PLANNING AND ZONING BOARD MEETING
June 24, 1971
A regular meeting of the Miami Shores Planning and Zoning
Board was held at 7:30 p. m. , June 24, 1971, at the Village Hall, with the
following members present:
Mr. Irving E. Horsey, Chairman
Mr. Gordon H. Moyer, Jr.
Mr. Fred G. Astor
Mr. James O. Denham
Absent: Mr. Harry F. Smenner, Jr.
Mr. William R. Bradford, Building and Zoning Director, was
also present.
Mr. Moyer moved that reading of the minutes be dispensed with
and that they be approved as written. The motion was seconded by Mr. Astor
and carried.
(1) Miss Jean Pellegrino, 144 N. E. 91st St.
The problems concerning the appearance of the above
property as well as use of the non -conforming building were deferred at
the last meeting pending an opinion from the Village Attorney on the Planning
Board's jurisdiction in the matter. Mr. Thomas C. Britton, acting for
Thomas H. Anderson, Village Attorney, stated on the non -conforming build-
ing that "under these circumstances, there appears to be no action the
Board may take on neighborhood complaints concerning the two non -conform-
ing garage apartments unless it be demonstrated that the facts as reported
to the Manager are in error." Concerning the request for Village assistance
on the drainage he stated that "the Board may, if it so chooses, make the
requested recommendation to the Council".
A report submitted by Mr. Robert Lewin, 136 N. E. 91st
Street, was sent to the Board. Mr. Lewin reviewed different changes that
had taken place with regard to this property in the last few years and presented
photographs showing how the property is being kept.
Mr. Astor thought this was a blight on the Village and that
we should make every effort to straighten out the situation and moved that
the Board suggest to the Council that they employ the Village Attorney to file
a suit for elimination of a non -conforming use on the basis of the fact that
the property has not been continued at the same extent of occupancy and that
the citizens of Miami Shores affected directly by this non -conforming use

deserve every attempt possible for the Village to clean it up. The motion
died for lack of a second.
Mr. Moyer's motion to deny request for drainage also failed for
lack of a second. After further discussion Mr. Denham moved that the
Planning and Zoning Board is of the opinion that the use and lack of main-
tenance of the non -conforming property at 144 N. E. 91st Street is creating
a neighborhood nuisance and that we request that the Village Attorney
investigate the possible elimination or cancellation of the non -conforming
use based on a change of intensity of use and extent of occupancy of land
since the original ordinance in 1956. The motion was seconded by Mr. Astor
and passed unanimously.
Inspection station: Mr. Moyer moved that the Board commend
the Council for action taken on phasing out the automobile inspection station
at the Village Hall location. The motion was seconded by Mr. Astor and
passed unanimously.
The meeting adjourned at 8:15 p. m.
