PLANNING AND ZONING BOARD MEETING
October 22, 1970
A regular meeting of the Miami Shores Planning and Zoning
Board was held at 7:30 p.m. , October 22, 1970, at the Village Hall, with
the following members present:
Mr. Donald W. McIntosh, Chairman
Mr. Gordon H. Moyer, Jr.
Mr. Thomas H. Baden
Mr. Irving E. Horsey
Absent: Mr. Fred G. Astor
Mr. William R. Bradford, Building and Zoning Director, was
also present.
Minutes of the last meeting were approved as written by motion
made by Mr. Moyer, seconded by Mr. Horsey and passed.
(1) Mr. Charles H. Markel, architect, representing Mr.
Gianaris, owner of the Mt. Vernon Motor Lodge, 9221 Biscayne Blvd. ,
requested consideration of a preliminary plan of an expansion program for
the motel. This program is in two phases: Phase one, to add 17 efficiency
units to the back of the existing building and Phase two, to demolish the
one story wings and erect two 18 room two story wings, for a new total
of 56 efficiency rooms. The plan calls for 71 parking spaces. After a
discussion of this plan in regard to the present zoning on the property, Mr.
Baden moved that the Board table the request at this time until it is known
what the Council is going to do in acting on the Board's zoning recommenda-
tions. The motion was seconded by Mr. Horsey and passed unanimously.
(2) The Miami Shores Baptist Church, 370 Grand Concourse,
requested permission to keep a bus parked next to the existing garage on
the church's parking lot on N. E. 96th Street. A sketch of the enclosure
for the bus was presenFty Chief Fowler which indicated a 10 ft. fence will
be used to hide the bus from the street. Mr. Horsey moved that the Board
recommend to the Council that the church be granted permission to park
this bus with a decorative fence enclosure as proposed, on the basis of a
permit for one year. The motion was seconded by Mr. Baden and carried.
(3) Dr. and Mrs. Joe Burch, 170 N. W. 105th St. , Lots 11,
10 & W 1/2 of 9, Block 126, Miami Shores Sub. , requested permit to
erect a 9 ft. x 20 ft. orchid house in their rear yard. The Zoning ordinance
requires approval by the Planning Board of any such structure exceeding

80 sq. ft. Mr. Moyer moved that the request be approved with a 5 ft. set-
back on the rear and a 10 ft. setback on the side. Motion was seconded
by Mr. Horsey and passed.
• Unfinished Business:
(a) Parking plan for new Community Center - Chairman
McIntosh presented a revised plan showing 32 parking spaces
which was generally approved by the Board.
Mr. McIntosh also presented a parking plan for the Presbyterian
Church along Park Drive. Some changes were suggested in this plan.
Chairman McIntosh brought up the subject of a recent listing
for sale of the property owned by Dr. Douglas J. Muncie at 150 N. E. 96th
Street and subsequent findings, a copy of the report being attached hereto.
Mr. Moyer moved that this zoning problem be brought to the attention of
the Council. Motion was seconded by Mr. Baden and passed unanimously.
The meeting adjourned at 9:00 p.m.

S SUBJECT: PROPERTY OWNED BY DR. DOUGLAS J. MUNCIE,
150 N. E. 96th St. , Lots 7 & 8, Block 20, Miami
Shores, Section #1.
The Village Clerk was notified in the latter part of September that the
Muncie property, 150 N. E. 96th Street, known as Lots 7 & 8, Block 20,
Miami Shores, Section, had been advertised in the newspaper with the
caption "PROFESSIONAL OFFICE AND HOME". The ad further stated:
"3 room office suite, plus 1 bedroom apt. down and two 2 bedroom furn.
apt. up. "
On October 2nd the Village Clerk and myself inspected the premises along
with Virginia Pinto, a real estate broker. The entire first floor appeared
to be utilized as a commercial professional office- clinic complex. The
second floor has two separate and distinct apartment living areas with complete
kitchen facilities on each side.
Further research by the Village Clerk indicates the following history on this
property: An injunction was filed May 6, 1947 in Chancery Order Book 818 on
Page 118, enjoining the defendants from using the building for hotel or apart-
ment purposes and restricting its use to a one family residence until the
zoning ordinance is legally revoked or amended by Miami Shores Village.

O 2p0, 1958 Dr. Douglas J. Muncie requested use of the property as his
residence and professional office with a required variance. The Village passed
Resolution 386 November 4, 1958, which states as follows:
".. applicant be permitted to occupy the said property as
his home and to use the same as an office for the practice
of the applicant's profession, and that he be authorized to
employ the services of one skilled technician to assist
him in the practice of such profession. "
