10-26-1978 Regular MeetingMIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING October 26, 1978 A regular meeting of the Miami Shores Planning & Zoning Board was held at 7:30 p.m., October 26, 1978, at the Village Hall, with the following members present: Mr. Albert R. Toussaint, Chairman Mr. Gordon H. Moyer, Jr. Mrs. Roberta Johnson Mr. J. S. Palmer Mr. Robert Stobs (arrived late) Mr. Sam Ackley, Village Manager, Chief Fletcher, and Council representatives Mayor Farina, Bowen and McIntosh, were also present. (1) Minutes of the meeting of September 28, 1978, were approved as written by motion made by Mrs. Johnson, seconded by Mr. Moyer and carried. (2) Mrs. Paula G. Clifford requests permit for a new house to be built at 1201 N. E. 100th Street, Lot 1, Block 5, Earleton Shores. The plan calls for demolishing the present house, which has been done, and re- constructing a new house with one wood frame wall on the second floor, a fiberglass shingle roof, and maintaining a non -conforming side setback. After discussion of the fiberglass roof, Mrs. Johnson moved that it be denied. The motion was seconded by Mr. Moyer and passed 4/1 with Mr. Stobs abstaining, because he didn't feel he was sufficiently informed on the subject. The issue of the frame wall was next discussed. The plan called for a timber frame and timber faced wall on the rear of the building on the second story cantilevered section. It was pointed out that a cement cantilever at the second story level would not be practical to accommodate wiring and air conditioning duct work. Mrs. Johnson moved approval of the variance as a hardship. The motion was seconded by Mr. Toussaint and carried. Mr. Stobs abstained from voting on any of the motions concerning the Clifford plans for the reason noted. Because of the swimming pool setback and problem with an existing tree, the plan placed the house on the previous house setback of 7.6 ft. from the side line. As there was no survey of the property at hand Mr. Moyer moved that the lot be surveyed for location of the pool, pool deck, tree and cabana. The motion was seconded by Mr. Toussaint and carried. (3) Mr. Mel Astley of Top Roofing Co., requested permit for Mrs. Baker, 179 N. W. 97th St., to reroof an existing flat roof with an aluminum asphalt coating in lieu of B.U. gravel, as required by Ordinance No. 403-78. After discussion, Mr. Palmer moved that the request be denied. The motion was seconded by Mr. Stobs and carried. (4) Village Council representatives to discuss code enforcement and zoning items. Mayor Farina was present to ask the Board's assistance in raising the level of code enforcement. In the discussion that followed it was -2- 10/26/78 suggested that the Police Department report the violations and then the Building & Zoning Department would send the notices. Mr. Ackley explained the enforcement procedure for municipal ordinances as outlined by the State Attorney's office. He recommended that the Chief's suggestion of rewriting ordinances be taken under advisement and that we take care of the present complaints and prepare to process them to a final conclusion. After we get through two or three court cases we will assign certain violations to the Police Department and others to the Building Depart- ment. Chief Fletcher suggested that Police personnel could assist the Building Department for perhaps a year until violations are brought under control. (5) Committee reports: Schools - Mr. Stobs reported that he had received three letters on church schools and would start to follow up on the others. Minimum standards - Mrs. Johnson had no report. Comprehensive Plan - Mr. Toussaint coordinating with Mr. Ackley. Metal sheds - Mr. Moyer gave a detailed report on this subject after researching other cities and the County. , and recommended rewriting Section 516 of the zoning ordinance in order to permit the metal sheds under certain conditions.
