07-01-1993 Regular Meeting• • • CODE ENFORCEMENT BOARD REGULAR MEETING JULY 1, 1993 A regular meeting of the Miami Shores Village Code Enforcement Board was held on Tuesday, July 1, 1993 at the Miami Shores Village Hall. The meeting was called to order by Chairman Asmus at 7:32 P.M. with the following members present: Margaret Burch Daniel B. Owens John L. Patnik Jr. Prospero G. Herrera II John L. Stokesberry Barry K. Asmus Absent: Thomas J. Caldwell Also Present: Frank LuBlen, Director of Code Enforcement Richard Trumble, Code Enforcement Inspector Jorge Garcia, Code Enforcement Inspector Jean Placide, Code Enforcement Inspector 1. Minutes June 3, 1993 Ms. Burch moved to approve the Minutes of the June 3, 1993 meeting as written. Mr. Stokesberry seconded the motion and it passed unanimously. Mr. LuBlen, Mr. Trumble, Mr. Placide and Mr. Garcia were sworn In. 2. Request for relief No. 002990 Owner: Angeline Jean Baptiste 10516 NW 2 Avenue Ms. Baptiste was sworn In. She explained that she was not aware that a permit was to be obtained In order to do the necessary repairs. After further discussion, Mr. Owens moved to approve the re- quest for relief with a fine of $50. Mr. Stokesberry seconded the motion and the vote was passed with Mr. Asmus voting NO and the rest of the Board voting YES. Request for relief No. 003078 Owner: Jorge I. Cuza 29 NE 106 Street After a discussion, Ms. Burch moved to deny relief and fine Mr. Cuza 1/2 of the amount due ($387.50). Mr. Patnik seconded the motion and It passed with the vote as follows: Ms. Burch, Mr. Patnik, Mr. Asmus and Mr. Stokesberry voted YES; Mr. Owens and Mr. Herrera voted NO. The motion passed 4 to 2. • • • Code Enforcement Board meeting - 2 - July 1, 1993 After further discussion, and up -dated information submitted to the Board, a motion was made by Ms. Burch to deny relief and fine Mr. Cuza In the amount of $775. Mr. Patnik seconded the motion and the vote was: Mr. Herrera and Mr. Owens NO; Mr. Asmus, Ms. Burch, Mr. Patnik and Mr. Stokesberry YES. The motion passed with a vote of 4 to 2. Request relief No. 002996 Owner: Housing and Urban Development 68 NW 92 Street Mr. Stokesberry moved to delete this Item from the agenda. Ms. Burch seconded the motion and It passed unanimously. Case No. 003133 Owner: Sarah Meltzoff 152 NE 93 Street Mr. Garcia told the Board that Ms. Meltzoff has not compiled with the notice to obtain a permit for the work performed. Mr. Stokesberry moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 6-4 of the Miami Shores Village Code, and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Mr. Herrera seconded the motion and the the motion passed 5 to 1 with Mr. Owens voting NO. Case No. 003157 Tenant: Bessie Green 70 NW 98 Street Mr. Piaclde explained to the Board that the tenant was In com- pliance. Mr. Owens moved to dismiss the case. Mr. Herrera seconded the motion and It passed unanimously. Case No. 003178 Owner: C.A. Hooks 11004 NW 2 Avenue Mr. Stokesberry moved to dismiss the case. Mr. Patnik seconded the motion and It passed unanimously. Case No. 003182 Owner: C. A. Hooks 11004 NW 4 Avenue After a discussion, Mr. Owens moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 10-1 of the Miami Shores Village Code, and ordered If not corrected In 30 days, a fine of $25 per day will become effective. • Code Enforcement Board meeting - 3 - July 1, 1993 Mr. Herrera seconded the motion and the motion passed with a 4 to 2 vote with Ms. Burch and Stokesberry voting NO. Case No. 003230 Owner: Juanita Givens Anderson 492 NW 111 Terrace Ms. Anderson was sworn In. Ms. Anderson explained that it was very difficult for her to obtain a permit because of circum- stances she had no control of. The Board suggested that she fill out a permit form immediately and have It notorized by someone at her work place and then dropped off at Building and Zoning as soon as possible. Ms. Anderson agreed to the Boards suggestion. After further discussion, Ms. Burch moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code, and ordered If not corrected In 60 days, a fine of $25 per day will be effective. Mr. Patnik seconded the motion and it passed unanimously. Case 003245 Owner: Blanca Olivera After a discussion, Ms. Burch moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code, and ordered If not corrected In • 30 days, a fine of $25 per day will be effective. Mr. Stokesberry seconded the motion and it passed unanimously. • Case 003247 Owner: Mllitana and Militana Law Office 8801 Biscayne Blvd Mr. Garcia stated that the property has not been brought Into compliance. Mr. Owens moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code, and ordered If not corrected In 30 days, a fine of $25 per day will be effective. Ms. Burch seconded the motion and it passed unanimously. Case 003248 Owner: ANJ Future Investments Inc. 8817 Biscayne Blvd Mr. Kahrlra was sworn In. He explained that the property was being worked on and should be completed shortly. After further discussion, Mr. Owens moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code, and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Mr. Stokesberry seconded the motion and it passed unanimously. Code Enforcement Board meeting - 4 - July 1, 1993 Case 003249 • Owner: ANJ Future Investments, Inc. 8851 Biscayne Blvd • • Mr. Kahrlra explained that this building was In the same area as the previous building and was being worked on also. After further discussion, Ms. Burch moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores VIIIage Code, and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Mr. Stokesberry seconded the motion and it passed unanimously. Case 003256 Owner: Fred Bender 199 NW 93 Street Mr. Bender was sworn In. Mr. Bender explained that he did not want to reduce the yard area of his home for a parking area because the yard provided a play area for his children. After further discussion, Mr. Patnlk moved for Finding of Fact and Conclusion of Law that a violation exists as per the Schedule of Regulations of the Miami Shores VIIIage Code, and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Mr. Stokesberry seconded the motion and It passed with a vote of 5 to 1 with Mr. Herrera voting NO. Case 003254 Owner: John Militana 8965 Biscayne Blvd. Mr. Garcia stated that the property Is not In compliance. Ms. Burch moved for a Finding of FAct and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores VIIIage Code, and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Mr. Stokesberry seconded the motion and it passed unanimously. Case 003272 Owner: Fred Bender 199 NW 93 Street Mr. Bender explained that he was working on the home and would complete the repairs as soon as possible. After a discussion, Mr. Stokesberry moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 10-1 of the Miami Shores Village Code, and ordered If not corrected In 60 days, a fine of $25 per day will become effective. Mr. Patnik seconded the motion and it passed unanimously. Mr. Owens seconded the motion and It passed unanimously. Case 003271 Owner: Jairo Gaviria 615 NE 97 Street Mr. Gaviria was sworn In. Mr. Gaviria explained that he was having problems with the insurance company In settling his claim after Hurricane Andrew, and finally the Insurance company has settled with him, and he started with the repairs needed on the home. After further discussion, Mr. Patnik moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores VIIIage Code, and ordered if not corrected In 30 days, a fine of $25 per day become effective. Mr. Stokesberry seconded the motion and it passed unanimously. Case 003295 • Owner: Costen Downs 198 NE 110 Street After a discussion, Ms. Burch moved for a Finding of Fact and Conclusion of Law that a violation exists to the Schedule of Regulations of the Miami Shores VIIIage Code, and ordered If not corrected In 30 days, a fine of $25 per day become effective. Mr. Stokesberry seconded the motion and It passed unanimously. Case 003290 Owner: Maricel Perez 290 NW 92 Street After a discussion, Ms. Burch moved for a Finding of Fact and Conclusion of Law that a violation exists to the Schedule of Regulations of the Miami Shores Village, and ordered If not corrected In 30 days, a fine of $25 per day become effective. Mr. Patnik seconded the motion and It passed unanimously. Case 003294 Owner: John Collins 11016 NW 2 Avenue Mr. Placide stated that the owner has not come Into compliance. • Mr. Owens moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 14-17 of the Miami Shores • Code Enforcement Board meeting - 6 - July 1, 1993 Village Code, and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Ms. Burch seconded the motion and it passed unanimously. Case 003309 Owner: Juana Ledesma 273 NW 92 Street Mr. Garcia stated that the property has not come Into compliance. Mr. Stokesberry moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 502 of the Miami Shores Village Code, and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Ms. Burch seconded the motion and it passed unanimously. Case No. 003300 Owner: Marta McCormack 805 NE 95 Street Mr. Trumble stated that the property owner has complied with the notice of violation and that the property Is now In com- pliance. • Mr. Stokesberry moved to dismiss the case. Ms. Burch moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 10-1 of the Miami Shores Village Code, and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Mr. Patnik seconded the motion and it passed unanimously. • Code Enforcement Board meeting - 7 - July 1, 1993 Case No. 003337 111 Owner: Kathy & Laure Kopyclnskl 10666 NE 11 Court • • Mr. Trumble stated that the property owner has not compiled with the notice of violation. Ms. Burch moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 13-1 of the Miami Shores Village Code, and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Mr. Stokesberry seconded the motion and it passed unanimously. Case No. 003338 Owner: Kathy & Laure Kopyclnskl 10666 NE 11 Court Mr. Trumble stated that the property owner has not complied with the notice of violation. Mr. Stokesberry moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-211 of the Miami Shores Village Code, and ordered If not corrected in 30 days, a fine of $25 per day will become effective.
