04-23-1970 Regular MeetingMIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING April 23, 1970 A regular meeting of the Miami Shores Planning and Zoning Board was held at 7:30 p.m. , April 23, 1970, at the Village Hall, with the follow- ing members present: Mr. Gordon H. Moyer, Jr. Mr. Thomas B. Baden Mr. Irving E. Horsey Mr. Fred G. Astor Absent: Mr. Donald W. McIntosh, Chairman Mr. William R. Bradford, Building and Zoning Director, was also present. In the absence of Mr. McIntosh, Mr. Baden was asked to take the chair. Minutes of the last meeting were approved as written by motion made by Mr. Moyer, seconded by Mr. Horsey and passed unanimously. (1) A request was made by Mrs. Frank Muller, 1263 N. E. 93rd Street, to maintain an existing redwood louvered fence more than 5 ft. high on the west side of her house. This fence was erected without a permit and is now the cause of neighborhood complaints. The Building Director reported . that the fence is approximately 6'6" high. Mrs. Muller stated that she did not know that she needed a permit for the fence; that she wanted it for privacy and had the sections which are 5 ft. high installed above the ground to prevent it from rotting out. Mrs. Mary Ann Stump complained that it blocks the breeze on the east side of her home. Mr. Herbert Mendell, Jr. , 1290 N. E. 94th St. , appeared to object to the fence because Mrs. Muller had objected to the way he drains his swimming pool. Dr. Paul Dunn, 1237 N. E. 93rd Street, had no complaint on the fence but he felt that if a variance is given to Mrs. Muller then his next door neighbor could get one also. After further discussion Mr. Horsey moved that the fence be dropped one foot to a nominal height of five feet plus or minus. Motion was seconded by Mr. Astor and passed unanimously. Mr. Moyer moved that the hedge of the Mendell home be cut to legal height. Motion died for lack of a second. (2) A request was made by Messrs. Barry Swope and Robert Miller for approval of setbacks on two homes to be built on Block 71, Miami. • • 4/23/70 -2- Shores Section #3. After review of the plot plan Mr. Moyer moved that the request be granted. Mr. Astor suggested that the motion be amended to include instruction that the alley be vacated by the Council and that site plans be submitted to the Board. The amendment was accepted and the motion as amended was seconded by Mr. Astor and passed unanimously. (3) A letter was received from Mr. Ben Lawson, attorney, concerning the zoning on Lots 10, 11, 12, 13 and 14, Block 35, Miami Shores Section #1. This property is located on the east side of N. E. Znd Avenue immediately north of the Library. The letter was discussed by the Board but no action was taken inasmuch as it was not a petition for rezoning. The Clerk was instructed to advise Mr. Lawson that the Board took no action on his letter. The Building Inspector reported that Mr. Budd Laurence has requested permission to illuminate the billboard type sign approved for the corner of Biscayne Blvd. and 105th Street. This is not prohibited by the ordinance. The Board suggested that it cut off at 10:00 p. m. The Building Inspector reported that a Sears and Roebuck store is moving into the vacant store in the Publix shopping plaza and the plans show a largeTXadio antenna on the roof. The Board requested that the plans for the antenna be submitted to the Board. The meeting adjourned at 8:50 p. m. -A17X Secretary Approved: Chairman
