PLANNING AND ZONING BOARD MEETING
December 14, 1978
A regular meeting of the Miami Shores Planning & Zoning Board was
held at 7:30 p.m., December 14, 1978, at the Village Hall, with the following
members present:
Mr. Albert R. Toussaint, Chairman
Mr. Gordon H. Moyer, Jr.
Mrs. Roberta Johnson
Mr. J. S. Palmer
Absent: Mr. J. Robert Stobs
Mr. 0. Sam Ackley, Village Manager, and Mr. Frank LuBien, Building
Inspector, were also present.
(1) Minutes of the meeting of November 30, 1978, were approved
as written by motion made by Mr. Palmer, seconded by Mrs. Johnson and carried.
(2) Plans for new signs for Publix Market, 9050 Biscayne Blvd.,
were presented, with additional wording "S & H Green Stamps"; permitted area,
630 sq. ft., proposed signs, 526 sq. ft., with internal lighting. Approval for
the signs as presented was given by motion made by Mr. Palmer, seconded by Mrs.
Johnson and passed unanimously.

Committee reports:
Metal utility sheds - proposed ordinance to be submitted
at meeting of January 11, 1979.
(4) Weekly Planning & Zoning Board meetings it was
decided to go to weekly meetings of the Board beginning
in January to catch up with work on the Comprehensive
Plan and subsequent public hearings.

Discussion of Spear home - In regard to the Spear home at
N. E. 93rd St. and N. Bayshore Drive, the Village Attorney
states that a Certificate of Occupancy cannot be refused
because of color of paint, however, we, the Miami Shores
Village Planning Board wish to go on record that:
(a) The color of this home is not harmonious and is not
the same beige color as presented in the original artist's
rendering.
(b) Dr. & Mrs. Spear both were aware that the Village had
previously questioned the color before the final painting
of the house.( See Gray letter of 2/6/78, Spear letter of
2/8/78 and Toussaint letter of 2/10/78.)
(c) Dr. & Mrs. Spear requested postponement of the hearing
on 2/9/78 regarding color in that they were experimenting
with color and the colors were not finalized. This was
interpreted by each member of this Board as Mrs. Spear's
tacit recognition of our jurisdiction in this matter and

the possibility that we might eventually rule the
colors as not being harmonious.
"At this point we emphasize that the architects and
designers are still only experimenting with colors and
shades and have not reached a final decision on which
one to use. This is quite evident since there are two
shades painted on one wall". Quote of Mrs. Spear in
letter of 2/8/78.
(d) We ask that the Village Council and Village Attorney
review this situation.
The above was made as a motion by Mr. Moyer, seconded by
Mrs. Johnson and carried, with Mr. Palmer abstaining.
Chairman Toussaint reported that on 6/24/76, sketches were
requested of this house to reveal the character of the
residence, and one of these sketches was a rendering which
showed beige as the color of paint, (meeting of 7/22/76).
