08-14-1975 Regular MeetingMIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING August 14, 1975 A regular meeting of the Miami Shores Village Planning and Zoning Board was held at 7:30 p.m. , August 14, 1975, at the Village Hall, with the following members present: Mr. James O. Denham Mr. Gordon H. Moyer, Jr. Mr. Kenneth R. Phoenix Mr. Bob Stobs, II Absent: Mr. Albert R. Toussaint Mr. William R. Bradford, Building and Zoning Director, was also present. Mr. Moyer moved that Mr. James Denham be named the new Chairman of the Board. The motion was seconded by Mr. Phoenix and passed. Minutes of the last meeting were approved as written by motion made by Mr. Phoenix, seconded by Mr. Moyer and carried. (1) A request was made by Dr. Gene Eng, 9420 Park Drive, for permission to leave an awning carport he had erected on the Park Drive side of his building, which is in an "O" zone across from a "C" zone. The canvas carport was erected without a permit. After discussion Mr. Moyer moved that the request be denied and that the structure be taken down within 30 days. The motion was seconded by Mr. Phoenix and passed unanimously. (2) A request was made by Laura McCarthy, Inc. , Realtor, 8601 Biscayne Blvd. , to change the Zoning Ordinance, Section 504, covering sign regulations, to permit a "sold" sign to be displayed on property. Pending further study Mr. Phoenix moved that the request be tabled for the time being. The motion was seconded by Mr. Moyer and carried. (3) A letter written by Mr. Alan Kridel, 1579 N. E. 104th St. , was forwarded to the Board by Mr. Fred Astor, for consideration by the Board of the complaints voiced by Mr. Kridel concerning conditions on 104th St. , east of 12th Ave. The Board discussed passing an ordinance requiring the upkeep of property, also getting more cooperation from the Police Dept. in prohibiting fishing and trespassing along the canal. In regard to trash on the parkway it was suggested that the neighbors be asked to cooperate in not putting it out a week before the collection. Mr. Bradford will look into boats and trucks in the front yards. Chairman Denham stated he would answer this letter along these lines and suggest that the neighbors organize themselves and insist that the trash be • • -2- put out on the day before collection. 8/14/75 (4) Mr. Bill Kofoed, 1298 N. E. 104th St. , Lot 5, Block 2, River Bay Park Additi..r, after obtaining a permit for addition to a bedroom and starting construction, has run into an easement problem with an adjoining neighbor, Mrs. Arthur Gasche, 1297 N. E. 103rd St. Along the rear of the property on 104th St. in this block there is a utility easement of 7 1/2 ft. , causing the properties on 104th St. and 103rd St. to be in doubt as to rear setback lines. After checking the house plans on file it appeared that the addition would not need a variance on the rear setback. Mr. Phoenix moved that Mr. Bradford meet with the contractor and measure both pieces of property to establish if there is a 7-1/2 ft. easement, that if there is no violation they proceed with the addition; further, if the setback problem exists that it be referred to the Council to resolve.
