PLANNING AND ZONING BOARD MEETING
February 22, 1973
A regular meeting of the Miami Shores Village Planning and Zoning
Board was held at 7:30 p.m. , February 22, 1973, at the Village Hall, with
the following members present:
Mr. Harry F. Smenner, Jr., Chairman
Mr. Gordon H. Moyer, Jr.
Mr. James O. Denham
Mr. Kenneth R. Phoenix
Absent: Mr. Fred G. Astor
Mr. William R. Bradford, Building and Zoning Director, was also
present.
Minutes of the last meeting were approved as written by motion made
by Mr. Denham, seconded by Mr. Phoenix and passed.
(1) A request was made by R. L. Developers, Inc. & Nelacar
Corp. to construct 88 apartment units on Block 19 and 20, El Portal Subdivision,
which is adjacent to the railroad tracks between 87th Street and N. E. 91st
Street. The Building Inspector reported that the plan included 43 three-bedroom
apartments and 45 two-bedroom apartments, the square foot requirements for
which met the density requirements based on land area. The parking require-
ment is 132 spaces and the plan provides 140. There were no variances to
be considered.
A discussion arose by Mr. Arthur Moreno and Mr. Ken Greenblat
questioning the right to put condominium apartments in an apartment zone.
Mr. Denham stated that he felt the Board needed a legal opinion as to whether
condominiums can go in an apartment zone and moved that action be deferred
until the Board receives an opinion from our Village Attorney. The motion
was seconded by Mr. Moyer and carried.
(2) ZONING HEARING - Dr. Paul Stratos
A request was made by Dr. Paul Stratos, owner of Lots 10, 11
and 12, Block 3, El Portal Subdivision, for permit to build a ten -unit apartment
building on said property, which is located on the east side of N. E. 2nd
Avenue, south of 91st Street. Since this property is zoned residential the petition
required a public hearing for consideration of zoning change for apartment use.
Property owners within 500 ft. of the area had been notified of the hearing.
Mr. Irving E. Horsey, architect for Dr. Stratos, presented the
plan for this apartment building and sketch of the elevation. He stated that

that Pollution Control had given permission for a package sewage trestment
plant. Dr. Stratos explained that he had owned the property for 15 years,
that he hadn't understood the zoning when he bought it, that it had cost him
a great deal to maintain over the years and that he was asking for some con-
sideration to use the property.

Mr. Lee Wilson, 236 N. E. 91st Street, stated he was against re-
zoning for apartments.
Mr. L. K. Kemper, attorney for Mr. Tokose, 235 N. E. 91st St. ,
spoke against this rezoning. He stated that there are no apartment houses
along N. E. 2nd Avenue and rezoning would open the door to all kinds of
rezoning requests.
Mrs. O. B. Simmons, 257 N. E. 91st Street, was against rezoning.
Mrs. Elaine Rheney, 280 N. E. 91st Street, voiced objection.
Mrs. J. B. Croft, 250 N. E. 91st Street, was definitely against
any multiple family residences on the corner of 91st Street and N. E. 2nd Avenue
with parking and traffic density.
Mr. Albert Warner, 148 N. E. 91st Street, was against rezoning.
Mr. J. Shoares, 290 N. E. 91st Street, was against rezoning.
Mr. William Alexander, 234 N. E. 92nd Street, was against apart-
ments.
Mr. Joseph V. Dugoni, 166 N. E. 92nd Street, pointed out the increased
density of people that would live on this property and how other areas on 2nd
Avenue would be affected.
Dr. John Holly, 220 Grand Concourse, stated this zoning would open
up zoning on 2nd Avenue.
Mrs. Elizabeth Th.or,nton, representing the Goodfellow property at
190 N. E. 91st Street, was against the rezoning.
Mr. Gordon Sither, 253 N. E. 92nd Street, stated that this could put
five times more people on that property than single family zoning and that he
was definitely against any. rezoning.
Mr. Bob McKenney, 145 N. E. 110th Street, was concerned that this
would open up the zoning all along 2nd Avenue.

Chairman Smenner read a letter received from Dr. Wittich/approving
this petition.
Mrs. Deeds, 200 Grand Concourse, spoke against rezoning.
Mrs. Carlton Hayward, 240 Grand Concourse, was against rezoning
as it will go right down 2nd Avenue.
Mr. Arthur Moreno, 246 N. E. 92nd Street, was against rezoning, stated
he would buy the lots and build residences.
Chairman Smenner explained that any property owner is permitted to
have a hearing for rezoning and the Board cannot deny the person the opportunity
to be heard. The Board can set the ground rules, establish the procedure to
be followed in handling this hearing. Other than that the course of action is
automatic. Every property owner is entitled to a hearing of this type. Mr.
Horsey stated that he and his client appreciated the Board's consideration.

Mr. Denham moved that the Board deny the request for change
of zoning on this property for the reasons (1) that basically it is not a good
idea for spot zoning and (2) the general opposition to increased density and
change. The motion was seconded by Mr. Moyer and carried.

The Building Inspector/on the sewage treatment plant for the
apartment on N. E. 8th Ave. at 90th Street, that the Village Attorney advised
that the Village had no jurisdiction in the matter and that the Council on
February 20th had given them approval to go ahead. Mr. Moyer stated that
he was against this plan for an apartment in the County using a plant located
within Miami Shores.
The meeting adjourned at 8:40 p. m.
