08-05-1993 Regular Meeting• CODE ENFORCEMENT BOARD REGULAR MEETING AUGUST 5, 1993 A regular meeting of the Miami Shores Village Code Enforce- ment Board was held on Thursday August 5, 1993 at the Miami Shores Village Hall. The meeting was called to order by Mr. Caldwell at 7:30 P.M. with the following members present: Margaret Burch Daniel B. Owens John L. Patnik Jr. Prospero G. Herrera II John L. Stokesberry Barry K. Asmus (arrived at 7:42) Absent: Mr. Frank LuBien, Director of Code Enforcement Also Present: Richard Trumble, Code Enforcement Inspector Jean Placide, Code Enforcement Inspector 1. Minutes Ms. Burch moved to approve the minutes of the July 1, 1993 meeting as written. Mr. Stokesberry seconded the motion and it passed unanimously. • 2. Request for Relief Yvan Frederic 9325 NW 2 Court • Mr. Frederic stated that he has tried to comply with the various violations and Is still trying. Mr. Frederic re- quested relief from the accrued fines. After further discussion, Mr. Stokesberry moved to deny the request. Ms. Burch seconded the motion and the vote did not pass with the voting as follows: Mr. Patnik, Mr. Herrera and Mr. Caldwell NO. Mr. Stokesberry, Mr. Owens and Ms. Burch YES. After further dlscusslon, Mr. Patnik moved to provide relief in the amount of 50% of the combined fines. Mr. Owens seconded the motion and it passed with the vote 4 - 1 with Mr. Stokesberry voting NO. Request for Relief Elizabeth L. H. Errisson 18 NE 107 Street After a dlscusslon, Mr. Stokesberry moved to deny the re- quest for relief of the accuring fines. Ms. Burch seconded the motion and it passed unanimously. • Code Enforcement Board meeging - 2 - August 5, 1993 Case No. 003293 Owner: Ms. Musselwhite 107 NW 109 Street Ms. Musselwhite had submitted a letter to the Board explain- ing that her husband had recently died and she was having a difficult time adjusting to the circumstances. After a discussion, Ms. Burch made a motion to give Ms. Musselwhite a 60 day extension. Mr. Stokesberry seconded the motion and It passed unanimously. Case No. 003312 Owner: Joseph Mondy 160 NW 95 Street Ms. Mondy explained that her family Just received an Insurance check and work should be starting shortly and ail the necessary repairs will be taken care of. After a discussion, Mr. Stokesberry moved for a Finding of fAct and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code, and ordered If not corrected In 60 days, a fine of $25 per day will become effective. Ms. Burch seconded the motion and It passed unanimously. • Case No.003313 Owner: Aristotle Diamond 117 NE 98 St Mr. Diamond explained the house has been worked on and clean- ed up considerably. After further discussion, Ms. Burch moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code, and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Mr. Patnik seconded the motion and the motion failed with the vote 5 - 1 with Mr. Asmus voting YES. After further discussion, Mr. Caldwell moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the MiamI Shores Village Code, and ordered If not corrected In 60 days, a fine of $25 per day will become • effective. Mr. Stokesberry seconded the motion. The motion passed with the vote 5 - 1 with Mr. Asmus voting NO. Case No. 003319 Owner: Jean C. Romelus 201 NW 91 Street • • • Code Enforcement Board meeting - 3 - August 5, 1993 After a discussion, Mr. Caldwell moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code, and ordered If not corrected in 30 days, a fine of $25 per day will become effective. Mr. Stokesberry seconded the motion and it passed unanimously. Case No. 003320 Owner: Jean C. Romelus 201 NW 91 Street After a discussion, Ms. Burch moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 20-17 of the Miami Shores Village Code, and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Mr. Stokesberry seconded the motion and It passed unanimously. Case No. 003332 Owner: Malek Brourl 231 NE 104 Street Mr. Brouri stated that he will do the necessary repairs to the home as soon as possible. After a discussion, Mr. Caldwell moved to dismiss the case. Mr. Herrera seconded the motion and the motion failed with the vote of 4 - 2. Ms. Burch, Mr. Stokesberry, Mr. Owens and Mr. Asmus voting NO and Mr. Caldwell and Mr. Patnik voting YES. After further discussion, Mr. Stokesberry moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code, and ordered If not corrected In 30 days, a fine of $25 per day will be- come effective. Mr. Patnik seconded the motion and it pass- ed unanimously. Case NO. 003347 Owner: Hughes J. Auguste 242 NW 93 Street After a discussion, Ms. Burch moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code, and ordered If not corrected In 30 days, a fine of $25 per day will become effective. • Mr. Stokesberry seconded the motion and it passed unanimously Case No. 003354 Owner: Ifocoeur Petit 141 NW 100 Terrace • Mr. Trumble stated that Mr. Petit was renting a portion of his home and that now the tenant has moved and Mr. Petit Is taking the second kitchen out of the home. Mr. Petit said that he would comply with the removal of the second kitchen. • • • • Code Enforcement Board meeting - 4 - August 6, 1993 After a discussion, Mr. Stokesberry moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 216 of the Miami Shores Village Code, and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Ms. Burch seconded the motion and It passed unanimously. Case No. 003355 Owner: Elspeth G. Hotchkiss 174 NE 106 Street Ms. Hotchkiss explained that the roofer she contracted started the Job and took off not completing the Job and taking her money. She has tried to locate the roofer, but he has left the area. After a discussion, Mr. Stokesberry moved to dismiss the case. Mr. Herrera seconded the motion and it passed unanimously. Case No. 003406 Owner: Jacques Ardisson 125 NE 106 Street After a discussion, Ms. Burch moved to dismiss the case. Mr. Stokesberry seconded the motion and It passed unanimously.
