PLANNING AND ZONING BOARD MEETING
June 11, 1970
A regular meeting of the Miami Shores Planning and Zoning Board
was held at 7:30 p.m. , June 11, 1970, at the Village Hall, with the following
members present:
Mr. Donald W. McIntosh, Chairman
Mr. Gordon H. Moyer, Jr.
Mr. Fred G. Astor
Absent: Mr. Thomas B. Baden
Mr. Irving E. Horsey
Mr. William R. Bradford, Building and Zoning Director, was also
present.
Minutes of the last regular meeting and of the public hearings of
May 11th and May 25, 1970, were approved as written by motion made by
Mr. Moyer, seconded by Mr. Astor and passed unanimously.
(1) Mr. Edgar D. Schraub, 1490 N. E. 101st St. , E. 50 ft. of
Lot 12 & W. 78. 67 of Lot 13, Block 1, M. S. Bay Park Estates, requested
permit to construct an addition on the east side of his home. This addition
would encroach on the 25 ft. front yard setback from the platted property
line at the street turn -around. However, the street has not been paved as
platted resulting in a deeper front yard. Mr. Schraub presented a letter
from his neighbor, Mr. Ken Dunning, stating he had no objection to this
addition. It was pointed out that there was no survey presented showing
the exact location of the addition with regard to the platted line as well as
the actual line . Mr. Astor moved that the Board recommend to the Council
that they do whatever is required legally to permit Mr. Schraub to proceed
with this planned construction, subject to a survey being presented indicating
the location of the existing structure with the addition superimposed thereon in
the setback. Motion was seconded by Mr. Moyer and passed unanimously.
(2) Miss Elsie Baioff of 336 N. E. 98th St. , was again
present to request permit to install a bathroom, raise the floor and make
necessary electrical changes to an existing non -conforming cl ta.ched building.
The minutes of the prior meetings covering Miss Baioff's request were
reviewed. Miss Baioff contended (1) that she had had a licensed engineer's
report on her building stating that it was up to code; (2) that one of her
neighbors had built on a bathroom and made an addition without a permit

at the same time she was being stopped and (3) that it is a non -conforming
building which she is just trying to make usable since she is being taxed
for it. The engineer's report was not in the Building Dept. files. Mr.
Astor stated that in the absence of this report and any real detail as to
construction, he would move that Miss Baioff be asked to present further
documentation for consideration at the next meeting. Motion was seconded
by Mr. McIntosh and carried.
(3) Mr. James Neal, 9306 N. E. 9th Ave. , Lot 7 and 8 less
the w. 105 ft. , Marilyn Heights 1st Addition, requested permit to make
an alteration that would tie an existing guest house to the main residence
with a screened porch. The guest house is wood frame with stucco and
the proposal is to remove the existing stucco and apply cedar shingles to
a new frarT a surface. The Building Inspector stated that this neighbor-
hood has some frame construction. Mr. Moyer moved that the Board
accept the overall design as presented and the renovation of the two
buildings providing it meets the South Florida building code in every
detail. Motion was seconded by Mr. Astor and passed unanimously.
The meeting was adjourned at 8:30 p.m.
