10-25-1973 Regular MeetingMIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING October 25, 1973 A regular meeting of the Miami Shores Village Planning and Zoning Board was held at 7:30 p.m., October 25, 1973, at the Village Hall, with the following members present: present. Mr. Fred G. Astor, Chairman Mr. Gordon H. Moyer, Jr. Mr. James O. Denham Mr. Kenneth R. Phoenix Mr. Donald W. McIntosh Absent: None Mr. William R. Bradford, Building and Zoning Director, was also Minutes of the last meeting were approved as written. (1) A request was made by Mr. Mirco Falle, a foreign student at Barry College who recently purchased the home at 64 N. W. 111th Street, to remodel the home for the purpose of providing additional bedrooms to accommodate five other foreign students. In reviewing the Zoning Ordinance as to use of a single family home, Section 216 permits "not more than 4 persons not related by blood or marriage". Mr. Denham moved that the request for variance as to use be denied. The motion was seconded by Mr. McIntosh and passed unanimously. Mr. McIntosh then moved that this section of the ordinance be tagged for further study. The motion was seconded by Mr. Denham and pas sed. (2) Mr. Mandel, owner of the new house at 797 N. E. 94th Street, appeared before the Planning Board for consideration of his request to keep the alley along the west side of his property from being paved. Mr. Mandel claimed that this alley would become heavily traveled by thru traffic from N. E. 8th Avenue. Mr. Denham moved that the Board refer this to the Village Manager for a recommendation concerning garbage pick-up and police and fire protection. The motion was seconded by Mr. Phoenix and pas sed. (3) Mr. Robert Squilla, 76 N. E. 102nd Street, appeared before the Board to request permit to build living quarters in the garage on the rear of the property which is a non -conforming building having only 5 ft. rear and side setbacks. Mr. Squilla had been told by his builder that he could get a permit to convert the garage into two bedrooms and bath. The Chairman, speaking on behalf of the Board, stated there was no way the Board could 10/25/73 -2- approve this request in view of our zoning regulations. (4) Chairman Astor requested that a Vice -Chairman be named to the Board and Mr. Denham was elected for this position by motion made by Mr. McIntosh, seconded by Mr. Moyer and passed. (5) Mr. Astor requested that a procedure be established for requiring identification of plans submitted for approval. Mr. Bradford presented a proposed stamp to be put on all plans to show approval, date, remarks, etc. , which was accepted by the Board with some minor changes. ( ) The_Chairman brought up some problems concerning the apartments being built by the Nelecar Corporation along the Railroad between 91st and 87th Streets. Mr. Astor referred to the setbacks and building elevations as brought out by a survey made by Mr. McIntosh. As to drainage at the lowest elevation along 87th Street, the Building Inspector stated that the builder is putting up a retaining wall for this purpose. As to the setback of the recreation building Mr. Bradford reported that he had talked to the owner about moving it back and was told it would cost about $16, 000 and that they were opposed to the move. It was pointed out that the architect must have known our setback requirements since all other requirements were met. Mr. Denham moved that since the recreation building under construction at the Shores Villas townhouses has only a 15 ft. setback that the Planning Board recommends that the developer move the building back to a 25 ft. set- back as required by the zoning ordinance, and it is further recommended that the developer be required to provide an adequate soakage pit and curbs at the south portion of the property to prevent flooding. The motion was seconded by Mr. McIntosh and passed unanimously. Mr. McIntosh moved that the Board recommend that the Council give serious consideration to requiring some type of maintenance agreement satisfactory to the Village Attorney to assure us that the entire development will be properly maintained. The motion was seconded by Mr. Denham and pas sed. Zoning ordinance revisions: Mr. Phoenix presented his studies on assigned problems in our zoning regulations which are to be written up and presented for action by the Board at a future meeting. Planning & Zoning Board meeting of November 22nd - Inasmuch as the 2nd meeting in November falls on Thanksgiving Day, the Board decided to hold this meeting on the fifth Thursday, or November 29th, if there is any business to transact.
