10-07-1993 Regular Meeting• • • CODE ENFORCEMENT BOARD REGULAR MEETING OCTOBER 7, 1993 A regular meeting of the Miami Shores Village Code Enforce- ment Board was held on Thursday October 7, 1993 at the Miami Shores Village Hall. The meeting was called to order by Chairman Asmus at 7:30 P.M. with the following members present: Chairman Asmus Daniel B. Owens John L. Patnik Jr. Prospero G. Herrera II Thomas Caldwell Ivor Hegedus Absent: Ms. Margaret Burch Also Present:Mr. Frank LuBien, Director of Code Enforcement Mr. Richard Trumble, Code Enforcement Inspector Mr. Jean Placide, Code Enforcement Inspector Mr. LuBien, Mr. Trumble and Mr. Placide were sworn In for the meeting. Mr. LuBien Introduced Mr. Ivor Hegedus as a new Board member. 1. Minutes of September 2, 1993 Mr. Caldwell moved to approve the Minutes of the •September 2, 1993 meeting as submitted. Mr. Owens seconded the motion and It passed unanimously. 2. Case 3465 Owner: Lloyd & Marla Caballero 10 NE 103 Street Mr. Placide stated that as of this morning (Oct. 7, 1993), the property was not In compliance. After a discussion regarding the unsightly fascia, soffit and house exterior Mr. Caldwell moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Mr. Owens seconded the motion and It passed unanimously. Case 3480 Owner: Thomas Romanik 195 NW 103 Street Mr. Romanik was sworn In and explained that unsightly fascia, soffit and house exterior should be In compliance as soon as possible and that he has contracted to have the work done. After a discussion, Mr. Owens moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code and ordered If not corrected In 30 days, a fine of $25 per day wilt become effective. Mr. Caldwell seconded the motion and it passed unanimously. • • Code Enforcement meeting - 2 - October 7, 1993 Case 3482 Owner: Donna Brice 901 NE 91 Terrace Mr. Richard Bolt represented Ms. Brice and was sworn In. Mr. Bolt stated that the unsightly fascia, soffit, and house exterior will be In compliance within 30 days. After a discussion, Mr. Caldwell moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code and ordered if not corrected in 30 days, a fine of $25 per day will become effective. Mr. Herrera seconded the motion and it passed unanimously. Case 3488 Owner: Brian K. Sloan 290 NW 93 Street Mr. Placlde stated the Inoperable vehicle on the premises has not been removed as of today (October 7, 1993). After a discussion, Mr. Caldwell moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 13-1 of the Miami Shores Village Code and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Mr. Owens seconded the motion and It passed unanimously. Case 3496 Owner: Andre Homere & Marie Louis 29 NW 110 Street Mr. Placlde stated the unsightly fascia, soffit and house exterior have not been brought Into compliance as of today (October 7, 1993). After a discussion, Mr. Owens moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Mr. Caldwell seconded the motion and it passed unanimously. Case 3498 Owner: Andre Homere & Marie Louis 29 NW 110 Street Mr. Placlde stated that the general unsightliness of the property has been brought into compliance. Mr. Caldwell moved to dismiss the case. Mr. Owens seconded the motion and it passed unanimously. Code Enforcement meeting - 3 - October 7, 1993 • Case 3515 Owner: Yvon St. Juste 168 NE 91 Street Mr. St. Juste was sworn In and stated that he planted the hedge on what he considered his property and that the previous owner put up the chain Zink fence. Mr. LuBien stated that the hedge in not on Mr. St. Juste's property, but on Village property. After a discussion, Mr. Caldwell moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 20-16 Subsection B of the Miami Shores Village Code and ordered If not corrected In 30 days a fine of $10 per day will become effective. Mr. Patnik seconded the motion and It passed unanimously. New Business Mr. Owens nominated Mr. Barry Asmus as Chairman of the Code Enforcement Board. Mr. Herrera seconded the motion and It passed unanimously. Mr. Caldwell moved to close the nomination for Chairman and Mr. Patnik seconded the motion. Mr. Asmus nominated Mr. Caldwell and Vice Chairman of the Code Enforcement Board. Mr. Owens seconded the motion and It passed unanimously. Mr. Herrera moved to close the nomination for Vice Chairman and Mr. Hegedus seconded the motion. A motion for adjournment was made at 8:05 P.M. Veronica A. Galli, Secretary Asmus, Chairman
