04-14-1977 Regular MeetingMIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING April 14, 1977 A regular meeting of the Miami Shores Planning and Zoning Board was held at 7:30 p. m. , April 14, 1977, at the Village Hall, with the follow- ing members present: Mr. James O. Denham, Chairman Mr. Gordon H. Moyer, Jr. Mr. Kenneth R. Phoenix Mr. Robert Stobs, II Absent: Mr. Albert R. Toussaint Minutes of the last regular meeting of February 24, 1977, were approved as written by motion made by Mr. Phoenix, seconded by Mr. Moyer and carried. (1) Final plans were presented for Dr. Jay Ellenby's tennis court to be constructed at 1009 N. E. 94th Street. After a review of the plans with Dr. Ellenby, Mr. Phoenix stated that since the neighbors have no objection to this tennis court and since the owner is going to provide drainage and maintain a minimum of 10 ft. from the property line, and that he maintains or adds to the shrubbery, he would move that it be approved. The motion was seconded by Mr. Moyer and passed unanimously. (2) Mr. Osmond C. Howe, 975 N. E. 94th Street, appeared before the Board to request approval of a 2-1/2 ft. walkway along the rear setback of his proposed pool. The regulations for a rear pool setback where there is no alley, set as a guideline (not covered in the Zoning Ordinance) call for a rear setback for the pool of 7-1/2 ft. with a pool screen at 5 ft. Mr. Howe claimed a unique situation in that the property abutting his property on the rear was a very large lot with much open area. After discussion Mr. Phoenix moved that the request for paving within 2-1/2 feet of the rear property line be denied, based on the guidelines set up by the Planning Board and Council. The motion was seconded by Mr. Stobs but failed to carry on a 2/2 vote. Mr. Moyer asked who is responsible for enforcement of zoning regulations. He also suggested that the Village bulletin be used to advise people of the zoning regulations. The meeting adjourned at 8:30 p. m. Village Clerk Approved: C_
