03-09-1978 Regular MeetingMIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING March 9, 1978 A regular meeting of the Miami Shores Planning & Zoning Board was held at 7:30 p.m., March 9, 1978, at the Village Hall, with the following members present: Mr. Albert R. Toussaint, Chairman Mr. Robert Stobs, II Mrs. Roberta Johnson Mr. James W. Dunaway Absent: Mr. Gordon H. Moyer, Jr. Mr. William R. Bradford, Building and Zoning Director, was also present. Minutes of the meeting of February 23, 1978, were approved as written by motion made by Mr. Dunaway, seconded by Mrs. Johnson and carried. PUBLIC HEARING ON REQUEST TO RE -ZONE FOR PARKING USE MADE BY PUBLIX MARKET, 9050 Biscayne Boulevard A request was made by Publix Market, 9050 Biscayne Boulevard, for permit to create an employee parking lot in the east right-of-way of the Railroad between N. E. 92nd and 93rd Streets, using 30 ft. of railroad right- of-way and 7 ft. of Village right-of-way along Club Drive and requiring removal of the row of pine trees. Chairman Toussaint reviewed this request and stated that it would require an amendment to the Zoning Ordinance No. 270, to establish a parking zone in the Railroad right-of-way. As required by ordinance, all property owners with- in. 500 ft. of this location were notified of the hearing. Mr. L. McGill, Manager of Publix, explained the plan to pave 400 ft. along the Railroad for employee parking to be fenced and landscaped. Chairman Toussaint read a letter received from Margaret McAuslan, 689 N. E. 92nd St., stating she was in favor of the request, and a letter received from Charles A. Gould, attorney, representing Oscar A. Jose, Jr., 546 N. E. 92nd Street, entering a formal objection to the proposed re -zoning. Mr. Stanley Potokar, 637 N. E. 92nd St., voiced objection to the creation of a parking lot encouraging crime and further objected to the expan- sion of business. Mr. John Knezevich, 711 N. E. 93rd Street, discussed the crime potential and the increase of traffic on 93rd Street, all of which would affect property values. Mrs. Vera Techo, 709 N. E. 93rd St., stated that the insurance people should not be permitted to park in the Publix lot, as they were doing. PUBLIC HEARING -2- March 9, 1978 Mr, Robert Lodge, 533 N, E, 92nd St,, voiced objection. Mrs, Leona Hector, 645 N. E, 92nd St., stated that those trees are 40 years old and she didn't want to wait 40 years for replacements. Mr. Jeff Pearl, 730 N. E. 94th St., was of the opinion that it was an extremely rare occasion when the parking lot is full and asked if a pro- fessional survey had been made of the parking. Mr, Salvatore Bruccoleri, 670 N, E. 93rd St., was against this request. Ms, Margie C. Caldwell, 657 N, E. 92nd St., voiced objection. Mr. Oscar A, Jose, 546 N. E. 92nd St., thought the Publix Board should take responsibility for this request and should tell the public what their plans for the future are. Mr, Michael Rutter, 691 N. E. 94th St., stated that the parking lot would be a breeding place for crime, Mrs. Joseph Cofer, 689 N. E. 92nd St., felt it was spot zoning and would depreciate property values; that as President of the Condominium Association of the Shores Plaza West, stated that almost all of the owners were against this request. Mr. David Lewis, 675 N. E. 93rd St., voiced objection, and pointed out the sorry condition of the parking lot along the Railroad maintained by the Publix Market across from Bay Point. Mr. Rutter, 691 N. E. 94th St., stated that other offices would use this parking area. Mr. Cawein, 700 N. E. 93rd St., stated that the people are concerned about deteriorating the area and he didn't think that it was physically possible to park there. Chairman Toussaint stated that the proposal included use of public right-of-way, and he asked the Board to first act on the request for use of 7 ft. of public right-of-way. Mrs. Johnson moved that the Board deny use of 7 ft. of right-of-way. The motion was seconded by Mr. Dunaway and passed unanimously. The next item Mr. Toussaint stated would be consideration of establishing a zoning classification for the 30 ft. of R.R. right-of-way. Mrs. Johnson moved that the Board not change the R.R. right-of-way zoning. The motion was seconded by Mr. Stobs and passed unanimously. • • -3- The Planning Board asked for a follow-up on: (a) The roofing ordinance. (b) Tile roofing on the tennis court chickees.
