PLANNING AND ZONING BOARD MEETING
June 8, 1978
A regular meeting of the Miami Shores Planning & Zoning Board was
held at 7:30 p.m., June 8, 1978, at the Village Hall, with the following members
present:
Mr. Albert R. Toussaint, Chairman
Mr. Robert Stobs, II
Mrs. Roberta Johnson
Mr. J. S. Palmer
Absent: Mr. Gordon H. Moyer, Jr.
Mr. William R. Bradford, Building & Zoning Director, was also
present.
Minutes of the meeting of May 25, 1978, were approved by motion
made by Mrs. Johnson, seconded by Mr. Palmer and carried.
(1) Roof ordinance - The Board again discussed the roofing
ordinance as prepared by the Village Attorney. It was the feeling of the Board
that the following paragraph, as originally requested, should be included in
this ordinance:
"Where there exists a roof of other material that
was permitted at the time of original construc-
tion, additions to or replacements to said
building may use the same material".
Mr. Palmer moved that the proposed roofing ordinance as
prepared by Mr. Fann be approved with the addition of the above paragraph, to
be listed as paragraph (g). The motion was seconded by Mr. Stobs and passed
unanimously.
(2) 50 ft. lots - The Board discussed the present Ordinance
361 having to do with lots of less than 75 ft. frontage and how it may be
amended to prevent subdividing under the present ownership. The following
amendment to Ordinance No. 361, Section 404 of Ordinance No. 270, was recommended
to the Council by motion made by Mr. Stobs, seconded by Mr. Palmer and carried
unanimously:
AN ORDINANCE AMENDING ORDINANCE NO. 361, and
Amending Section 404 of Ordinance No. 270.
(a) No building shall hereafter be erected, nor
any existing building be structurally altered,
except in conformity with the regulations
regarding space, area and cubage as set forth
herein.
(b) There shall not be allowed any subdividing of
individual ownership of one or more residential
lots in the Village into units smaller than the
required 75 -foot lot requirement of Ordinance
No. 270, Article IV, Schedule of Regulations.

(c) In no case or situation shall the existing
structure be allowed to become non -conforming.
(d) The above will not apply to 50 -foot lots
where such lot is owned by someone other than
the owners of the side contiguous lots.
There being no further business before the Board, the meeting
adjourned at 8:45 p.m.
