12-08-1977 Regular MeetingMIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING December 8, 1977 A regular meeting of the Miami Shores Planning and Zoning Board was held at 7:30 p.m, December 8, 1977, at the Village Hall, with the following members present: Mr. Albert R. Toussaint, Chairman Mr. Robert Stobs, II Mrs. Roberta Johnson Mr. James W. Dunaway Absent: Mr. Gordon H. Moyer, Jr. Mr. William R. Bradford, Building and Zoning Director, was also present. Minutes of the meeting of November 10, 1977, were approved as written by motion made by Mr. Stobs, seconded by Mrs. Johnson and carried. (1) A request was made by Victoria T. Peach, operating Montessori Children's House, 10390 N. E. 2nd Avenue (Advent Lutheran Church), to remove the restrictions placed by the Village in 1975 of a limit of 20 students and four persons operating the school. Mrs. Peach stated that the enrollment is showing a steady increase and she would like to be able to increase the number of students to between 50 and 75, which1he limit for her type of operation under County requirements; with students from 22 years to 6 years, never over 11 years; to operate from 8 a.m. to no later than 3 p.m. Miss Agnes Conlon, 10290 N. E. 2nd Avenue, complimented Mrs. Peach on her present operation but voiced objection to having a full grade school in this church, based on the problems that were encountered with the Bassett School. Mrs. Peach stated that she did not intend to go beyond the 6th grade. Mrs. William Hutchison, 230 N. E. 102nd St., had some reservations on increasing the number of students, as well as, Mr. & Mrs. Birch, 10204 N. E. 2nd Ave. After further discussion Mr. Stobs moved that the Board approve a maximum of 50 students with 6 teachers, pre-school through sixth grade, from 8 to 3 p.m. with a five-year limit from the original date of opening. The motion was seconded by Mr. Dunaway and carried unanimously. (2) The question of the fence that was erected, without permit, in the front yard of the Advent Lutheran Church was discussed. Mrs. Peach stated that she had paid for a permit in her bill from Sears. The church will call Sears and get them to take out a permit. (3) Mrs. Jacqueline P. Smith, 250 N. W. 112th Terrace, had a composition shingle roof installed without a permit, by Bills Roofing of North Miami, an unlicensed contractor. The job was stopped and the owner was told that tile was removed and tile should be replaced. Mrs. Smith was present 12/8/77 -2- to petition the Board, because of financial hardship, to allow her to complete the job with the composition shingles. After some discussion Mrs. Johnson moved that this request be referred to the Council. The motion was seconded by Mr. Dunaway and carried unanimously. (4) Materials and standards for roof coverings. A proposal for an ordinance on roofing requirements was submitted by Mr. Stobs, who stated that the material was taken from various city codes with the bulk from the Coral Gables code. After review and discussion of the requirements for re -roofing the Board agreed to maintain tile roofs where originally used. Mrs. Johnson moved that the proposed roofing ordinance be forwarded to the Council as a recommendation from the Planning Board. The motion was seconded by Mr. Dunn and carried unanimously. CCopy attached., (5) Mr. and Mrs. Ken Bagwell, on behalf of the Presbyterian Church Sunday School group, requested a temporary permit to sell Christmas trees from the church parking lot. The proposal was for three days through Saturday. Mr. Dunaway moved that the Board approve a temporary permit for the sale of Christmas trees from the church parking lot, with their proposed sign. The motion was seconded by Mrs. Johnson and carried unanimously. (6) Approval of revised parking layout and landscaping behind Village Hall. Mr. Bradford presented sketch of a revised parking plan behind the Village Hall, adding parking spaces along the west side of the property. After review of the plan Mr. Stobs moved the landscaping be done with full size hedge prior to paving and that the parking plan is approved as presented. The motion was seconded by Mrs. Johnson and passed unanimously. Mr. Dunaway left the meeting at about 9:30 p.m. Chairman Toussaint reviewed a list of items to be undertaken by the Board. The meeting adjourned at 9:55 p.m. Approved:4./i2 ,.� -L✓ { Chairman December 8, 1977 PROPOSED ROOF ORDINANCE ROOFS 1. All pitched roofs shall be constructed of: a. Clay tile b. White concrete tile c. Solid colored cement tile which color is impregnated with same color intensity throughout d. Thick butt varigated slate 2. Where there exists a roof of other material that was permitted at the time of original construction, additions to or replacements to said building shall use the same material. 3. All buildings with flat roofs shall be constructed with built-up roofing material. All roofs having an incline of less than 22" per foot shall be constructed of built up roofing and gravel. All flat roofs and roofs with inclines of less than 22" per foot shall be approved by the Planning & Zoning Board to be in harmony with the adjacent buildings. 4. Materials used for covering mansard facias shall be limited to those listed above for pitched roofs. 5. Flat roofs are permitted on additions to existing pitched roof structures providing: a. A cement or tile roof is not practical and this shall be determined by the Planning & Zoning Board. b. The addition shall not exceed 15% of the ground area of the existing building. c. The addition is not visible from the front elevation of the building on an inside lot, or is not visible from the front or side street elevations on a corner lot.
