PLANNING AND ZONING BOARD MEETING
May 13, 1976
A regular meeting of the Miami Shores Village Planning and Zoning
Board was held at 7:30 p. m. , May 13, 1976, at the Village Hall, with the
following members present:
Mr. James O. Denham, Chairman
Mr. Gordon H. Moyer, Jr.
Mr. Kenneth R. Phoenix
Mr. Albert R. Toussaint
Mr. Robert Stobs, II
Mr. William R. Bradford, Building and Zoning Director, and Mr.
Earl K. Andersen, Village Manager, were also present.
Minutes of the last regular meeting were approved as written
by motion made by Mr. Stobs, seconded by Mr. Moyer and carried.
(1) A clarification was requested by the Village Council of
the action taken by the Planning Board on April 22, 1976, in regard to the
living area above the garage of the residence under construction at 440
N. E. 94th Street, owner, F. K. Foster. The points in question were the
petitions installed but not shown on the original drawing and a proposed
lavatory requested in conjunction with the use as an art studio.
Chairman Denham reported that the Board did approve the
installation of a lavatory and all members of the Board that were present
at the meeting confirmed this. Mr. Phoenix moved that the Board re -affirm
the action taken on April 22nd, as recorded. The motion was seconded by
Mr. Stobs and passed 3/1 with Mr. Moyer dissenting and Mr. Toussaint
abstaining as he was not present at the meeting referred to.
Mr. Moyer brought up the question of partitions being installed
without permit, as well as cabinets and sink, and the Planning Board requested
that the Village Attorney give an opinion as to whether it' . requirement of our
building code that a permit be obtained for changes of interior partitions on
new construction. Mr. Moyer also called attention to the fact that the con-
tractor had stamped an approval on some of the drawings on file. Mr. Toussaint
moved that the Board bring the matter of this approving of plans before the
Village Attorney as to whether or not there is a legality in signing same. The
motion was seconded by Mr. Moyer and passed unanimously.
(2) A request was made by Mr. Alan Mandel, 797 N. E. 94th St. ,
for approval of Waiver of Plat to establish new lot lines on Lot 28, Block 67,

Miami Shores Subdivision and Lot 3, Joni Heights Subdivision, (west side
of Biscayne Blvd. between 94th and 95th Streets). It was reported that
both lots had over the minimum square foot requirement. Mr. Phoenix
moved that the Waiver of Plat be approved subject to requirement for a
circular drive on Biscayne Blvd. and maintenance of the easement south of
Lot 3, Joni Heights. The motion was seconded by Mr. Moyer and passed
unanimously.
(3) The request of Militana, Militana & Militana, attorneys,
at 8801 Biscayne Blvd. , to leave the free-standing directorysign in front
of their office, was again before the Planning Board. On March 25, 1976
the Planning Board denied the request. At a subsequent Council meeting
the matter was referred back to the Planning Board since the petitioner
objected to the Board taking action when he was not present. After
listening to further argument by Mr. John Militana, Mr. Moyer moved that
the Planning Board reaffirm their action taken on March 25, 1976. The
motion was seconded by Mr. Toussaint and passed unanimously.
The meeting adjourned at 8:50 p. m.
