PLANNING AND ZONING BOARD MEETING
December 9, 1971
A regular meeting of the Miami Shores Village Planning and Zoning
Board was held at 7:30 p. m. , December 9, 1971, at the Village Hall, with
the following members present:
Mr. Irving E. Horsey, Chairman
Mr. Gordon H. Moyer, Jr.
Mr. Fred G. Astor
Mr. James O. Denham
Mr. Harry F. Smenner, Jr.
Absent: None
Mr. William R. Bradford, Building and Zoning Director, was also
present.
Upon motion made by Mr. Moyer, seconded by Mr. Astor and passed
the minutes of the last meeting were approved as written.
(1) Old Business:
Mr. Walter Lavigne's request to leave his orchid house where
it is presently located: His address is 320 N. E. 96th Street. After further
discussion of the orchid house location and objections to granting the required
variance, Mr. Astor moved that the Board deny the request to leave the orchid
house where it is and insist on its being moved to the position which was
approved. The motion was seconded by Mr. Smenner and passed 3/2 with
Mr. Denham and Mr. Moyer dissenting.
(2) Old Business:
Dr. Morris Kuckku's request for annexation of the residences
on N. E. 91st Street from 10th Avenue to the Bay:
The Board reviewed the report from the Village Manager but
felt more information was needed before moving on this request. Mr. Smenner
moved that this be referred to the staff of members who may be concerned
with the annexation, notably, the Village Manager, Director of Planning and
Zoning, Fire and Police authorities, County Club Association, and further-
more that these staff members be asked to point out any problems that might
be encountered that might make the annexation undesirable. The motion was
seconded by Mr. Astor and passed unanimously.
(3) A request was made by Mr. Gordon Moyer for permission to
demolish an old house at 60 N. E. 99th Street on a 50 ft. lot next to his home.
After a review of the plans Mr. Smenner moved that permission be granted
to tear down the old house and that this plan be approved for the 50 ft. lot, The
motion was seconded by Mr. Denham and carried with Mr. Moyer abstaining.

(4) Mr. George Reithel, representing Dr. and Mrs. Irving
Waldman, 1234 N. E. 96th Street, requested permit to erect a tennis court
in the rear of the above listed property with a fence that will exceed the
height limitation. In the discussion that followed Mr. Reithel stated that the
owners would be willing to stipulate that uponsale of the property the fence
would be taken down. An affidavit was presented indicating that the contiguous
neighbors had no objections to this fence. Action was deferred on this
request until the first meeting in January so that the Board may have further
time to consider a reasonable solution to the problem of a high fence.
