PLANNING AND ZONING BOARD MEETING
February 22, 1979
A regular meeting of the Miami Shores Planning & Zoning Board was
held at 7:30 p.m., February 22, 1979, at the Village Hall, with the following
members present:
Mr. Albert R. Toussaint, Chairman
Mr. Gordon H. Moyer, Jr.
Mr. J. Robert Stobs
Mrs. Roberta Johnson
Mr. J. S. Palmer
Mr. Frank LuBien, Building Inspector, was also present.
(1) Minutes of the meeting of February 8, 1979, were approved as
written by motion made by Mr. Palmer, seconded by Mrs. Johnson and carried.
(2) Mr. Frank S. Monroe, 515 N. E. 95th St., presented a petition
to the Board, signed by 44 residents, asking that through traffic be eliminated
from N. E. 95th St. It was their request that thru traffic be routed to 96th
St. Chairman Toussaint stated that the Board would take this under advisement.
(3) Unfinished business of the plans of Mr. Joseph C. Grayson,
15 N. W. 102nd St. At the last meeting Mr. Grayson requested variances:
(a) for a flat roof addition visible from a street side, and (b) a flat roof
addition in excess of the allowable area. The plans were re -drawn showing a
mansard facia around the edge of the roof, which did not alter the variances.
After further discussion Mr. Stobs moved that the variances be denied. The motion
was seconded by Mrs. Johnson and passed unanimously. Mr. Grayson stated that
he would like to appeal this decision to the Village Council.
(4) A request was made by Mrs. Jack Norman, 151 N. E. 101st. St.,
to screen in a patio along the east stide'of her home which wi- put the enclosure
within 18" of the side property line. In a compromise effort Mr. Moyer moved
that a variance be approved allowing the enclosure to extend two feet into the
setback to the edge of the roof overhang. The motion was seconded by Mr. Toussaint
but failed to carry on a 2/3 vote.

Definition:
(a) Ornamental masonry for walls (front yard) -The following
amendment was proposed for Section 518, of the Zoning Ord. #270:
Paragraph (b) Shall be constructed of masonry, CBS or
ornamental metal, but not including any wire fence.
(b) Grade criteria for height of walls, fences and hedges - The
following amendment was proposed for Section 518, of the
Zoning Ord. #270:
Paragraph (d)
(1) Front yards or side yards abutting public
right of way should be controlled by existing grade
at sidewalk or adjacent street. Grade shall be
controlled by the lower grade of the two. Front
yard grade where sidewalks do not exist shall be
controlled by adjacent street.

(2) Grades along interior side yard lines should be
along the finished yard grade or ground elevation.
In the event of a difference of grade created by
cutting or filling of an adjacent lot, the average
grade of the abutting lots should prevail.
(3) Rear yard grade should be defined as the center line
grade of the alley pavement as constructed or the
grade of the yard, the lower grade of the two will
be the grade reference mark.
(4) In the event of a pronounced rise or fall in the
property line of an intended improvement the height
shall not exceed 6" deviation of the allowable height.
(6) Mrs. Johnson - minimum standards ordinance:
The proposed ordinance on minimum housing standards
(following the Coral Gables ordinance) submitted by Mrs. Johnson was read
and discussed through Article I, Page 5, to be completed at the next meeting.
