01-11-1979 Regular MeetingMIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING January 11, 1979 A regular meeting of the Miami Shores Planning & Zoning Board was held at 7:30 p.m., January 11, 1979, at the Village Hall, with the following members present: Mr. Albert R. Toussaint, Chairman Mr. Gordon H. Moyer, Jr. Mr. J. Robert Stobs Mrs. Roberta Johnson Mr. J. S. Palmer Mr. 0. Sam Ackley, Village Manager, and Mr. Frank LuBien, Building Inspector, were also present, as well as Mr. William Fann, Village Attorney. (1) Minutes of the meeting of December 14, 1978, were approved as written by motion made by Mr. Palmer, seconded by Mrs. Johnson and carried. (2) A request for variance was made by Attorney James Shroads on behalf of Juanita and Lillie Mae Anderson, 492 N. W. 111th Terrace, to allow an asphalt shingle roof to remain as installed. It was alleged that the roofer was told that this property was not in the Shores. Subsequently, a shingle roof was installed with a County permit. Mr. Shroads argued that because of misinformation concerning the jurisdiction of the property and its proximity to an unincorporated area, that a hardship variance should be granted. It was pointed out that allowing non -tile roofs in that area would further erode the neighbor standards and that the alleged hardship had been created by the owner and the roofer. Mrs. Johnson moved that the request be denied. The motion was seconded by Mr. Stobs and passed unanimously. (3) A request was made by Mr. James R. Sabatino for permission to use some type of shingle roof in place of tile at 1301 N. E. 104th St., for aesthetic and architectural reasons. After being discouraged by the Board, Mr. Sabatino withdrew his request and no action was needed as his roofing permit called for cement tile. (4) Mr. Irving Breakstone, 9909 Biscayne Blvd. requested clari- fication of setbacks in order to build a room addition. Because there is an existing 6 ft. setback on his home, Mr. Breakstone asked to be permitted to use this setback on a new addition. The Board asked him to reconsider his addition to conform with a 10 ft. setback. No action was taken. 1110 Mr. Fann, Village Attorney, discussed zoning variances and how the Board should consider them. Ordinance on metal sheds: A proposed ordinance was submitted by Mr. Fann, as drafted by the Board, to permit and regulate metal sheds. Mr. Palmer • • 1/11/79 -2- moved that it be approved by the Board. The motion was seconded by Mrs. Johnson and passed unanimously. A public hearing was tentatively set for February 1, 1979, to advise the public of these proposed regulations on metal sheds. Mr. Stobs reported on his work on the private school regulations and Mrs. Johnson stated that she was working on the minimum housing standards. Mr. Sam Ackley, Village Manager, presented the first draft of the Comprehensive Plan report along with some of the required maps on existing land use, arterial traffic, gas lines, etc. As soon as it is finished public hearings will be scheduled. The meeting adjourned at 9:35 p.m. Chairman
