A regular meeting of the Miami Shores Village Historic Preservation Board was
held at Miami Shores Village Hall on Monday, May 30, 1995. The meeting was called
to order at 7:30 p.m. by Chairman von Bittner with the following members present:

Chairman von Bittner called the Roll and administered the Oath to all who would be
giving testimony at the meeting.
1. MINUTES - APRIL 24, 1995
Member Temkin moved to approve the Minutes of the April 24, 1995, meeting as
corrected. Member Franck seconded the motion and it passed unanimously.
2. APPLICATION FOR CERTIFICATE OF APPROPRIATENESS
Maintenance or repair - paint exterior of house

Owner: Dr. Guy E. O'Grady
Dr. O'Grady was present to speak on his own behalf. He stated that he had
been working on the house for the past fourteen months to do whatever was necessary
to preserve the structure of the house. He stated he began to paint with what would
best match the antique Cuban roof tiles. Since the house had been painted so many
times in the past, it was difficult to determine exactly what the original exterior color had
been. He stated he had chosen a color with a hint of red to compliment the roof tiles
and to maintain a Mediterranean/Art Deco look with the windows being painted in an
almond color accent. He said he had begun the painting without knowing that he
needed to first come before the Board to discuss his intentions. Dr. O'Grady passed
pictures around for the Board to review which reflected the finished painting of the
home. He told the Board that untold hours had been spent just in stripping the
windows and getting them to close properly due to the extensive over -painting in the
past. He stated that the front door had been sandblasted and lightly sanded.
Chairman von Bittner told Dr. O'Grady that his application did not indicate the
color he wanted to have approved to paint the house. Dr. O'Grady stated that the color

was a salmon/peach, the windows were almond, and the door was natural wood
enhanced with a little reddish or cherry stain.

Member Franck made a motion to approve the Certification of Appropriateness
to paint the house as described above by Dr. O'Grady. Member Temkin seconded the
motion and it passed unanimously. Chairman von Bittner stated that this motion was
approved with conditions, after the fact: 1) the original wood casements to be painted
almond, and, 2) the front door to be stained natural provincial.
3. APPLICATION FOR CERTIFICATE OF APPROPRIATENESS
Alteration - raise height of garage slab seven inches, replace garage door with
French window panels and doorway to match front facade of house

Owner: Dr. Guy E. O'Grady
Dr. O'Grady advised the Board that the garage doors had a substantial amount
of dry rot. The present doors were about thirty years old. A swing -out type would be
extremely difficult to maintain. He showed a picture dated 1933 of the original swing -
out doors. Dr. O'Grady stated that the garage and rear cottage had probably never
been used as a garage, as it would be difficult to drive a car into. What he would like to
do was to match the side facade of the porte cochere. He passed around a recent
Polaroid of the arched door he found in the house which was two-inch thick Cypress.
He used this to replace the redwood door and shutters which had been there. The
French panels he used were identical to the Cypress panels he had already installed
into the loggia. He wanted to duplicate the look on the garage to match the house
exterior as he would not be using the garage as a garage but rather as a storage space
for his wood working equipment and other things.
The Board reviewed the original blueprints of the home. After discussion with
Dr. O'Grady, it was apparent that the renovations he wanted to do would change its
entire original look. The garage would probably be used for living and/or maids
quarters, but definitely not for a garage. Member Logan -Hynes read Standard 5 and
Standard 6 from the Secretary of the Interior Standards for Rehabilitation which
standards Dr. O'Grady had not met with what he desired to do with his house.
Chairman von Bittner suggested that he make a door that looked like a swinging open
garage door with two small lights similar to the 1933 picture and just keep the doors
closed. This way the historic integrity of the house could be maintained and Dr.
O'Grady could use the inside of this area in any way he wanted. Dr. O'Grady thought
this was a good possibility. Member Logan -Hynes desired, at a minimum, to see
drawings of what Dr. O'Grady proposed to do with this garage area. She also
suggested he explore other design avenues. Chairman von Bittner stated that he

would approve an application which showed doors similar to the 1933 picture with small
lights and wrought iron hinges. He also suggested that Dr. O'Grady check with
Building and Zoning for approval to turn the garage area into living quarters.
The Board questioned Dr. O'Grady about his desire to raise the front garage
area seven inches. This renovation was to be done to alleviate water seeping into this
area. Chairman von Bittner asked if he had thought about installing half round copper
gutters in front of the garage to direct water away from the front area. Dr. O'Grady
thought this would detract from the tile roof. The Board determined that seven inches
was quite high and wanted to know how Dr. O'Grady was going to do this. He stated
that he could brick the seven inches. Member Logan -Hynes asked Dr. O'Grady if he
had plans drawn up for this work. He stated that he had not. Member Logan -Hynes
advised him that making a new foundation was major work and would need blueprints
and a permit. The Board suggested an altemative be sought by Dr. O'Grady.
Chairman von Bittner advised Dr. O'Grady that he had two choices with the
application. He could either withdraw this item and show the Board drawings of
different designs at a future time, or it could be voted on. Dr. O'Grady chose to
• withdraw his application.
4. APPLICATION FOR CERTIFICATE OF APPROPRIATENESS
Alteration - replace wood jalousies covering screened porch with arched plate
glass windows

Owner: Dr. Guy E. O'Grady
Dr. O'Grady told the Board he wanted to install the windows into the front loggia -
porch area because of the severe water intrusion he was experiencing. He had begun
the work prior to getting a permit and coming to the Board to seek approval. Chairman
von Bittner made a suggestion to install gutters and awnings on the front of the house
to solve the problem.. Dr. O'Grady stated that gutters would detract significantly from
the tile roof and awnings would cut down on the light entering the house. This was how
the house was and it was like a dungeon. Chairman von Bittner agreed that wood
jalousies would not permit adequate Tight into the house, but perhaps a screen on the
outside, plate glass windows on the inside which could be opened, and a light awning
could be installed to allow sufficient light in. Dr. O'Grady did not believe this would be
suitable. Chairman von Bittner stated that at the last Board Meeting, the Board had
denied an application to Mr. Pruitt and Mr. Schmid because they had wanted to enclose
their front porch with windows in a similar fashion. Chairman von Bittner stated that
the Board had a standing policy not to allow any owner to enclose a screened porch as
this radically changes the appearance of the house. Member Logan -Hynes stated that

she was going to read Standard 2 and Standard 3 of the Secretary of Interior's
Standards for Rehabilitation. The Board believed that Dr. O'Grady was changing the
original appearance of the home too much to meet the guidelines stated in the
Standards for Rehabilitation. Chairman von Bittner stated that he wished Dr. O'Grady
had come before the Board prior to commencing work on the windows because of the
expense he had already incurred with this renovation and because these windows were
not appropriate. The pictures did not show any evidence of arches in the front facade
and that the openings were in effect rectangular. Member Logan -Hynes mentioned that
the stained wood around the windows was also inappropriate.
Member Logan -Hynes made a motion to deny this Application for Certificate of
Appropriateness. Member Temkin seconded the motion and it passed unanimously.
5. CERTIFICATE OF APPROPRIATENESS
21 NW 101 Street
Owner: Mr. Charles Smith
Chairman von Bittner stated that on January 23, 1995, Mr. Charlie Smith came
before the Board to obtain an Advisory Certificate to reroof his roof with Cedar shake
shingles which was approved. Apparently, Village Hall lost this application, and the
Village Clerk asked the Board to redo this certificate. Chairman von Bittner added Mr.
Smith's application to the Board's Agenda and asked the Board to approve a Certificate
of Appropriateness which Mr. Smith will tum in on the Board's new form. The
application is to approve a heavy grade, western Cedar shake, Dade County product
controlled approved, for the roof of this home. Since Mr. Smith's certificate had already
been approved by the Board prior to designation which was only advisory, this vote
would be the actual certificate. Now Mr. Smith needs to go before the Planning and
zoning Board and the Village Council to get a variance for this work and cannot get the
variance without the approval of this application and issuance of the certificate.
Member Logan -Hynes moved to reapprove the Certificate of Appropriateness.
Member Franck seconded the motion and it passed unanimously.
6. HISTORICAL PRESERVATION QUESTIONNAIRE
Chairman von Bittner handed out a questionnaire from Tallahassee to the Board.
He asked that they review, sign and return it to Tallahassee at their convenience.

7. NATIONAL REGISTER THEMATIC GROUP II - JENNIER JOVE
Chairman von Bittner wanted to share the work Ms. Jove had done for the Board
on the Group II designation proposal. He passed out a copy of the proposal to each
member and commented on the impressive job she had done. Ms. Jove had covered
37 houses and compiled substantial documentation on each. Chairman von Bittner told
the Board that he had submitted the twenty page °Statement of Historic Content" to
Tallahassee last week to get a preliminary assessment and there was no specific
deadline to meet. He asked the Board how this project should be handled with the
Council. Member Temkin stated that the first one was a grant. Chairman von Bittner
suggested that after the Board had made their choices, they should go before the
Village Council with the Board's recommendation and a proposal. The Board
discussed holding a reception and slide presentation at the Library for the City Council
and Ms. Jove. They also discussed the importance of giving Dr. Jesus Mendez at
Barry University credit for their participation. The Board determined that a deadline of
September should be given for each member to have had reviewed and commented on
Ms. Jove's work. At the first Fall meeting, the Board would discuss their findings and
• what the next step to take should be. The idea of using Barry University volunteers to
go through Miami Shores and take pictures of the homes designated was discussed
and also the idea of asking Barry University if this could be done through a school
project. Chairman von Bittner told the Board that a policy decision needed to be made
conceming the home owners who did not want to designate their homes locally. He
stated that these people should be encouraged to designate locally so the Board would
have jurisdiction for the future.
8. BUDGET/JURISDICTION
Chairman von Bittner stated that Member Logan -Hynes had prepared a Budget
which he reviewed and offered suggestions. He stated he called Mr. Lubien and was
advised that a Budget for the Board was not advisable and had little chance of
approval. There was discussion concerning what the Board had jurisdiction to do and
that it should the Board's goal to broaden its functions rather than designation of
homes and ruling on certificates of appropriateness. The Board believed that it would
be a good idea to amend its enabling the ordnance it to allow it to conduct walking
tours, trolley tours, etc. Chairman von Bittner stated that he would prepare something,
bring it to the Board to review, and then take whatever steps were necessary to obtain
the Village Council's approval.
