MIAMI SHORES VILLAGE
PLANNING AND ZONING BOARD MEETING
April 24, 1975
A regular meeting of the Miami Shores Village Planning and Zoning
Board was held at 7:30 p.m. , April 24, 1975, at the Village Hall, with the
following members present:

Mr. Gordon H. Moyer, Jr.
Mr. James O. Denham
Mr. Kenneth R. Phoenix
Absent: None (vacancy existing)
Mr. William R. Bradford, Building and Zoning Director, was also
Minutes of the last regular meeting were approved as written.
(1) Mr. W. W. Reinhardt, Jr. of 78 N. W. 106th St., requested
permission to leave an awning carport in front of his house. Mr. Reinhardt
was notified that the awning did not comply with the zoning ordinance and that
no permit had been secured. Mr. Bradford reported that he had had an inquiry
from another party on this type of construction and as a result other awnings
found in existence had been cited' in violation. The zoning ordinance does not
permit any construction in the front setback. Mr. Reinhardt petitioned the
Board to allow him to keep this structure since he had not known it was not
permitted and because it has been there since 1969. It was the feeling of the
Board that to allow this use would establish a precedent that would weaken our
zoning. Mr. Moyer moved that the request be denied. The motion was seconded
by Mr. Denham. Mr. Phoenix stated he would like to see if the Board can
help this man relocate the awning in his side or back yard. The motion was then
passed unanimously. Mr. Reinhardt stated that he would make an appeal to the
Council.
(2) Mr. George A. Frix, Jr. requested a variance to permit con-
struction and "Special Use" on Lot 9, Block 30, Miami Shores Section #1, which
is located behind Thomson McKinnon and within the X Zone, for office use as
provided within the "O" Zone. The Building Director felt this request should be
for a change of zone and not a variance. The parking lots 8 & 9, Block 30, had
been purchased by Dr. Burnam to be used in conjunction with the parking plan
• for a medical building at 96th St. and N. E. 2nd Ave. , which did not materialize.
The lots subsequently had been offered for sale to the Village but no acknowledg-
ment had been received on this offer. Mr. Frix stated that in order to recoup
from this investment the owners were considering (a) construction of an office
building, (b) construction of a single family home, or (3) sale to the Village
for a fire station. After discussing the proposed uses for this property

Mr. Phoenix moved that the Council consider purchasing Lots 8 and 9, Block
30, 100 ft. on N. E. 97th Street and 115 ft. deep, for parking or other future
uses. The motion was seconded by Mr. Denham and passed unanimously.
(4) Letter from the Village Manager concerning location for a
new Fire station subsequent tohe merger of the Village Fire Department
with Metro: After discussion this subject Mr. Denham moved that the
Planning and Zoning Board recommends that a location for the Metro Fire
Station be found outside the limits of Miami Shores and that the Board would be
glad to meet with the Village Manager or Village Council and Fire Department
officials to discuss possible sites outside the Shores. The Planning and Zoning
Board feels that locating the fire station in the prime areas of Miami Shores
would create a nuisance and depreciate the adjacent residential area, would
remove valuable property from the tax roll and also would require purchasing
of property that is more expensive than other property in the nearby area. This
motion was seconded by Mr. Phoenix and passed unanimously.
Chairman Astor reported that the speed limits had been reduced on
Biscayne Blvd. and N. E. 2nd Ave. and wanted the Board to push for a light
in front of the Country Club and a left -turn lane at 105th St., as well as make
a second request to the Council to have the speed limit on 103rd Street reduced
to 30 m. p. li.
Mr. Astor also stated he would like to see the Board get going on
working with the Village Attorney to re -vamp the zoning ordinance. He further
added that he had had a request for the Board to study noise regulations.
The Board requested copies of any available noise pollution ordinances.
The meeting adjourned at 8:55 p. m.
