05-06-1993 Regular MeetingCODE ENFORCEMENT BOARD REGULAR MEETING MAY 6, 1993 A regular meeting of the Miami Shores Village Code Enforcement Board was held on Thursday, May 6, 1993 at the Miami Shores Village Hall. The meeting was called to order by Mr. John L. Stokesberry with the following members present: Margaret Burch Daniel B. Owens John L. Patnik Jr. Prospero G. Herrera 11 Absent: Barry K. Asmus Thomas J. Caldwell Also Present: Frank LuBien, Dir. of Code Enforcement Richard Trumble, Code Enforcement Inspector Jorge Garcia, Code Enforcement Inspector Jean Placide, Code Enforcement Inspector 1. Minutes - April 4, 1993 A motion was made by Ms. Burch to approve the minutes as written. Mr. Owens seconded the motion and it passed unanimously. 2. Hearing, Case No. 003051 411 Unsightly fascia, soffit, house exterior 289 NE 102 St Owner: Robert Turner, DDS • Mr. LuBien, Mr. Trumbie and Mr. Turner were sworn In. Mr. Turner explained that his brother, Mr. Robert Turner, the property owner, had dled three days after the hurricane and that there have been many complications with his will. Mr. Turner stated that the pro- perty should be In compliance In approximately 30 to 60 days. Ms. Burch made a motion for Finding of Fact and Conclusion of Law a violation exists to Sec 12-133 of the Miami Shores Village Code, and ordered that a fine of $25 per day will become effective If not corrected In 60 days. Mr. Owens seconded the motion and it passed unanimously. 3. Hearing Case, No. 003072 Unauthorized construction/alterations 68 NW 92 St Owner: Government Nat'l Mortgage Assoc. Mr. Garcia was sworn In. Mr. Garcia explained that there has been no response from the property owner whatsoever. Ms. Burch made a motion for Finding of Fact and Conclusion of Law a violation exists to Sec 6-4 of the Miami Shores Village Code, and ordered that a fine of $25 a day will become effective If not corrected In 30 days. Mr. Patnik seconded the motion and It pass- ed unanimously. • • Code Enforcement meeting - 2 - May 6, 1993 4. Hearing Case, 003069 Unsightly Fascia, Soffit, House Exterior 10130 North Miami Avenue Owner: Francis E. Klick Mr. Klick was sworn in and went on to explain that the house was being sold and the closing date was set for June 3, 1993. After a short discussion, Ms. Burch made a motion for Finding of Fact and Conclusion of Law a violation exists to Sec 12-133 of the Miami Shores VIIIage Code, and ordered that a fine of $25 a day will become effective if not corrected within 60 days. Mr. Patnik seconded the motion and after a discussion, Ms. Burch amended her motion to 90 days Instead of 60 days and Mr. Patnik seconded the amended motion and It passed unanimously. 5. Hearing, Case 003113 Improper treatment of refuse 246 NW 93 St Owner: Ellen M. Riley Mr. Jean Placide was sworn In and went on to explain that upon Inspection of the property today, the property was cleaned up according to code and the violation no longer exists. Ms. Burch moved to dismiss the case and Mr. Owens seconded the motion and it passed unanimously. 6. Hearing, Case No 003145 Unsightly fascia, soffit, house exterior 9325 NW 2 Court Owner: Yvan Frederic Mr. Garcia presented a picture of the house and the explained the violation was not compiled with. After a discussion, Mr. Owens made a motion for Finding of Fact and Conclusion of Law a violation does exist to Sec 12-133 of the Miami Shores VIIIage Code, and ordered that a fine of $25 a day will become effective If not corrected In 30 days. Ms. Burch seconded the motion and it passed unanimously. 7. Hearing, Case No. 003144 Unsightly fascia, soffit, house exterior 9325 NW 2 Place Owner: Leanna Weston Ms. Weston was sworn In. Mr. Garcia explained that the house needed painting In the area around the air conditioner and where the shutters were removed. After further discussion, Ms. Burch made a motion for Finding of FAct and Conclusion of Law a violation exists to Sec 12-133 of the Miami Shores VIIIage Code, ordered that a fine of $25 per day will become effective If not corrected In 30 days. Mr. Owens seconded the motion and it passed unanimously. Ms. Weston stated that the violation will be complied with within the time period. 8. Hearing, Case No. 003156 Unathorized storage of Materials 9625 North Miami Avenue Owner: Chemical Mortgage Co. • • Code Enforcement meeting - 3 - May 6, 1993 Mr. Placide stated that the property was cleaned up and In com- pliance of code as of today when he went to the property to do an Inspection. Mr. Owens moved to dismiss the case. Mr. Herrera seconded the motion and It passed unanimously. 9. Hearing, Case No. 003170 Failure to obtain an occupational license for rental property. 29 NW 110 St Owner: Guyrla Larsen Mr. Garcia stated that as of this date, the property owner has not obtained the occupational license necessary. Mr. Owens moved for Finding of Fact a violation does exist to Sec 14-17 of the Miami Shores Village Code, ordered that a fine of $25 per day will become effective If not corrected In 30 days. Mr. Owens seconded the motion and It passed unanimously. 10. Hearing, Case 003206 Failure to obtain an occupational Ilcense for rental property. 242 NW 93 St Owner: Hughes J. Auguste Mr. Garcia stated that as of this date, the property owner has not obtained the occupational license necessary. Ms. Burch moved for Finding of Fact a violation does exist to Sec 14-17 of the Miami Shores Village Code, ordered that a fine of $25 per day will become effective If not corrected In 30 days. Mr. Owens seconded the motion and It passed unanimously. Comments The consensus of the Board was to compliment Mr. LuBien for the brochure that was mailed to the residence. The Board stated that It was a very good piece of literature that, with the three languages, would be very helpful to all residences of Miami Shores.
