01-02-1969 Zoning HearingZONING HEARING MIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING January 2, 1969 A zoning hearing before the Miami Shores Planning and Zoning Board was held at 7:30 P. M. , January 2, 1969, at the Village Hall, with the following members present: Mr. Donald W. Hoefle, Chairman Mr. Gordon H. Moyer, Jr. Mr. Thomas B. Baden Mr. Donald W. McIntosh Mr. Irving E. Horsey Absent: None Mr. John W. McIntyre, Acting Village Manager, and Mr. William H. Bradford, Building and Zoning Director, were present, as well as, 18 Village citizens. Chairman Hoefle opened the meeting and the minutes of the last meeting were approved by motion made by Mr. Moyer, seconded by Mr. Baden and passed. (1) ZONING HEARING Mr. Jack Golding, owner of the building at 9999 N. E. 2nd Ave. , spoke in support of a petition filed by attorney S. Philip Malspeis on behalf of Mary Pillock, owner under contract of the property at 230 N. E. 100th St. , Lots 8 and 9, Block 33, Miami Shores Section #1, for a change of zone from residential to parking. This property is located east of the alley behind the 9999 building on 100th Street. Mr. Golding stated that his building is fully occupied, that the parking situation is critical and further aggravated by Metro Court parking. He stated that this proposal is in line with the zoning plan of the business property on 2nd Avenue from 99th Street to 94th Street which provides 100 ft. east and west of the alleys for parking. Mr. Golding presented a layout of the proposed parking plan. The Planning Board pointed out that he had not provided 10 x 20 ft. spaces and therefore would not be able to get as many parking spaces as shown on the drawing. Mr. Donald Landis, 246 N. E. 100th St. , opposed the whole idea and thought it was ridiculous. He stated he didn't want this office building in the first place; that he didn't think they could get 33 parking spaces in the lot. He complained about the Avis rental cars behind the building and added that he felt he would lose 8 to 10 thousand dollars on his home if this goes through. 1/2/69 -2- Mr. L. Wheldon, 237 N. E. 100th St. , complained about the office building and thought the owner should suffer because he built a three-story building. Mr. R. H. Brown, 253 N. E. 100th St. , thought this would deterior- ate the area with trash accumulating in the lot, and he was strongly opposed to the change. Mr. Stanley Gardiner, 229 N. E. 100th St. , stated he purchased his home on the strength of what the Village Hall had told him, that the 2nd Avenue property would probably remain a park; that he has thousands of dollars tied up in his property; that he will be directly across from this proposed parking lot and is against the proposal. Mr. Hunter Tushingham, 270 N. E. 100th St., stated that he felt that this building has damaged everything within a dozen blocks of it. Mrs. Martha Hattesen, 285 N. E. 100th St. , stated that she is very much opposed to this change. She stated that the library parking spaces are being used by this building and it is impossible to get into the library; that there should be more meters on the streets, or that these tenants should take their cars to some other lots like the Christian Church or the Lutheran Church lots. Mr. Lawrence Harrigan, 258 N. E. 100th St. , was opposed to it. Mrs. Helen Turcotte, 286 N. E. 99th St., didn't think the building should have been built and didn't want the people to park on her front parkway. Mr. Don Tichenor, 246 N. E. 101st St. , was very much opposed to any further expension of business interests in Miami Shores. Mr. Roland Stafford, 299 N. E. 99th St. , criticized the conditions existing behind this building, that the garbage cans were a disgrace and had no covers allowing the trash to blow in the yard. He stated that the cans should be in a room or a container. Dr. Howard E. Hattesen, 285 N. E. 100th St., was opposed to it. Mrs. Harry Selser, 165 N. E. 98th St. , stated that her home is zoned for parking and is right across the street from a parking lot and if they wanted a parking lot they could have her home. Mrs. Frances Rollins, 260 N. E. 99th St. , was opposed to this and to all business in Miami Shores. 1/2/69 -3- At the conclusion of the discussion Mr. McIntosh moved t1rat the Board deny this petition based on the parking layout not being satisfactory and on the items recommended by the neighbors as metered parking and using other lots and he personally didn't think that 50 spaces would salve the parking problem. Motion was seconded by Mr. Baden and passed unanimously. (2) Miss Elsie Baioff, 336 N. E. 98th St. , requested permission to add toilet facilities in an existing non -conforming accessory building. Alterations and repairs were being made to the building without permit and were stopped by the Building Inspector. It was pointed out that the condition of this building is sub -standard and a report should be made by the Building Inspector as to what will be required to bring it up to code. Mr. Moyer moved that the Board table this for further action at a later date when more information is furnished by Mr. Bradford. Motion was seconded by Mr. Horsey and pas sed unanimously. Since this would constitute a variance Mr. McIntosh suggested getting letters from the neighbors on whether or not they have any objection to the reconstruction of this building. (3) Set date to meet with representatives of Harland Bartholomew & Associates. -P ovemb-er 23rd was tentatively set for this meeting. /gray The meeting adjourned at 9:10 P.
