HISTORIC PRESERVATION BOARD
April 21, 1986
A regular meeting of the Miami Shores Historic Preservation Board
was held on Monday, April 21, 1986. The meeting was called to order by
Margo Newton, Chairman, at 7:40 P.M. at the Miami Shores Village Hall,
with the following members present:

Vivian D. Rodriguez
2. MINUTES
The minutes of the meeting of February 24, 1986 were approved as
amended, by a motion .made by Mr. Gaggstatter, seconded by Vivian
Rodriguez, and passed unanimously.
Addea Colangelo moved to approve, as written, the minutes of the
meeting of March 17, 1986, seconded by Mr. Gaggstatter, and passed
unanimously.
The minutes of the Special Meeting held on April 7, 1986 were approved,
as written, by a motion made by Vivian Rodriguez, seconded by
Mr. Gaggstatter, and carried by a unanimous vote.
3. CARL FABIAN
577 N. E. 96th St. - COVENANT
Members reviewed the Modified Covenant signed by Carl and Aida Fabian.
Ms. Newton outlined the ruling from Mr. Fann, Village Attorney and the
memo from Mr. Forney. Members were advised that they could accept a
modified covenant, however, they must take into consideration the
precedent which would. be set, and the possibility of gutting the intent
of the existing Covenant.
Much discussion followed.
Mr. & Mrs. Fabian were present. Mr. Fabian noted that both.h&and
Mrs. Fabian are very strongly in favor of seeing the house preserved.
At the time they consented to Landmark Designation they were told that
these certain changed could be made to the house. Further, the Fabians'
were advised by their attorney that signing the Covenant in its' form
goes on for perpetuity;.;and conceivably several years down the road when
the make up of the Board is different, hands could.be tied. The intent
of modifying is to allow for flexibility in the future, even though their
intent is to preserve and protect the property. The Covenant as drawn
up could be restrictive, and give others full authority to make decisions
regarding Change.

Mrs. Rodriguez felt there were items written into the modified covenant
which could cause drastic changes to the[:pkoperty by a future owner, and
very much change the character of the house. She especially. objected to
items 1, 2, 5, & 6. Mrs. Rodriguez further stated that she might be more
apt to approve the modification if the statements were clarified in
keeping with the guidelines of the Department of Interior, which would
indicate changes sensitive to the original.
Mr. Courtney arrived at this time.
It was the consensus of the Board that Mr. & Mrs. Fabian receive a copy
of the Department of Interior Guidelines. The Board will make suggestions
in verbage.to modify the covenant, in an effort to arrive, at a covenant
which both parties could live with.
Discussion continued concerning Members desire to work with the Fabians
on language mutually agreed upon, so that any changes would be in keeping
with the character of the house.
Mr. Gaggstatter moved that the Board work with Mr. & Mts. Fabian in the
effort to come up with language which would be mutually agreeable,
seconded by Mrs. Rodriguez, and. carried unanimously.
Discussion continued.
Ms. Newton expressed pleasure in the interest of Mr. & Mrs. Fabian in their
home} and preserving its' character, she thanked them for coming to the
meeting, and again expressed a desire to come to agreement on a modified
covenant.
4. FEDERAL GRANT ASSISTANCE
Letter from George Percy, Chief, Bureau of Historic Preservation
Florida Department of State.
Msr. Newton read a letter from George Percy, stating that. the Miami Shores
Historic Preservation is #10 on the priority list to receive funding of
$2,000. when the funds become available.
5. ELECTION OF CHAIRMAN
Ms. Newton stated that in reviewing the Ordinance she realized that the
Chairman serves for a period of one year, since she was appointed last
April tofill a term to September she feels a Chairman should be elected.
Following brief discussion, Addea Colangelo moved to appoint Margo Nelaton,
Chairman of Historic Preservation Board to run to September, seconded by
Vivian Rodriguez, and carried unanimously.
6. ANNOUNCEMENTS, COMMENTS, REPORTS
A. The listing of Miami Shores Historic Landmarks was review by
Ms. Newton, who commented on those who have not signed the
covenant. Of a total of 27, 8 have not signed, and one was
removed from designation. Mrs. Colangelo suggested the home-
owners be invited to the functions sponsored by the Board so
that they will be more comfortable, and aware of the Board's
functions.

B. Ms. Newton urged members to write letters. to Commissioners, and
make calls concerning present level of funding for Metro,Dade
Division of Historic Preservation. These letters should be written
before July, before the new budget is prepared and adopted.
C. A letter has been sent to Daniel & Claudia Aulton by Ms. Newton,
as was moved at the special meeting of the Board. She also
enclosed a copy of the Secretary of Interior's Standards for
Rehabilitation and Guidelines for Rehabilitating Historic Buildings.
It was agreed by the. Board that in the future the owner should be
present when A Certificate of Appropriateness is considered.
D. The Miami Shores House Tour is scheduled for.April 27th, 1-4 P.M.,
tickets willcbe available at the Grand Concourse Apartments.
Stephen Smith is writing an article for the Neighborssection of
The Miami Herald to promote the event.
E. May 14,is Preservation Day in Tallahassee, sponsored by the Florida
Trust. This is a fine experience if one can attend, and it gives
an opportunity to lobby the legislatures. Also Ms. Newton urged
those who are not members to join the Florida Trust, she has the
application forms.
F. A program, sponsoredby the Friends of the Library In conjunction
with Dade Heritage Days will be held on April 22 at 7:00 P.M. at
the Miami Shores Brockway Library.
G. Mrs. Rodriguez announced, the Dade Council of Preservation Boards
is sponsoring a workshop on May 24th at the Miami Woman's Club.
The Workshop will run from 9:00 A.M. to 1:00 P.M.
H. Mr. Courtney wished to encourage people to open their homes for
special viewing by the public, he requested discussion and sugges-
tions as to how this could be accomplished. Mrs. Rodriguez suggested
an article in the Chamber News highlighting a Historic Landmark, a
Miami Shores monthly showcase home. Discussion followed.
The business of the meeting adjourned at 8:40 P.M..
7. MIAMI SHORES VILLAGE SLIDES
A slide program of early Miami Shores was conducted with commentary by
Mr. Gaggstatter. The slides were assembled by Lawton McCall, a former
Miami. Shores Village Manager.
Program concluded at 9:30 P.M.
