01-27-1961 Regular MeetingMIAMI SHORES VILLAGE PLANNING AND ZONING BOARD MEETING January 27, 1961 A regular meeting of the Miami Shores Village Planning and Zoning Board was held at 7:30 P.M. , January 27, 1961, at the Village Hall, with the following members present: Mr. Marion B. Arnold, Chairman Mr. Gordon H. Moyer, Jr. Mr. Elwood Jones Mr. Emrys C. Harris Mr. Thomas B. Baden Absent: None Mr. Charles H. Markel, Building and Zoning Director and Mr. William Bradford, Assistant Director, were also present. Minutes of the last meeting were unanimously approved as written by motion made by Mr. Jones and seconded by Mr. Moyer. • (1) The Board first took up the unfinished business of the roof for the Christian Church. A representative of the Carey roofing material company was present to explain the product being considered, an asbestos plastic shingle, which he claimed would be the most practical material for a roof of that pitch. After some discussion, Mr. Moyer moved that the Board reject this roof until all available materials that can be applied are inspected and checked to find out what can go on that roof and keep within the aesthetics of Miami Shores. Motion was seconded by Mr. Baden and a call vote was taken with the following results: Mr. Baden Aye Mr. Moyer Aye Mr. Arnold No Mr. Jones No Mr. Harris Aye Mr. Harris added that he approved the motion assuming this would be done within a reasonable time. Mr. Arnold stated that he failed to see anything in our ordin- ance that, justified the motion that was passed and asked that the Council take the matter up at their meeting of February 7th. (2) PUBLIC HEARING ON X -ZONE EXTENSION Mr. Arnold then turned the meeting over to the public hearing on a petition filed by the Peoples National Bank to re -zone Lots 11, 12, 18 and 19, Block 28, Miami Shores Subdivision, from residential to parking. There were approximately 45 citizens present in regard to this issue. Mr. O. B. Simmons, attorney representing the Peoples Bank, was the first speaker. Mr. Simmons explained how the business district had • • -2- 1/27/61 been extended one block on the south and one block on the north several years after the original planning of the business zone and parking zone on N. E. 2nd Avenue; that the parking zone behind the 2nd Avenue frontage on the north had been established in April of 1958 and that the same extension was now being asked for the 100 ft. east of the alley between 94th and 95th Streets. Mr. L. L. Robinson, 295 N. E. 94th St. , was opposed to it. He stated he had fought the rezoning for more business and he was now fighting rezoning for more parking. Mr. Lloyd Gordon, 290 N.E. 95th St. , protested that parking lots create papers and trash which now blow into his yard from the A & P parking lot, which is never swept; that he protests any action granting this change. Mrs. David Margolin, 295 Grand Concourse, presented a petition to the Board on which there were approximately 90 names protesting this change. Mr. William B. Peterson, 166 N. E. 93rd St. , stated he was against it. Mr. Vincent Vuturo, 260 N. E. 95th St. , stated that he lived directly east of the proposed area; that the alley would probably have to be one-way and that there are many young children in this neighborhood and the traffic would be very dangerous for them. Mr. Vuturo objected very strongly to having the parking brought that close to him and that the present parking is more than adequate except on Friday night. Mr. Harvey Bell, 253 N. E. 94th St., who would be adjacent to the lot, was strongly against it as he didn't think anything would improve the appear- ance of a parking lot. Mrs. Ilah Sexton, 230 N. E. 94th St.. stated that papers, cans and debris blow in her yard now from the bank lot; also that the traffic in the alley would be hazardous. Mr. Robert Cullins, 314 N. E. 94th St., didn't understand why there is a need for more parking when the present lot is never full. Mr. George Frix, speaking on behalf of the Bank, didn't think that this change would destroy property values. He pointed out the expensive residences that have been built around the elementary school and catholic church, that the parking and excess traffic had not destroyed these property values; that the "ba_ik parking lot would not constitute an eyesore or destroy values. Mr. U. A. Daniel, 280 N. E. 95th St. , was against the change. Mrs. Holtzhauser, 166 N. E. 92nd St., stated she did not live in the affected area but was against it on principle, that we should uphold the standards. Mr. Stafford, Vice President of Peoples Bank, stated that they were looking to the future when they felt they would need additional parking. Mr. William Martin, 150 N. E. 95th St., stated he was completely • • -3- against it, that it would devaluate the property. Mrs. Anna Buckley, 375 N. E. 94th St., thought the present parking lots are not maintained well. 1/27/61 Mr. Bill Adams, of Rader and Associates, explained the sketch of the proposed parking lot with adequate drainage on the lot, a 5 ft. wall on the east side and properly landscaped. Mr. Ernest Reiger, 249 Grand Concourse, thought this would be very undesirable and was against it. Mrs. Grace Lindsey, 176 N. E. 93rd St. , was very strongly against it. Mr. 0. B. Simmons pointed out that the business district was ext. ied to 94th St. by the Supreme Court and that the bank is looking to the future when the business will require more parking area. Mr. David Margolin stated he walks by the present parking lot every night and he has never seen it full. Mrs. Neargarder, 260 N. E. 95th St. , wanted to know if she could sell her 50 ft. lot that is adjacent to the proposed parking area. As there were no further remarks, Chairman Arnold stated that the Board would make a recommendation to the City Council in the near future. (3) Mr. James Vitale, 428 N. E. 91st St., requested permit for remodeling and enlarging his home at the above address. Because the detached garage has an apartment in it and is non -conforming, this was brought before the Board. Mr. Jones moved that the permit be granted providing proper plans are submitted. Motion was seconded by Mr. Baden and passed unanimously. (4) A variance was requested by Mr. Caster, 395 N. E. 97th St.. to construct an attached garage, using 10 ft. of the rear setback. A garage attached to the house requires a 15 ft. rear setback, whereas this plan only allowed 5 ft. Mr. Harris requested Mr. Caster to get letters from his neighbors stating they have no objection to this. Mr. Jones wanted to go by and see the existing garages adjacent to this property. Action was tabled until the next meeting. The meeting adjourned at 9:40 P. M. Clerk Approved:
