would not have been able to be built under the present
restrictions.
Mr. Bowen asked the Board to take under advisement review of
Ordinance No. 403-78, specifically with regard to paragraph (e) (2), with
the suggestion of limiting the flat roof addition to 30% instead of the
• present 15%; and with regard to (e) (3), suggested: that the flat roof
addition be allowed provided it is not visible from the front elevation of
the building.
Chairman Toussaint stated that the Board would take this under
advisement.
(4) Mrs. Phyllis Moore, 310 N. E. 98th St., requested permit
to construct a heavy timber trellis as a carport attached to the garage.
In lieu of the trellis Mrs. Moore stated she would build a carport if permitted
to use 5 ft. of the rear setback. Mr. Toussaint moved that the request for a
5 ft. variance be denied. The motion died for lack of a second. Mr. Moyer
stated he would like to see a drawing of the trellis, but this suggestion was
not acted on.
(5) Bike path -
Mr. Ackley presented the plan for a bike path through
Miami Shores to be constructed by the County which runs along the east side
of N. E. 10th Avenue to the east side of Biscayne Blvd. Mr. Ackley stated
that we will notify the residents on both sides of 10th Avenue that the
plan will be discussed at the Board meeting of July 25, 1979.
The meeting adjourned at 9:35 p.m.
