PLANNING AND ZONING BOARD SPECIAL MEETING
August 29, 1978
A special meeting of the Miami Shores Planning & Zoning Board
was held at 7:30 p.m., August 29, 1978, at the Village Hall, with the follow-
ing members present:
Mr. Gordon H. Moyer,
Mr. Robert Stobs
Mr. J. S. Palmer
Absent: Mr. Albert R. Toussaint, Chairman
Mrs. Roberta Johnson
Mr. Frank LuBien, temporary Building Inspector was also present.
In the absence of Mr. Toussaint, Mr. Moyer was asked to chair
the meeting.
(1) Minutes of the meeting of August 10, 1978 were approved as
written by motion made by Mr. Stobs, seconded by Mr. Palmer and carried.
(2) A request was made by Mr. and Mrs. Stephen Lutton, 167
N. W. 109th Street, for permit to reconstruct a porch, enlarging it as a
bedroom and bath, maintaining a flat roof on the street side. In the
discussion that followed it was pointed out that the survey revealed that the
building is encroaching into the setback, and flat roofs are not permitted
on an addition that exceeds 15% of the ground area of the existing building,
or where visible fron the front elevation. Mrs. Sutton argued that she had
been told she could go ahead with the demolition of the old porch pending
presentation of an up to date survey, and that the question of the flat roof
had not come up.
Mr. Palmer moved that the request be disallowed, which
motion died for lack of a second. Mr. Stobs moved approval of the request
on the ground that it does not set a precedent because there was an existing
structure having an incline of less than 21/2", which can be interpreted as
being altered. The motion was seconded by Mr. Moyer and passed 2/1 with
Mr. Palmer dissenting. Chairman Moyer reviewed the action as a recommendation
to Council for a variance to cover the flat roof, the size of the addition
and the setback.
The meeting adjourned at 8:30 p.m.
