CODE ENFORCEMENT BOARD REGULAR MEETING
October 5, 1995
A regular meeting of the Miami Shores Village Code Enforcement Board was held on
Thursday, October 5, 1995, at Miami Shores Village Hall. The meeting was called to
order by Chairperson Asmus at 6:30 P.M. with the following members present: .

Chairperson Asmus called the meeting to order with the first item on the Agenda being
the approval of the September 7, 1995, Minutes.
• 1. Approval of Minutes
Mr. Hegedus moved to approve the Minutes of September 7, 1995. Mr. Herrera
seconded the motion and it passed unanimously.
HEARING
2. Case No. 4656
Recreational Vehicle on Premises
150 NW 109 Street
Owner: Mema Mathews
Section 501 (S) (1). Recreation Vehicle on Premises.
Parking a recreational vehicle on premises not in a garage or rear yard, or in
excess of 20' in length and 10' in height is prohibited.
Ms. Merna Mathews was present to speak on the violation. Mr. Pierre stated this
violation was for a 25' recreational vehicle (RV) parked on the east side of her house.
He said he had spoken with Ms. Mathews and she was willing to move the vehicle but
was having a problem in getting this done. Mr. Pierre suggested she come before the
• Board and ask for a continuance. Ms. Mathews stated she had tried to get U -Haul to

move it for her but they could not do it. Chairperson Asmus asked if the vehicle was
motorized. Ms. Mathews stated it was not and that it was a travel trailer. She reported
that she had contacted a company today that moves trailers. They have agreed to
move her trailer by this Saturday. Mr. Trumble advised that Ms. Mathews would move
the vehicle to Stuart where she owns property.
Mr. Hegedus moved for a Finding of Fact and Conclusion of Law that a violation
exists to Section 501 (S) (1) of the Miami Shores Village Code and the administrative
fee of $180 is waived. If the violation is not corrected within 30 days, a $25 a day fine
shall be levied. Mr. Caldwell seconded the motion and it passed unanimously.
3. Case No. 4604
Unlawful Structures
100 NE 110 Street
Owner: James Howard
Schedule of Regulations - U/S
Failure to construct accessory buildings in a location as required by law is
prohibited. An application for a building permit must be sought. If approved, relocation
of the accessory building or removal of building is required.
Mr. Hererra moved for dismissal. Mr. Caldwell seconded the motion and it
passed unanimously.

Section 12-133. Depreciation of surrounding property.
The exterior of every structure shall be so maintained with reasonable
attractiveness so as not, in the case of excessive scaling or paint or excessive mildew,
to cause a substantial depreciation in property values in the immediate neighborhood.
The exterior surfaces shall be kept free from materials, objects and conditions which will
have an adverse effect on adjacent premises.
Mr. Hererra moved for dismissal. Mr. Caldwell seconded the motion and it
passed unanimously.

Failure to Obtain an Occupational License

Section 14-17. Required; Hours for retail sales.
No person shall, within the limits of the village, engage nor manage any
business, occupation or profession without first having paid the amount of license tax
required by this chapter and without first having obtained a village occupational license
therefore issued for an applying to the current occupational license year, or fractional
part thereof, during which such business, occupation or profession is commenced,
carried on or engaged in. Such occupational license shall be applied for and obtained
before the commencement of any such business, occupation or profession, and
annually thereafter on or before October 1 or each year as long as such business,
occupation or profession Is carried on. Provided, nevertheless, that the retail sale of
consumer goods between the hours of 1:00 a.m. and 6:00 a.m. is prohibited.
Mr. Hererra moved for dismissal. Mr. Hegedus seconded the motion and it
• passed unanimously.

No one was present to speak on the violation. Mr. Pierre passed a picture to the
Board for review. He stated the house needs painting and a notice of violation was
issued. There has been no response. Mr. Trumble stated the house was abandoned.
Public Works has done some yard cleanup.
Mr. Hegedus moved for a Finding of Fact and Conclusion of Law that a violation
exists to Section 12-133 of the Miami Shores Village Code and an administrative fee of
$180 shall be assessed. If the violation is not corrected within 30 days, a $25 a day
fine shall be levied. Mr. Caldwell seconded the motion and it passed unanimously.
9. Case No. 4631

No one was present to speak on the violation. Mr. Pierre stated this was house
which was rented without an occupational rental license to a Barry University student.
He spoke with the manager, Mr. Rodriguez, today and has left messages. No one has
come in to apply for a license.
Mr. Caldwell moved for a Finding of Fact and Conclusion of Law that a violation
exists to Section 14-17 of the Miami Shores Village Code and an administrative fee of
$180 shall be assessed. If the violation is not corrected within 30 days, a $25 a day
fine shall be levied. Mr. Hegedus seconded the motion and it passed unanimously.
10. Case No. 4634

rented without a license. He spoke with Ms. Guittierez to get a license but she has not
done so.

exists to Section 14-17 of the Miami Shores Village Code and an administrative fee of
$180 shall be assessed. If the violation is not corrected within 30 days, a $25 a day
fine shall be levied. Mr. Herrera seconded the motion and it passed unanimously.
11. Case No. 4643

The exterior of every structure shall be so maintained with reasonable
attractiveness so as not, in the case of excessive scaling or paint or excessive mildew,
to cause a substantial depreciation in property values in the immediate neighborhood.
The exterior surfaces shall be kept free from materials, objects and conditions which will
have an adverse effect on adjacent premises.
No one was present to speak on the violation. Mr. Pierre stated the violation
was given to paint the house. He passed a picture for the Board to review. A permit
had been obtain but is now expired.
Mr. Hegedus moved for a Finding of Fact and Conclusion of Law that a violation
exists to Section 12-133 of the Miami Shores Village Code and an administrative fee of
$180 shall be assessed. If the violation is not corrected within 30 days, a $50 a day
fine shall be levied. Mr. Herrera seconded the motion and it passed unanimously.
12. Case No. 4664
Inoperable Vehicle on Premises
68 NW 95 Street
Owner: New Owner
Section 13-1. Inoperable Vehicle on Premises.
Maintaining a vehicle not in provable operating condition and not stored in a
garage is prohibited. Vehicle is to be stored in a garage or removed.
No one was present to speak on the violation. Mr. Pierre stated the violation
was for vehicle without a tag. He stated he spoke with the owner who said he would
move the care. Mr. Pierre returned this afternoon and the car had not been moved.

Mr. Caldwell moved for a Finding of Fact and Conclusion of Law that a violation
exists to Section 13-1 of the Miami Shores Village Code and an administrative fee of
$180 shall be assessed. If the violation is not corrected within 30 days, a $25 a day
fine shall be levied. Mr. Herrera seconded the motion and it passed unanimously.
ADJOURNMENT
Mr. Caldwell moved for adjournment. Mr. Herrera seconded the motion and it
passed unanimously. The meeting adjourned at 6:45 P.M.
