PLANNING AND ZONING BOARD MEETING
August 13, 1964
A regular meeting of the Miami Shores Village Planning and
Zoning Board was held at 7:30 P.M., August 13, 1964, at the Village Hall,
with the following members present:
Mr. Emrys C. Harris, Chairman
Mr. M. B. Arnold
Mr. Gordon H. Moyer, Jr.
Mr. Donald W. Hoefle
Absent: Mr. Thomas B. Baden
Mr. William R. Bradford, Building and Zoning Director, was
also present.
Minutes of the last meeting were approved as written by motion
made by Mr. Moyer, seconded by Mr. Hoefle and passed unanimously.
(1) A request was made by Mr. Ernest D. Ashurst, representing
Uncle Johnts Pancake House property, for a zoning variance to permit a
Shell Oil Co. Service Station on the northeast corner_ of Biscayne Blvd. and
90th Street, since this is within a prohibited area of 500 ft. from another
station. After some discussion Mr. Arnold moved that the request be
approved. Motion was seconded by Mr. Hoefle but failed to carry on a split
vote with Messrs. Harris and Moyer dissenting. Mr. Ashurst indicated that
he would take this next to the Village Council.
(2) A request was made by Mr. Dan Schmidt for a variance on
height and type of fence permitted at 975 N. E. 92nd Street. Mr. Schmidt
explained that the appearance of the adjoining property is depreciating his
property so that he cannot sell it and, therefore, he would like to extend
reed fencing three feet above the existing 5 -ft. wall. It was brought out that
the adjoining owner removed part of a porch to make a clear 50 ft. of vacant
property to sell which Mr. Schmidt bought. It was also mentioned that the
former owners did not maintain a setback on theirAo iarttThe new home is
within ten feet of their home. The owners of the property which Mr. Schmidt
complained about, Mr. and Mrs. Boutzilo, have never finished the side of
their house from which the porch was removed. After discussion,, Mr. Arnold
moved that the Building Inspector call on these people and advise them that
unless they stucco and finish the side of their house within 30 days, the Board
will grant this man the privilege of extending the fence. Motion was seconded
by Mr. Moyer and passed unanimously.

(3) A request was made by the owner of the Mt. Vernon motel
to demolish the present motel building and rebuild an apartment building of
60 units comprised of 12 efficiencies, 44 one -bedroom and 4 two-bedroom
apartments. The Building Inspector pointed out that the area requirements
as specified in an A-1 District would be 104,800 sq. ft., .whereas the land
area involved is only 63, 276 sq. ft. Mr. R. S. Schneider, architect for
Mr. Gianaris, the owner, argued that the ordinance did not specifically
indicate that these requirements would have to be met in an A-2 District.
After further discussion Mr. Arnold moved that the Board submit this matter
to the City Attorney and to the City Council with a recommendation that the
ordinance be interpreted with regard to permitted used in an A-2 District so
that the Board will know what to do in the future. Motion was seconded by
Mr. Hoefle and passed unanimously.
