PLANNING AND ZONING BOARD MEETING
March 13, 1975
A regular meeting of the Miami Shores Village Planning and Zoning
Board was held at 7:30 p.m. , March 13, 1975, at the Community Center, with
the following members present:
Mr. Fred G. Astor, Chairman
Mr. Gordon H. Moyer, Jr.
Mr. James O. Denham
Mr. Kenneth R. Phoenix
Mr. Donald W. McIntosh
Mr. William R. Bradford, Building and Zoning Director, and Mr.
Richard M. Lund, Village Attorney, were also present.
Minutes of the last meeting were approved as written by motion
made by Mr. Denham, seconded by Mr. Moyer and carried.
(1) A request was made by Mr. Donald Gerloff, 1350 N. E. 101st
Street, for permission to operate from and park a helicopter in his back yard.
Mr. Gerloff proposes to create a heliport on a barge anchored to his seawall
to the rear of his house. A report was received from the Police Dept. indicat-
ing that numerous complaints had been made concerning this helicopter and
that on contacting the FAA, were told that from a safety standpoint there is no
problem. A letter was received from Attorney David P. Catsman, represent-
ing Mr. Robert Cook, 9801 N. E. 13th Ave. , requesting that the Village Council
enforce the zoning ordinances which are being violated by a helicopter landing
and taking off in an area which is not zoned for airplane or helicopter use.
Mr. Gerloff presented three letters from his neighbors
approving this use.
Mr. Lund stated that in an R zone (which this is) the
permitted zoning is for single family residences and no other use is permitted
in that area, unless the use could be considered as an accessory to a single
family residence. Mr. Lund concluded that under our present zoning ordinance
he did not believe it could be granted unless the Board shall determine this is
an accessory use to a residence.
Mr. McIntosh moved that the Board deny the request
based on Section 501 of the existing zoning ordinance of Miami Shores Village
and also on Section 606, paragraph (b); Section 501 pertaining to uses in a
zoned district and 606 (b) state "there shall be no noise or vibration resulting
from or in connection with the use that is perceptible from any part of any
"R", "A", or "O" District. " The motion was seconded by Mr. Moyer and
passed unanimously.

(2) Request was made by Mr. Donald R. Melton, 160 N. E.
102nd St. , for approval of plans for adding to a non -conforming residence
(side yard setback). In addition to the setback the Building Director asked the
Board to review the plans as to architectural conformity to the neighborhood.
After some discussion and request for a plot plan, Mr. Moyer moved that
this request be tabled until the Board can study it further with a survey of the
property. The motion was seconded by Mr. McIntosh and passed unanimously.
(3) PUBLIC HEARING:
A request was made by Barry College to change the zoning
on the west ten acres of the vacant property abutting N. W. 2nd Avenue between
N. W. 111th Street and N. W. 115th Street, running east approximately 316 feet,
from COLLEGE USE to KENNEL CLUB PARKING.
Chairman Fred Astor read the request made by Barry College
for the zoning use on the property in question as a parking lot for the Kennel
Club.
Shepard Broad, Chairman of the Board of Trustees of Barry
College, asked to speak in behalf of the College. At the termination of his
remarks Mr. Broad presented a copy of a letter to the Chairman of the Planning
Board, from Sister M. Trinita Flood, President of Barry College, the original
of which had been delivered earlier to the Village Clerk. This letter was read
as follows:

Gentlemen:
This is to advise you that Barry College hereby
withdraws its written application to you dated February
25, 1975 requesting a change in zoning of a ten -acre
rectangular tract of land owned by Barry College adjacent
to and lying east of N. W. 2nd Avenue, Miami Shores,
Florida, as shown on the drawing heretofore submitted to
you in connection with said application.
The meeting adjourned at 8:35 p. m.
