01-06-1994 Regular Meeting• CODE ENFORCEMENT BOARD REGULAR MEETING JANUARY 6, 1994 A regular meeting of the Miami Shores Village Code Enforce- ment Board was held on Thursday January 6, 1994 at the Miami Shores Village Hall. The meeting was called to order by Chairman Asmus at 7:30 P.M. with the following members present: Barry Asmus Thomas Caldwell Daniel B. Owens John L. Patnik Jr. Prospero G. Herrera 11 Ivor Hegedus Margaret Burch Also Present:Mr. Frank LuBien, Director of Code Enforcement Mr. Richard Trumble, Code Enforcement Inspector Mr. Jean Placide, Code Enforcement Inspector Mr. LuBien, Mr. Trumble and Mr. Placide were sworn in for the meeting. 1. Minutes of December 2, 1993 Mr. Caldwell moved to approve the Minutes of December 2, 1993. Ms. Burch seconded the motion and It passed unanimously. Case 3293 Existing walls & metal awnings on property need to be painted. 107 NW 109 Street James T. Musselwhite Mr. Placide stated the residence Is not In compliance. Mr. Douglas Musselwhite stated that he has all the materials ready to start painting the residence and will get started as soon as possible. After further discussion, Ms. Burch moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code and ordered if not corrected In 30 days, a fine of $50 per day will become effective. Mr. Patnik seconded the motion and it passed unanimously. Case 3610 Bottom of 16'-1" Wide garage door has mildewed and rotten boards throughout. 20 NE 104 Street Francine Pierre Louis Mr. Placide stated that the violation was corrected. Mr. Caldwell moved to dismiss the case and Ms. Burch seconded the motion and it passed unanimously. Case 3617 Exterior of house and perimeter wall have excessive mildew and peeling paint. • 893 NE 96 Street Phillip S. Davis • • Code Enforcement Board meeting - 2 - January 6, 1994 Mr. Trumble stated that the violation does exist as of this date. After a discussion, Ms. Burch moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Mr. Caldwell seconded the motion and It passed unanimously. Case 3624 Unauthorized construction - Placing of pea rock In swale area and north side of house without obtaining a permit. 10650 NE 10 Court Sven Rostad Mr. LuBien stated that Mr. Rostad placed pea rock In the swale area and pea rock Is not a permitted material In the swale area. After much discussion, Mr. Caldwell moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 6-4 of the Miami Shores Village Code and ordered If not corrected In 60 days, a fine of $25 per day will become effective. The vote was as follows: Mr. Caldwell and Chairman Asmus YES; Mr. Owens, Mr. Patnik, Mr. Herrera, Mr. Hegedus, Ms. Burch NO. The motion failed and Chairman Asmus passed the gavel to Vice Chairman Caldwell. After further discussion, Mr. Asmus moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 6-4 of the Miami Shores Village Code and ordered If not corrected In 30 days, a fine of $25 per day will become effective. The vote was as follows: Mr. Patnik and Mr. Herrera NO; Ms. Burch, Mr. Caldwell, Mr. Owens, Mr. Hegedus, and Mr. Asmus YES. The motion passed 5 to 2. Mr. Rostad explained that he was not aware of the ordinance and he would have the pea rock removed. Case 3650 Exterior garage door has mildew, peeling paint, etc. Awning on west side of property Is hanging loose off Its brackets. 101 NE 106 Street Estate of Roy C. Bell Mr. Placlde stated that the violation was not In compliance as of this date. After a discussion, Mr. Caldwell moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Mr. Herrera seconded the motion and it passed unanimously. Case 3647 Tearing out wall In back bathroom and dumping in driveway with- out obtaining a permit. 1276 NE 93 Street Mr. John Shepherd Code Enforcement Board meeting - 3 - January 6, 1994 Mr. Trumble stated that the violation was not In compliance as of this date. Mr. Shepherd stated that the expense of the alteration did not exceed $100 and therefore he did not need a permit. Mr. LuBlen stated that the requirement for a permit Is based on value, not cost. After further discussion, Ms. Burch moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 6-4 of the Miami Shores Village Code and ordered if not corrected in 30 days, a fine of $25 per day will become effective. Mr. Patnik seconded the motion and it passed unanimously. Case 3652 Unauthorized construction -alterations, windows, plumbing, exterior walls, repainting, electrical and plastering work. 9526 North Miami Avenue Refik Cevik Mr. Piacide stated the violation was not in compliance as of this date. After a discussion, Mr. Hegedus moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 6-4 of the Miami Shores Village Code and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Ms. Burch seconded the motion and it passed unanimously. Case 3672 White Ford van KPI20X-Viking Plumbing - prohibited parking. 10650 NE 10 Court Sven Rostad Mr. Trumbie stated that the violation was not in compliance as of this date. Mr. Rostad stated that the vehicles were removed from the pro- perty. Ms. Nery Garcia of 10659 NE 10 Court stated that the commercial vehicles were parked In front of the Rostad residence when she left her home to come to the Code Enforcement meeting. Ms. Garcia specifically attended the Code Enforcement meeting to validate the fact of the commercial vehicles parked at Mr. Rostad's residence. After further discussion, Mr. Caldwell moved for a Finding of Fact and Conclusion of Law that a violation exists to the Schedule of Regulations of the Miami Shores Village Code and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Ms. Burch seconded the motion and it passed unanimously. • Code Enforcement Board meeting - 4 - January 6, 1994 410 Case 3684 Property being rented out - without an Occupational License. 46 NW 96 Street Clarence Charles Mr. Placide stated that the violation was not In compliance as of this date. After a discussion, Mr. Caldwell moved for a Finding of Fact and Conclusion of Law that a vlolatlon exists to Section 14-17 of the Miami Shores Village Code and ordered If not corrected in 30 days, a fine of $25 per day will become effective. Mr. Herrera seconded the motion and it passed unanimously. Case 3685 Property being rented out - without an Occupational License. 54 NW 104 Street David Campbell Mr. Placide stated that the violation was In compliance as of this date. Ms. Burch moved to dismiss the case. Mr. Patnik seconded the motion and It passed unanimously. 411 Case 3686 Property being rented out - without an Occupational License. 142 NW 103 Street Akos Aczel Mr. Placide stated the violation was not In compliance as of this date. Mr. Aczel stated that he was letting a friend stay at his home and not collecting rent and presented a letter from his friend. After a discussion, Mr. Hegedus moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 14-17 of the Miami Shores Village Code and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Mr. Patnik seconded the motion and It passed unanimously. Case 3694 Bal Harbour Florist van parked In driveway of residence on a regular basis. 10130 North Miami Ave Manuel Peres Mr. Placide stated the violation was not In compliance as of this date. • Code Enforcement Board meeting - 5 - January 6, 1994 • After a discussion, Ms. Burch moved for a Finding of Fact and Conclusion of Law that a violation exists to the Schedule of Regulations of the Miami Shores Village Code and ordered If not corrected In 30 days, a fine of $25 per day will become effective.
