June 12, 1995
A special meeting of the Miami Shores Village Historic Preservation Board was
held at Miami Shores Village Hall on Monday, June 12, 1995. The meeting was called
to order at 7:30 p.m. by Chairman von Bittner with the following members present:

The Secretary called the Roll.
1. MINUTES - MAY 30, 1995
Chairman von Bittner stated that he had just received the Minutes and passed a
copy to each Board member to review. The Board voted to move the Minutes to the
next meeting.
• 2. APPLICATION FOR CERTIFICATE OF APPROPRIATENESS
Alteration - blocking up garage doors on the rear guest cottage

Owner: Dr. Guy E. O'Grady
Dr. O'Grady was present to speak about his application. He stated that after the
May 30, 1995, meeting in which he decided to withdraw this application he began to
review the 1933 photograph to see how he could replace the existing garage doors
which were badly rotten due to severe water intrusion. He believed that he could
maintain the appearance of the garage doors in the 1933 photograph although the
doors would probably not be functional. He stated he could obtain the Cypress wood
vertical panels for the swing -out doors as well as the wrought iron decorative hardware
to match the 1933 photograph as closely as possible. Dr. O'Grady said there was an
open laundry area, 4' x 8', which he would like to block up leaving access through the
garage and not having this area open to the outside. If the blocking was done
internally, the arch would not be affected. He passed around pictures for the Board to
review. Chairman von Bittner stated that the application requested internal alteration
for which the Board had no authority. If the application was strictly limited to
reinstalling outside garage doors, the Board could rule. Dr. O'Grady stated that he had
taken his ideas of blocking the garage doors to Mr. Lubien who agreed that this
blocking would be the most stable way to go. He stated that he wanted to create the
• look of the four small windows in the garage doors. Member Franck suggested that he
drive through Miami Shores to see different ideas on what other residents had done to
display the small window effect. He also reiterated that the Board could not rule on

his internal blocking request and suggested he take this directly to Building and Zoning
for approval. Dr. O'Grady was asked if he had any sketches to provide the Board. He
stated he did not.
The Board questioned Dr. O'Grady about his desire to raise the interior floor.
He stated this may not be necessary as installation of new doors should solve the water
intrusion problem. He chose to delete this request from his application.
The application requested the Board rule on colors. Chairman von Bittner stated
that the 1933 photograph showed an acorn brown color with black hinges. The Board
stated they had no problem with this color scheme.
Chairman von Bittner read the corrected application to the Board.
Member Frank made a motion to approve the Application for Certificate of
Appropriateness as corrected. Member Temkin seconded the motion and it passed
unanimously.
3. APPLICATION FOR CERTIFICATE OF APPROPRIATENESS
Alteration - placement of rectangular copper screening into loggia openings to
shield arched windows and placement of canvas fabric over loggia openings

Owner: Dr. Guy E. O'Grady
Dr. O'Grady told the Board that after the May 30, 1995, meeting he had
investigated different awning structures and found that acrylic woven fabric would
closely match the awnings in the 1933 photograph. He stated he had gotten an
estimate from Miami Awning. The stripe could be put in and he would like to use a
Dune or Toast color. He stated that the house was showing severe deterioration with
water coming right into the living areas. Plaster was falling from the roof. He called the
house a "nightmare." Chairman von Bittner stated that installing awnings and copper
gutters would sharply cut down on the water intrusion problem. Window screens would
help diffuse the water also. Member Courtney stated that she had a similar problem
with water intrusion at her shop. This was solved by installing lentils which acted as a
barrier and diverted water from coming in. Member Franck advised Dr. O'Grady that he
must specify what type or style of awning he wanted to install. It was determined that
he would use a round or large Roman valance style awning. The stripe colors would
be Terra Cotta, Dune and Brown designed to replicate the 1933 photograph. There
• would be three identical rectangular awnings in the front of the house which would
cover the loggia screened openings. The screens would be installed over the arches
and would darken the windows somewhat. The awnings would cover one-half of the

windows to insure that the arches were hidden from view. The wood frame around the
windows would be painted an Almond color. It was decided that the arched windows
which were previously disapproved would be allowed to remain contingent upon the
above requirements.
Member Temkin made a motion to approve the Application for Certificate of
Appropriateness, as corrected. Member Courtney seconded the motion and it passed
unanimously.
4. APPLICATION FOR CERTIFICATE OF APPROPRIATENESS
Maintenance, repair or alteration - paint

Owner: Mr. Charles Smith
Mr. Smith was present to speak. He gave the Board several photographs for
their review and file. He told the Board that he had painted one section of the front of
the house in the color scheme for which he was applying. The foundation color was
olive green, but after several scrapings he found that the house had been painted
• several times in various shades of green. He stated none of the paint foundation would
show due to the red Hibiscus hedge along the entire front of the house. There would
also be chocolate -cherry Alamada foliage cascading down a trellis. Members of the
Board had driven by the house and all concurred that it was quite appropriate.
Member Temkin made a motion to approve the Application for Certificate of
Appropriateness. Member Courtney seconded the motion and it passed unanimously.
5. APPLICATION FOR CERTIFICATE OF APPROPRIATENESS
Maintenance, repair or alteration - cover existing plywood awnings with green
striped canvas material

Owner: Mr. Charles Smith
Mr. Smith showed the Board a swatch of the awning fabric he wanted to use. He
stated this fabric was the same Sunbrella material as had been used at the Spears
Harris house. The awnings would be made of plywood, covered with fabric, and
installed in the front and back of the breezeway only and not the entire house.. Mr.
Smith stated that these awnings would pull down and latch providing great security for
this open, vulnerable area. During discussion the Board remarked that they had
never seen this particular type of awning installation done and were concerned that it
• would not last very long. Mr. Smith went into detail concerning the construction and
durability of the proposed awnings.

Member Frank made a motion to approve the Application for Certificate of
Appropriateness to cover the exiting plywood awnings with green striped fabric.
Member Courtney seconded the motion and it passed unanimously.
6. APPLICATION FOR CERTIFICATE OF APPROPRIATENESS
Maintenance, repair or alteration - reroof existing dwelling with tile

Owner: Mr. Charles Smith
Chairman von Bittner stated that the Board had already approved this an
application for a roofing material. Mr. Smith agreed, but stated that there had been a
great deal of controversy over this issue and he was before the Board for clarification.
He stated that it was the interpretation of the Planning and Zoning Board at their
meeting last week that if one had a designated dwelling and requested a
nonconforming roofing material, there would be no engineer's certificate required to
prove that the building could not support an allowable material. Building and Zoning
interpreted that if one had a building that was not historically designated, an engineer's
• certificate would be required to state that the building would not support the tile. If the
building was designated, then a Certificate of Appropriateness from the Historic
Preservation Board would be all they required to consider granting a variance for a
nonconforming material such as Cedar Shake (which had been previously approved for
the building). Section 702 - Hardship Variance, of the Miami Shores Village Code was
cited and stated, in the opinion of the Board, that if a building was designated it would
be eligible for a variance. He told the Board that he felt very strongly about this issue
because it was a decision that belonged to this Board and not to Mr. Lubien. The
Council denied the variance because the Village Attorney had stated that if they voted
on it without an engineer's letter they would not be consistent with other cases and that
the application was technically defective.
The Board reviewed Section 225, Appendix A, of the Miami Shores Village Code
and the options available for the Board to consider. It was determined that Mr. Smith
was before the Board to find out what was allowable and appropriate for him to use,
under the Secretary of Interior's guidelines.
Member Temkin made a motion to deny the Application for Certificate of
Appropriateness for tile. Member Courtney seconded the motion and it passed
unanimously. The denial was based on the fact that each of the roofing materials in
this application were not historically appropriate or otherwise appropriate under the
Secretary of Interior's Guidelines applicable to this application. This is based upon the
• Miami Shores Village tax assessor's worksheet showing that in 1938 wood shingles
were on this house (see attached worksheet). Member Franck made a motion to add

the language as above stated. Member Courtney seconded the motion and it passed
unanimously.
7. ANNOUNCEMENTS
Cuban Tile Ordinance - Chairman von Bittner read the new Ordinance to the
Board. He stated that a list must be made of the structures in each jurisdiction that has
the tile and given to the respective building officials to let them know which houses
have historic Cuban tile. The Board discussed possible ways of obtaining this list such
as enlisting a volunteer from Barry University to go through Miami Shores and prepare
the list.
