PLANNING AND ZONING BOARD MEETING
April 22, 1976
A regular meeting of the Miami Shores Village Planning and Zoning
Board was held at 7:30 p.m. , April 22, 1976, at the Village Hall, with the
following members present:
Mr. James O. Denham, Chairman
Mr. Gordon H. Moyer, Jr.
Mr. Kenneth R. Phoenix
Mr. Robert Stobs, II
Absent: Mr. Albert R. Toussaint
Mr. William R. Bradford, Building and Zoning Director, was also
present.
Minutes of the last regular meeting were approved as written by motion made
by Mr. Moyer, seconded by Mr. Phoenix and passed.
(1) A request was made by Mr. David D. Phillips, attorney, repre-
senting Mr. & Mrs. F. K. Foster, for approval of final plans for placement
of partitions and fixtures in the garage living area of a residence presently
under construction at 440 N. E. 94th Street, Lots 6 & 7, Block 51, Miami
Shores Subdivision. Mr. Phillips presented an affidavit for approval of a
revision in the plans for the garage rooms, stipulating use as an art studio
and re -affirming the previously filed deed covenant restricting the premises
from rental purposes. In discussing the reason why this plan is being
questioned Mr. Denham explained that the garage living area had been approved
as part of the plan for remodeling the old house and improving the premises
and not as part of a new plan. Mr. Phillips further offered to put up a bond
covering removal of the lavatory in question upon sale of the property. Mr.
Stobs moved that the request of Mr. and Mrs. Foster for an art studio be
approved subject to a bond being provided the Village in the amount of $250. 00
to cover cost of the removal of the lavatory at the time the property changes
hands, plus having the new deed restriction recorded. The motion was
seconded by Mr. Phoenix and passed 3/1 with Mr. Moyer dissenting.
(2) A request was made by the Keyes Co., representing the
Federation of Jewish Agencies of Greater Philadelphia, for approval of
Waiver of Plat for re -alignment of lot lines on Lot 3A and Lot 4 of Block 75,
Miami Shores Section 3, (west side of Biscayne Blvd. between 95th and 96th
Sts.) It was noted that the plan meets minimum lot requirements. Mr. Moyer
moved that the waiver of plot be approved. Motion was seconded by Mr.
Phoenix and passed unanimously.

(3) A memo was received from Mr. Toussaint on "grade criteria
for determining heights of walls, fences, and hedges in Miami Shores
Village", copy attached hereto. Mr. Phoenix moved that this proposed
amendment to Ordinance No. 270, Sections 518 and 519, be recommended
for adoption. The motion was seconded by Mr. Moyer and passed unanimously.
The Board discussed the Dade County Master Plan in regard to
rebuilding the maintenance shop facilities and it was stressed for the Village
Council, that a proper zoning classification should be established on the
maintenance property before the Master Plan is adopted.
The Board also requested that the Council take note of the Board's
concern over the increasing aircraft noise and fire and rescue vehicle sirens.
The meeting adjourned at 8:45 p. m.

Subject: Grade Criteria for Development of Walls,Fences,
Hedges in Miami Shores Village.
Mr. Chairman; After considerable research and conversations
with Messer's Mr. William Bradford, Building Director, Mr.
Henry Boliek, Maintainance Supervisor,Detective Camphor of
the Police Department and Mayor McIntosh, I would like to
recommend a proposed Amendment to Village Ordinance 270,
Sections 518 & 519 defining the "Establishment of Grade Criteria
for Development of Walls, Fences, and Hedges in Miami Shores
Village as follows;
(1) Front yards or side yards abutting Public Right of Way
will be controlled by existing grade at sidewalk or adjacent
street. Grade reference will be controlled by the lower of
the two grades.
Front yard grade where sidewalks do not exist shall be
controlled by the adjacent street.
(2) Grades along interior side yard lines will be along the
finished yard grade or ground elevation. In the event of a
difference of grade created by cutting or filling of an
adjacent lot, the average grade of the abutting lots will
prevail.
(3) Rear yard grade will" be defined as the center line
grade of the alley pavement as constructed or the grade of
the yard, the lower grade of the two will be the grade
reference mark.
(4) In the event of a pronounced rise or fall in the property
line of an intended improvement an average elevation will be
determined by taking elevations along the wall, hedge or fence
line at five foot intervals and totaling the sameand then
dividing by the number of stations of which the elevations
were taken.
In Council Meeting of April 6,1976, Village Manager , Mr Andersen
presented an Amendment to our Lot Cleaning Ordinance 34, to
control plant growth in Public Right of Ways. This was a part
of the Mayor's request of January 22, 1976 in conjunction
with the Hedge Height problem and will answer the area of
Mr. Boliek's problems concerning clearance for Trash and
Garbage Trucks in the alleys which we have discussed previously.
This information concludes my,report on this subject at this
time.
