02-09-1978 Regular MeetingMIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING February 9, 1978 A regular meeting of the Miami Shores Planning and Zoning Board was held at 7:30 p.m., February 9, 1978, at the Village Hall, with the following members present: Mr. Albert R. Toussaint, Chairman Mr. Gordon H. Moyer, Jr. Mr. Robert Stobs, II Mrs. Roberta Johnson Mr. James W. Dunaway Absent: None Mr. William R. Bradford, Building and Zoning Director, and Mr. 0. Sam Ackley, Village Manager, were also present, as well as about 40 residents. Minutes of the meeting of January 12, 1978, were approved as written by motion made by Mr. Moyer, seconded by Mrs. Johnson and carried. (1) Mr. Herbert Hirsch, 89 N. E. 109th St., requested permit to build a house on Lot 24, Block 2, College Heights, which is the lot adjoining his home, on which there is a swimming pool that was built as part of the entire property of two lots. In splitting the property the pool will become non- conforming because of the setbacks on the west side. After discussion Mr. Stobs moved that the Board recommend a variance for Mr. Hirsch's application, pro- vided the deck is 42 ft. off the edge of the pool, leaving a 6 ft. setback. The motion was seconded by Mrs. Johnson and passed unanimously. (2) Revised request from Mrs. Victoria Peach on the Montessori Children's House at 10390 N. E. 2nd Ave. - At the Council meeting of January 24, 1978, the Board recommendation for expansion of the Montessori School to 50 students with 6 teachers, pre-school through sixth, from 8 a.m. to 3 p.m., was not approved, but open for revision. Mrs. Peach's new application to the Board, dated February 1, 1978 was as follows: (a) Enrollment limited to 50 students. (b) Pre-school through third grade. (c) School hours - 8:30 a.m. to 2:30 p.m. After discussion by Mr. Pierce, attorney, in support of this request and objections voiced by the neighbors, Mr. Dunaway moved that the Board permit Mrs. Peach to go on with her present number of students of 25. The motion was seconded by Mr. Moyer and passed 4/1 with Mr. Stobs dissenting. Mrs. Johnson then moved approval of ages 22 to 6, with hours 8:30 a.m. to 11 a.m., as originally established. The motion was seconded by Mr. Moyer and passed 4/1 with Mr. Stobs dissenting. (3) Request was made for approval of a new sign for Biscayne Kennel Club depicting dogs outlined in neon to be erected on the west side of the building, facing I-95. After review of the plan Mr. Dunaway moved that it be approved. The motion was seconded by Mrs. Johnson and carried unanimously. • 2/9/78 -2- (4) A parking plan was proposed by the Police Department for the recreation fields, to provide angle parking slots on the south side of Grand Concourse east of 7th Avenue. A petition was presented to the Board by Mr. Jack Rengstl, of 665 Grand Concourse, signed by residents of Grand Concourse objecting to this parking plan. After discussion Mr. Ackley suggested that it be withdrawn until the neighbors bring it up. (5) Approval of plan for re -fencing the maintenance yard at 1701 N. W. 103rd Street - the plan for re -fencing the Village maintenance property as submitted by Mr. Bradford was approved by motion made by Mr. Moyer, seconded by Mrs. Johnson and passed unanimously. (6) Complaints concerning paint on Spear home at 9325 N. Bayshore Drive. A letter was received by the Planning Board from Dr. and Mrs. Spear advising that they are experimenting with colors and it will probably be changed. Mr. Moyer asked about the landscaping that was promised. (7) the Board.
