06-26-1975 Regular MeetingMIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING June 26, 1975 A regular meeting of the Miami Shores Village Planning and Zoning Board was held at 7:30 p.m. , June 26, 1975, at the Village Hall, with the following members present: Mr. Fred G. Astor, Chairman Mr. Gordon H. Moyer, Jr. Mr. James O. Denham Mr. Kenneth R. Phoenix Mr. Albert R. Toussaint Prior to the meeting the Board visited the home of Mr. and Mrs. Leonard Spragg, 73 N. E. 108th Street, to observe the noise problem caused by an air conditioning unit in the neighboring side yard. Mr. Moyer moved that the minutes of the last meeting be approved as written. The motion was seconded by Mr. Phoenix and passed. (1) Mr. Eugene L. Simm, Director of Metro Traffic and Trans- portation, was present to discuss a plan for re-routing traffic on Park Drive between N. E. 6th Avenue and N. E. 96th Street. This plan called for vacating the right-of-way between 95th and 96th Streets. Property owners on Park Drive from 96th St. south to 6th Ave. had been notified of this meeting. In the discussion that followed it was pointed out that there should be a way through the property for bicycle traffic from the Community Center and proper access for fire trucks. Mr. Denham moved that the Planning Board recommends that the closing of Park Drive in accordance with the Metro recommendation be accepted by the Village as the Board considers this to be an improvement to the traffic flow and to the orderly development of the area. The motion was seconded by Mr. Toussaint and passed unanimously. (2) Discussion of noise ordinance - The Board discussed the complaint made by the Spraggs at 73 N. E. 108th St. on the air conditioning unit installed in the side yard of the adjacent home. It was pointed out the difficulty of arriving at acceptable noise levels if a more specific ordinance were written. In an attempt to resolve this problem Mr. Phoenix moved that the Board take action in form of contacting the owner of the equipment to state the facts as known at the time the permit was issued and see if some reason- able solution can be worked out between the two parties and that any expense incurred be shared by both parties (which Mr. Spragg had agreed to). The motion was seconded by Mr. Moyer and passed unanimously. It was suggested that air conditioning units not be placed in side setbacks without consent of the neighbor.
