PLANNING AND ZONING BOARD MEETING
March 8, 1979
A regular meeting of the Miami Shores Planning & Zoning Board was
held at 7:30 p.m., March 8, 1979, at the Village Hall, with the following
members present:
Mr. Albert R. Toussaint, Chairman
Mr. Gordon H. Moyer, Jr.
Mr. J. Robert Stobs (arrived late)
Mrs. Roberta Johnson
Mr. J. S. Palmer
Mr. Frank LuBien, Public Works Director,and Mr. 0. Sam Ackley, Village
Manager, were also present.
(1) Minutes - February 15, 1979, approved by motion made by
Mr. Palmer, seconded by Mrs. Johnson and carried.
Minutes - February 22, 1979 - approved by motion made by Mrs.
Johnson, seconded by Mr. Palmer and carried.
(2) A request for variance was made by Mr. Jule F. Paulk, 1225
N. E. 91st Terrace, from Ordinance No. 403-78, Section 2, C4) e., in order
to build a flat -roof addition in excess of 15% of the ground area of the
existing building, as required by the above ordinance. It was determined
that the area of the flat roof addition would add about 40%. Mr. Paulk argued
that this was a hardship in that he needed this size addition, that the
area permitted would not provide any appreciable space, and that the addition
would enhance and increase the value of his home. After further discussion
Mrs. Johnson moved that the request be denied. The motion was seconded by
Mr.Moyer and passed unanimously.
(3) Traffic flow on N. E. 95th Street - The Board requested that
the Village Manager ask the County to look into this problem with alternative
suggestions.
(4) Utility shed ordinance - rewording of Section 516. was read
and approved by motion made by Mr. Moyer, seconded by Mr. Palmer and passed
unanimously.
(5) Definitions:
(a) Ornamental masonry for front yard walls, Section 518
of the zoning ordinance. The Council referred this back to the Planning
Board for further clarification. After some revising the following was
proposed: "shall be constructed of decorative masonry faced with brick,
clay brick, stone, ornamental precast decorative block, or equal as approved
by the Planning Board, or ornamental metal". By motion made by Mrs. Johnson,
seconded by Mr. Palmer and passed this amendment will go back to the Planning
Board for final review.
(b) Height and grade criteria - acceptable.

(6) Private school ordinance - copies of the proposed ordinance
had been forwarded to the Board for review. In the discussion of residential
zoning and child care /education, Miss Agnes Conlon, 10290 N. E. 2nd Ave.,
asked the Planning Board to restrict the use of residential zoning for schools.
Approval of the proposed ordinance is pending further review.
(7) Tropical Chevrolet plans for expansion - Mr. Bob Geyer, owner,
presented preliminary plans for re -designed use of the Tropical Chevrolet
property. Afrer review of the plans Mr. Palmer moved they be approved on
the basis of closing the north exit,. presentation of a plan of landscaping on
the north end, and elevation of the 6th Avenue side with onsite parking only.
The motion was seconded by Mrs. Johnson and passed 4/1 with Mr. Moyer dissenting
as he stated the use of this property has changed from the original request.
The Board agreed, at Mrs. Johnson's suggestion, that last-minute
items will not be considered and that the agenda will be made up a week in
advance of the meeting.
The meeting adjourned at 10:10 p.m.
