09-02-1993 Regular Meeting• • • CODE ENFORCEMENT BOARD REGULAR MEETING SEPTEMBER 2, 1993 A regular meeting of the Miami Shores Village Code Enforce- ment Board was held on Thursday September 2, 1993 at the Miami Shores Village Hall. The meeting was called to order by Chairman Asmus at 7:30 P.M. with the following members present: Chairman Barry Asmus Daniel B. Owens John L. Patnik Jr. Prospero G. Herrera II John L. Stokesberry Thomas Caldwell Absent: Ms. Margaret Burch Also Present:Mr. Frank LuBlen, Director of Code Enforcement, Mr. Richard Trumble, Code Enforcement Inspector Mr. Jean Placide, Code Enforcement Inspector Mr. LuBlen, Mr. Trumble and Mr. Placide were sworn In for the meeting. 1. Minutes of August 5, 1993 Mr. Caldwell moved to approve the minutes of the August 5, 1993 meeting. Mr. Stokesberry seconded the motion and it passed unanimously. 2. Case No. 3333 Owner: T. W. Treadwell 551 NE 102 Street Chairman Asmus Instructed that the record show that no one was present to represent the property owner. The Board discussed the unsightly fascia, soffit and house exterior and Mr. Caldwell moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code and ordered if not corrected In 30 days, a fine of $25 per day will become effective. Mr.Stokesberry seconded the motion and it passed unanimously. Case No. 3336 Owner: Delta Lynne Grady 10580 NE 2 Place After a discussion regarding the unsightly fascia, soffit and house exterior, Mr. Caldwell moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code and ordered if not corrected In 30 days, a fine of $25 per day will become effective. Mr. Stokesberry seconded the motion and It passed unanimously. Code Enforcement meeting - 2 - September 2, 1993 Case No. 3366 Owner: Dorothea Myrick 9413 NW 2 Place After a discussion regarding the lack of off street parking at the above address, Mr. Owens moved for Finding of Fact and Conclusion of Law a violation does exist to the Schedule of Regulations of the Village of Miami Shores and if the violation is not corrected within 30 days, a fine of $25 per day will be- come effective. Mr. STokesberry seconded the motion and it passed unanimously. Case No. 3408 Owner: Sally Case Marino 241 NW 92 Street The Board discussed the unsightly fascia, soffit and house exterior at the above location. Mr.Stokesberry moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code, and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Mr. Caldwell seconded the motion and It passed unanimously. Case No. 3426 Owner: Mr. William H. Generette 402 NE 93 Street Mr. Generette was sworn In. Mr. Generette presented a letter to the Board stating his opinion of why he was not in violation to the Village of Miami Shores Code. He also presented slide pictures of his home and explained his opinion that his home was not unsightly, and yes, there was an area that needed attention, but he felt that he did not warrant a violation. After further discussion, Mr. Caldwell moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code, and ordered If not corrected In 30 days, a fine of $25 per day will become effective. The motion was seconded for discussion by Mr. Patnik. After the discussion, Mr. Caldwell amended to motion to have the violation corrected In 60 days, or a fine of $25 per day will become effective. Mr. Patnik seconded the amended motion and It passed unanimously. Case No. 3440 Owner: Joanan Ellen 24 NW 102 Street Mr. Ellen was sworn in. Mr. Ellen explained that he did not know that he was In violation of having a non -family occupancy at his home. After further discussion, Mr. CAldweil moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 2-16 of the Miami Shores Village Code, and ordered If not corrected In 30 days, a fine of $25 per day will become effective. The motion was seconded by Mr. Stokesberry and it passed unanimously. • • • Code Enforcement meeting - 3 - September 2, 1993 Case 3459 Owner: Diane L. Barton 11040 NW 2 Avenue Mr. LuBien explained that the property has been brought Into compliance and a violation no longer exists. Mr. Caldwell moved to dismiss the case. Mr. Stokesberry seconded the motion and It passed unanimously. Case No. 3467 Owner: Phyllis G. Blanco 533 NE 91 Street Mr. LuBien explained that Ms. Blanco has made an effort to clean up her property but that a violation still exists. Mr. LuBien went on to explain that the yard Is heavy with fruit trees and various vegitation that is not controlled. Ms. Blanco was sworn In. Ms. Blanco stated that she has cleaned up a good deal of the rubbish from the yard and Is still In the process of getting the yard in order. She has hired a yardman to help with the trees and vegitation. Ms. Blanco stated that she felt that the yard could be in compliance within 60 days. Mr. Tom Loftess was sworn in. Mr. Loftess Is a neighbor of Ms. Blanco's and stated that he felt that Ms. Blanco has done a good Job of cleaning the yard but work still had to be done. After a discussion, Mr. Stokesberry moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 10-1 of the Miami Shores Village Code, and ordered If not corrected In 60 days, a fine of $25 per day will become effective. Mr. Patnik seconded the motion and It passed unanimously. Chairman Asmus announced that Mr. Stokesberry's term on the Board had expired and that Mr. Stokesberry would not be coming back to serve on the Board.
