06-03-1993 Regular MeetingCODE ENFORCEMENT BOARD REGULAR MEETING JUNE 3, 1993 • A regular meeting of the Mlami Shores Village Code Enforcement Board was held on Thursday, June 3, 1993 at the Miami Shores Village Hall. The meeting was called to order by Vice -Chair- man Thomas J. Caldwell at 7:30 P.M. with the following members present: Margaret Burch Danlel B. Owens John L. Patnik Jr. Prospero G. Herrera III John L. Stokesberry Thomas J. Caldwell Absent: Barry K. Asmus Also Present: Frank LuBien, Director of Code Enforcement Richard Trumble, Code Enforcement Inspector Jorge Garcia, Code Enforcement Inspector Jean Placide, Code Enforcement Inspector 1. Minutes May 6, 1993 Ms. Burch moved to approve the Minutes of May 6, 1993 as written. Mr. Stokesberry seconded the motion and It passed unanimously. • Mr. LuBien, Mr. Trumble, Mr. Placide and Mr. Garcia were sworn In. 2. Case *2971 Request for Relief Owner: Nancy C. Appleton, Trustee 65 NE 107 Street Mr. Charles Smith represented Ms. Appleton and stated that the house was set for closing on July 10, 1993 and the house Is now In compliance. Ms. Burch moved to waive all outstanding fines. Mr. Stokesberry seconded the motion and it passed unanimously. Case 2990 Request for Relief Owner: Angeline Jean Baptiste 10516 NW 2 Avenue No action taken on the above case. Case 2857 Request for Relief Owner: Jorge Cortes 1025 NE 91 Terrace Mr. Cortes explalned that the Insurance claim was Just settled and he now has a contract with a contractor to start work. His plans have to be stamped and submitted to Building and Zoning for a permit and the work could be completed In 60 days. • • Code Enforcement Meeting - 2 - June 3, 1993 After a discussion, Ms. Burch moved to table the Item for 60 days In order for Mr. Cortes to comply. Mr. Patnik seconded the motion and It passed unanimously. 3. Case *3123 Hearing Unsightly fascia, soffit, house exterior 9701 NE 4 Avenue Owner: Mitchell Wendling Mr. Trumble explained that the entire house needs painting and the he spoke to the painter and the painter said he could not start work for approximately 60 days. Ms. Burch asked Mr. Wendling why didn't he get a different painter since this particular one kept putting off the starting of the Job. Mr. WendlIng was sworn In. Mr. Wendling stated that he wants this particular painter to do the work because he likes the work that he does and that the painter told him (Mr. Wendling), that he would be able to start work in 2 weeks. Ms. Wendling was sworn in. Ms. Wendling stated that she too, wants this painter to do the work because of the quality of work that he does Is excellent. Ms. Wendling went on to state that she did not want to pay a fine If the painter says he'll start and then won't show up. The Board suggested to Ms. Wendling that she tell the painter that If he does not show up this time that she Is being fined on a dally basis after 30 days from today. Ms. Burch moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code, and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Mr. Stokesberry seconded the motion and It passed unanimously. Hearing Case 3157 Unsightly Fascia, Soffit, House Exterior 70 NW 98 Street Tenant: Bessie F. Green Mr. Placide stated that the owner of the home died and that the house was In foreclosure. Mr. Herrera moved to table the case until the next meeting. Ms. Burch seconded the motion and It passed unanimously. Hearing Case 3196 Unsightly Fascia, Soffit, House Exterior 28 NW 104 Street Owner: Barbara Chinn Mr. Placide stated that the owner, Ms. Chinn pulled a permit on June • 2, 1993 to do the necessary work. • Code Enforcement Meeting - 3 - June 3, 1993 After a discussion, Ms. Burch moved for a Finding of Fact and Con- clusion of law that a violation exists to Section 12.133 of the Miami Shores Village Code, and ordered If not corrected in 30 days, a $25 a day fine be effective. Mr. Patnik seconded the motion and it passed unanimously. Hearing Case 3210 Unsightly Fascia, Soffit, House Exterior 9434 North Miami Avenue Owner: Dennis Waite Mr. Garcia told the Board that the owner has not compiled with the order. Mr. Stokesberry made a motion for a Finding of Fact and Conclusion of Law a violation exists to Section 12-133 of the Miami Shores Village Code, ordered if not corrected in 30 days, a fine of $25 per day will become effective. Ms. Burch seconded the motion and it passed unanimously. Hearing Case 3220 Unsightly Fascia, Soffit, House Exterior 890 NE 98 Street Owner: Karen and Wiley Huff Mr. Trumbie stated that Hurricane Andrew caused a tree to fall in • the neighbors yard. Mr. Huff stated to Mr. Trumble, that the neighbor had a backhoe to straighten the tree. He claimed the backhoe caused the wall to fall Into the neighbors yard. Ms. Huff was sworn In and stated that the debris had been removed from the neighbors yard and placed in the alley for pickup. Mr. LuBien stated that the debris was in fact In the alley right of way and that the remnants of the wall were In the street right of way. After a short discussion, Mr. Owens made a motion for a Finding of Fact and Conclusion of Law that a violation exists to Section 12-133 of the Miami Shores Village Code, and ordered If not corrected within 60 days, that a fine of $25 per day will become effective. Ms. Burch seconded the motion and it passed unanimously. Hearing Case 3221 General Unsightliness 262 NE 98 St Owner: Malcolm M. Campbell Mr. Garcia stated that the property has not come Into compliance. Mr. Owens made a motion for a Finding of Fact and Conclusion of Law that a violation exists to Section 10-1 of the Miami Shores Village Code, ordered if not corrected In 30 days, a fine of $25 per day • will become effective. Mr. Stokesberry seconded the motion and it passed unanimously. Code Enforcement Meeting - 4 - June 3, 1993 • Hearing Case 3227 Unauthorized Construction/Alterations 243 NE 103 Street Owner: Mr. & Mrs. Mark Smith • Mr. Garcia stated that the owners have come Into compliance with the property. Mr. Stokesberry moved to dismiss the case. Ms. Burch seconded the motion and it passed unanimously. Hearing Case 3229 Failure to Obtain an Occupational License 82 NE 102 Street Owner Steven Evans Mr. Piaclde stated that the owner has not come Into compliance. Ms. Burch moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 14-17 of the Miami Shores Village Code, and ordered If not corrected In 30 days, a fine of $25 per day will become effective. Mr. Patnik seconded the motion and It passed unanimously. Hearing Case 3236 General Unsightliness 9125 N Bayshore Drive Owner; Federico Slxto Mr. Trumble stated that the owner has not come Into compliance and that this was a repeat violation of which, In the past, Mr. Sixto would come Into compliance Just before the date of the hearing. After a brief discussion, Mr. Stokesberry moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 10-1 of the Miami Shores Village Code, and ordered If not corrected In 30 days, a fine of $25 per day become effective. Ms. Burch seconded the motion and it passed unanimously. Hearing Case 3255 General Unsightliness 559 NE 87 Street Owner: Dallas Glass Mr. Garcia stated that the owner has not come Into compliance. Ms. Burch moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 10-1 of the Miami Shores Village Code, and ordered If not corrected In 30 days, a fine of $25 per day become effective. Mr. Stokesberry seconded the motion and It passed unanimously. Hearing Case 3253 Improper Storage of Rubbish, Garbage, etc. 8945 Biscayne Blvd. Owner: John Miiitana • Mr. Garcia stated that the owner has not provided proper containers for the disposal of garbage and rubbish and Is not In compliance. • • Code Enforcement Meeting - 5 - June 3, 1993 Ms. Burch moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 10-1 of the Miami Shores Village Code, and ordered If not corrected in 30 days, a fine of $25 per day become effective. Mr. Patnik seconded the motion and it passed unanimously. Hearing Case 3265 General Unsightliness 54 NW 104 Street Owner: David Campbell Mr. Placide stated that the property owner has not compiled. Mr. Owens moved for a Finding of Fact and Conclusion of Law that a violation exists to Section 10-1 of the Miami Shores Village Code, and ordered If not corrected in 30 days, a fine of $25 per day become effective. Mr. Stokesberry seconded the motion and it passed unanimously. Hearing Case 3266 Improper Treatment of Refuse 9760 North Miami Ave Owner: Mary Anna Singer Ms. Singer was sworn ;In. Ms. Singer stated that the trash was picked up and properly disposed of that day and the property was In compliance. After a discussion, Ms. Burch moved to dismiss the case. Mr. Patnik seconded the motion and it passed unanimously. Hearing Case 3270 Commercial Vehicle In Residential Zone 9426 NW 2 Place Owner: Joseph Pierresaint The Code Enforcement Officer stated that the owner was In compliance.
