02-03-1994 Regular Meeting• CODE ENFORCEMENT BOARD REGULAR MEETING FEBRUARY 3, 1994 A regular meeting of the Miami Shores Village Code Enforce- ment Board was held on Thursday February 3, 1994 at the Miami Shores Village Hall. The meeting was called to order by Acting Chairman Caldwell at 7:30 P.M. with the following members present: Thomas Caldwell John Patnik Jr. Margaret Burch Ivor Hegedus Absent: Barry Asmus, Daniel Owens and Prospero G. Herrera II Also Present:Mr. Frank LuBien, Director of Code Enforcement Mr. Richard Trumble, Code Enforcement Inspector Mr. Jean Placide, Code Enforcement inspector Mr. LuBien, Mr. Trumble and Mr. Placide were sworn In for the meeting. 1. Minutes of January 6, 1994 Ms. Burch moved to approve the Minutes of January 6, 1994 as submitted. Mr. Hegedus seconded the motion and it passed unanimously. 411 2. Request for Relief Case 3496 29 NW 110 Street Andre Homere $1500 fine due for violation cited 9/20/93 and in compliance as of 1/5/94 for wooden fence In rear yard had missing boards and pool enclosure had broken aluminum posts and damaged screening. After a discussion, Ms. Burch moved to deny the request for relief. Mr. Patnik seconded the motion and the motion passed unanimously. Request for Relief Case 2353 925 NE 92 St Jose Alvarez -Alfonso $735 fine due for violation cited 8/26/91 and brought into compliance as of 5/7/92 for foliage in unsightly condition. Mr. Alvarez -Alfonso stated his home was In compliance and he submitted payment of $11O Administrative fee In November 1991 and was not aware of the on-going fine and had not received an invoice from the Village of Miami Shores regarding the clean up of his property. • Mr. LuBien stated that the former Code Enforcement officer, Mr. Rodriguez, was In charge of this violation and that he • • • Code Enforcement meeting - 2 - February 3, 1994 (Mr. LuBien), was not Informed of the dialogue between Mr. Rodriguez and Mr. Alvarez -Alfonso. After further discussion, Mr. Hegedus moved to approve the request for relief In full Ms. Burch seconded the motion and it passed unanimously. Request for Relief Case 3617 893 NE 96 Street Phillip Davis Exterior of house and perimeter wall have excessive mildew and peeling paint. Mr. Davis stated, that in his opinion, the house was not in bad need of painting and would like to have until the end of the year to bring the home into compliance. After a discussion, Ms. Burch moved to deny the request for relief and to approve an extension of 60 days to come Into compliance or the original fine of $25 a day will occur. Mr. Hegedus seconded the motion and it passed unanimously. Case 3598 122 NW 110 Street Archille Gervais Erecting a circular driveway on the north side of the pro- perty with unauthorized materials and without first obtaining a building permit. Mr. Placide stated that the residence was not In compliance as of this date. After a discussion, Ms. Burch moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 6-4 of the Miami Shores Village Code and ordered if not corrected In 30 days, a fine of $25 per day will be- come effective. Mr. Patnik seconded the motion and it passed unanimously. Case 3625 117 NW 93 Street Colette Mills Failure to maintain parkway by allowing grass to deteriorate. Mr. Placide stated that the residence was not In compliance as of this date. After a discussion, Mr. Hegedus moved for a Finding of Fact and Conclusion of Law that a violation exists to SEction 20-17 of the Miami Shores Village Code and ordered If not corrected in 30 days, a fine of $25 per day will be- come effective. Mr. Patnik seconded the motion and it passed unanimously. Case 3680 10 NE 97 Street Donna Props. Inc. Missing screening on pool enclosure and missing lock on enclosure door. Code Enforcement meeting - 3 - February 3, 1994 Mr. Heart stated the lock has been placed on the fence gate and the screen enclosure will be disassembled on Friday, February 4, 1994. After a discussion, Ms. Burch moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Mr. Patnik seconded the motion and it passed unanimously. Case 3695 284 NE 102 Street Milagros Harper ° Broken and loose tiles on roof and exterior walls have peeling paint. Mr. Trumble stated that no permit has been issued as of this date. After a discussion, Ms. Burch moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code and ordered if not corrected In 30 days, a fine of $25 per day will become effective. Mr. Patnik seconded the motion and It passed unanimously. Case 3696 520 NE 92 Street Frank Rom Excess mildew - peeling paint. Mr. Rom stated he has been having a difficult time getting a honest contractor and that he has now hired Mr. Don Pettigrew to begin the job. Mr. Pettigrew stated that he will bring all the necessary paperwork to Building and Zoning on Friday, February 4, 1994. After a discussion, Ms. Burch moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Mr. Hegedus seconded the motion and it passed unanimously. Case 3699 546 NE 92 Street Michael Dorsey Failure to obtain alarm permit. Mr. Trumble stated a permit has not been issued as of this date. After a discussion, Mr. Hegedus moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 547-91 of the Miami Shores Village Code and ordered if not corrected In 30 days, a fine of $25 per day will become effective. Ms. Burch seconded the motion and it passed unanimously. Code Enforcement meeting - 4 - Febuary 3, 1994 Case 3703 72 NW 97 Street Gloria Robinson Failure to obtain alarm permit. Mr. Placlde stated the violation has been corrected. Ms. Burch moved to dismiss the case and Mr. Patnik seconded the motion and It passed unanimously. Case 3723 112 NE 111 Street Luis M. Martin Property Is being rented out: No Occupational license on file. Mr. Placlde stated the violation has been corrected. Ms. Burch moved to dismiss the case and Mr. Patnik seconded the motion and It passed unanimously. Case 3741 137 NE 106 Street Ocgena DeCastro Multiple occupancy in single family zone.(Home owner living In rear unit of the property). • Mr. Placlde stated the violation has been corrected.
