09-30-1976 Special MeetingSPECIAL MEETING PLANNING AND ZONING BOARD September 30, 1976 A special meeting of the Miami Shores Village Planning and Zoning Board was held at 7:30 p.m. , September 30, 1976, at the Village Hall, with the following members present: Mr. Gordon H. Moyer, Jr. Mr. Kenneth R. Phoenix Mr. Albert R. Toussaint Mr. Robert Stobs, II Absent: Mr. James O. Denham, Chairman Mr. William R. Bradford, Building and Zoning Director, was also present. In the absence of Mr. Denham, Mr. Phoenix was elected to take the chair by motion made by Mr. Moyer, seconded by Mr. Toussaint and carried. This meeting had been called at the request of Mr. Jerry Lance, 246 N. E. 102nd Street, for consideration of a variance to allow a concrete pool deck to extend to the rear property line. The regulation requires a five-foot setback. Mr. Lance presented a letter explaining that the pool was inadvert- ently placed in a position where there is insufficient room for the pool deck to provide a five-foot setback from the property line. Mr. Lance also presented signatures of the neighbors who had no objection to this encroach- ment. After discussion Mr. Toussaint stated that from a practical point of view he saw no objection to the variance and moved that the Board grant a variance to Mr. Lance to pave to the property line as shown on the drawing. The motion was seconded by Mr. Stobs, but failed to carry on a 2/2 vote with Messrs. Phoenix and Moyer dissenting. In the discussion following the motion the Board was advised that no permit had been taken out for the carport that housed two vehicles and a boat. Also, that the original pool permit showed the pool patio having a five-foot setback. Mr. Stobs moved that the Building Inspector inspect the carport and report back to the Board and that Mr. Lance apply for a permit for the structure. The motion was seconded by Mr. Toussaint and carried. The meeting adjourned at 8:10 p. m. Clerk7,44..e.A.AA01)
