11-09-1972 Regular MeetingMIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING November 9, 1972 A regular meeting of the Miami Shores Village Planning and Zoning Board was held at 7:30 p.m., November 9, 1972, at the Village Hall, with the following members present: Mr. Harry F. Smenner, Jr. , Chairman Mr. Gordon H. Moyer, Jr. Mr. Fred G. Astor Mr. James O. Denham Mr. Kenneth R. Phoenix Absent: None Minutes of the last meeting were approved as written by motion made by Mr. Denham, seconded by Mr. Moyer and passed. (1) On July 10, 1972, Mr. Alan M. Kridel of 1579 N. E. 104th St. , was notified that the hedge of trees west of his home was in violation of the zoning ordinance. Dr. Gilbert Friedman, the next door neighbor, objected to the height of these trees. After several postponements the matter was before the Board with attorney Kenneth Bevan representing Mr. Kridel and attorney Robert Golden representing Dr. Friedman. Mr. Golden argued that the trees constitute a hedge. Mr. Bevan contended that the trees were planted four feet apart and do not constitute a hedge. Mr. and Mrs. Kridel want the trees for privacy and Dr. Friedman can't cope with the leaves that fall in his pool. The Board did not feel they should be put in the position of defining the word "hedge" and asked the parties involved to work out a compromise and the following was tentatively agreed upon by the attorneys: that the trees on the Kridel property be cut and maintained at a height of ten feet from the water along the property line in question to the edge of the north wall of the Friedman living room. (2) A request was made by Mr. and Mrs. John N. Cumming of 9314 N. W. 2nd Place, to convert their existing garage into an office with a bath. The plans show no way of access from the house to the office, with only an outside door from the side yard into the proposed office. As it appeared this conversion could create two living units Mr. Astor moved that the request be denied. The motion was seconded by Mr. Moyer and passed. (3) Mr. H. W. Bendle of 501 N. E. 101st St. , requested a variance on the trailer regulations to allow his 32 ft. camper trailer in his rear yard. After some discussion Mr. Denham moved that the request for variance be denied. The motion was seconded by Mr. Astor and carried. The meeting adjourned at 9:35 p. m. s Village ,f erk
