PLANNING AND ZONING BOARD MEETING
March 27, 1975
A regular meeting of the Miami Shores Village Planning and Zoning
Board was held at 7:30 p.m. , March 27, 1975, at the Village Hall, with the
following members present:
present.
Mr. Fred G. Astor, Chairman
Mr. Gordon H. Moyer, Jr.
Mr. James O. Denham
Mr. Kenneth R. Phoenix
Absent: Mr. Donald W. McIptosh
Mr. William R. Bradford, Building and Zoning Director, was also
Minutes of the last regular meeting were approved as written.
(1) Approval of plans submitted by Mr. Donald R. Melton
for remodeling the home at 160 N. E. 102nd Street (a non -conforming residence)
was again deferred pending Mr. Melton's appearance.
(2) Mr. F. K. Foster, presented plans for remodeling the home
at 440 N. E. 94th Street, with the following request:

Phase A: Approval of additions & renovations
of existing structure and demolition
of auxiliary building.
Phase B: Approval of new garage with guest
quarters to be placed on adjoining lot.
Grant west setback variance to allow new
addition to match face of existing residence,
proposed setback 5 ft.
Mr. Foster stated he is purchasing the 50 ft. lot to the
east of this home and is willing to tie the two lots together with a unity of title
and sign an affidavit that the guest quarters will not be used for rental purposes.
Mr. Phoenix moved that the Board give approval based on
the 50 ft. lot to the east becoming a part of the main parcel through a unity of
title, that the existing building remain and any new buildings line up with the
existing wall on the west, that the entire project be built as one unit and upon
issuance of a temporary C. O. for the residence that the new garage will be

completed within 90 days, that the existing garage will be demolished before
issuance of a final C.O. and that there will be a deed restriction filed against
rental of the new garage guest quarters. The motion was seconded by Mr.
Moyer and passed unanimously.
The Board wanted the record to show they were approving these
variances in order to eliminate a 50 ft. lot, demolish a non -conforming
structure and improve an old home.
Mr. Bradford reported on the Village Fair, 9636 N. E. 2nd Ave. ,
in regard to their temporary signs and licenses but advised that nothing
could be determined until the Fair was in full operation.
Mr. Astor brought up the crime situation in Miami Shores and asked
the Board to recommend to the Council that we stiffen enforcement of the
hedge ordinance on a sales basis to get property owners to trim their hedges
and trees so that the homes are not so hidden.
Mr. Moyer brought up a truck parked in the front yard at 70 N. E.
99th St. and asked for better enforcement of trailer, truck and boat regulations.
Mr. Moyer also discussed a low flying helicopter that regularly flies over the
Shores and asked that the Council consider filing an injuction against low flying
helicopters, as well as the increasing commercial air flights over the Shores.

Mr. Phoenix called attention to the run-down condition/on the east
side of N. E. 2nd Ave. just north of the Library and thought the Village should
condemn the house.
The meeting adjourned at 8:30 p.m.
