11-11-1976 Regular Meeting1 1 1 MIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING November 11, 1976 A regular meeting of the Miami Shores Village Planning and Zoning Board was held at 7:30 p.m., November 11, 1976, at the Village Hall, with the following members present: Mr. James O. Denham, Chairman Mr. Gordon H. Moyer, Jr. Mr. Kenneth R. Phoenix Mr. Albert R. Toussaint Mr. Robert Stobs, II Mr. William R. Bradford, Building and Zoning Director, was also present. Minutes of the public hearing of October 28, 1976, were approved as corrected (a) concerning Mr. Vic Griffith's remarks, and (b) three 10 -story buildings, by motion made by Mr. Moyer, seconded by Mr. Toussaint and carried. Minutes of the Board meeting of September 23, 1976, were approved by motion made by Mr. Toussaint, seconded by Mr. Phoenix and carried. (1) The first business of the evening was to take action on the request for annexation of the Quayside Subdivision. Chairman Denham asked the Board to comment on the objections that were voiced at the hearing. In regard to concern over completion of the project, members of the Board commented on the assessed value of the property and its prime location. It was their opinion that there was little risk of it becoming marginal property. The police protection as outlined in the report submitted by the Chief of Police was discussed. Mr. Phoenix raised a question as to whether the completed project would ever require the optimum services estimated. The zoning was discussed and Village control over same after annexation. Mr. Moyer thought the condominium association might want to decrease their assessment by asking the Village to provide more services, as street maintenance, lights, extra police, etc. It was pointed out that the Village could not provide these services on private property. If certain services were required that are not now anticipated, they could probably be provided by special assessment. Concerning Country Club memberships, Mr. Mel Roberts, a critic of this annexation, agreed that the club could use the revenue as well as new members. 1 • 1 • 1 11/11/76 -2- The benefit to the Shores would be in the tax dollars which Mr. Toussaint figured was very conservatively estimated, and that there would probably be more revenue than what we are looking at. Mr. Stobs moved that the Planning & Zoning Board recommend to the Council that the Quayside annexation be approved subject to the restric- tions of the zoning as setforth now and that the Village Attorney ascertain that any changes would have to be approved first by Miami Shores. The motion was seconded by Mr. Toussaint. In the discussion that followed, Mr. Phoenix asked if we would have any assurance that the sewer line would be connected when the North Dade plant is in operation. The answer was that the County has jurisdiction and control over this requirement. 10 - Mr. Moyer stated that he did not believe the proposed three story buildings near the Boulevard would set a precedent or have any effect on the Shores zoning. In regard to a referendum, Mr. Moyer stated that he didn't believe the majority of Villagers voting on this would be sufficiently informed and he thought the Council would have to take this into consideration. The motion passed unanimously. (2) Review of action taken by the Board on October 14, 1976, in regard to a patio roof for Mr. & Mrs. R. C. Moore, 310 N. E. 98th St. ; At the recommendation of the Village Council, the Board reconsidered approval of the arbor type roof based on the same code re- quirement as pool enclosures. Since the question was raised that an arbor roof is the same as a trellis and should be considered under accessory building setbacks, Mr. Phoenix moved that the Board rescind the action of October 14, 1976, and deny the request for an arbor roof to be erected within three feet of the property line. The motion was seconded by Mr. Moyer and passed unanimously. Mr. Moyer brought up the noise nuisance caused by ambulances, planes, etc. but there appeared to be no remedy. Mr. Toussaint asked the Building Inspector if there is anything that can be done about the unsightly tree house at N. E. 97th St. and 6th Ave. The meeting adjourned at 8:45 p. m.
