Shores Village Code Enforcement Board was held on Thursday, March 4, 1993 at 7:30 P,M, at.; -the Miami Shores Village Hall, The meeting was called to order by Mr. Barry Asmus, Chairman, with the following members present: Barry K, Asmus, Chairman Thomas J, Caldwell Margaret Burch. Prospero G, Herrera II Daniel B. Owens John L, Patnik, Jr„; John L, Stokesberry Also present: Richard Trumble, Code Enforcement Inspector Jorge Garcia, Code Enforcement Inspector Jean Placide, Code Enforcement Inspector Frank LuBien, Director of Code Enforcement 1. MINUTES MARCH 4, 1993 The minutes of the meeting of March 4, 1993.were approved as written, by a motion -made by Mr. Staesberry seconded by Mrs. Burch, and passed by unanimous vote, 2, REQUEST FOR RELIEF, CASE NO 2857 UNSIGHTLY::FASC A.:SQF 'IT7 _HQUSE EXTERIAR 1026 -NE9lst Tarr, JO$GE CORTES, OWNER Mr. Trumble, 1tr, Garcia and Mr, LuBien were sworn in for their testimony of the evening , :_:_Mr, Jorge Cortes also was sworn in, The case was introduced by 1r, LuBien and presented by Mr, Trumble, Mr. Trumble stated the home was purchased and sold the same day, two weeks before Hurricane Andrew. The house is unoccupied at this time, Mr, Cortes testified, he has tried to settle with Allstate, in vain, He wants to make the necessary repairs, but unfortunately canLt without adjuster,. Following much. discussion, Mr, Caldwell made a motion to table the request for relief, to the next meeting,. to. give the owner an opportunity to make a good faith effortto settle with the insurance company and make the repairs. Mxs, Burch seconded the motion, Mr, Caldwell amended his motionito add that the fine not accru during this time., Mrs, Burch accepted the addition and the motion passed unanimously by a roll call vote, 3. HEARINGCASE NO, 003910 COMMERCIAL VEHICLE IN RESIDENTIAL ZONE 805 NE 95th STREET OWNER: MARTA MC CQRMACK Mr, Bruce McCormack was sworn in', Mr, LuBien introduced the case, which was presented by Mt, Trumble,-- Following much::discussion, Mt; Caldwell moved.for.a Finding of Fact and Conclusion of Law there is a violation to the Schedule of Regulations, ordered that if not corrected in 30 days, a $10,00 per day fine will become effective, Mr, Patnik seconded the motion and it passed by a 4/3 roll call vote, Mr, Owens, Mr. Herrera and Mr,•Asmus voted No, • • CODE ENFORCEMENT BOARD -2- March 4, 1993 4. MUSSELWRITE Virginia Musselwhite was sworn in, Mr, LuBien introduced the case,•it was presented by Mr, Garcia, who indicated effort has been made to. 'cleanup the violation, Mr. Stokesberry moved for Finding of Fact and_. Conclusion of Law a violation continues to exist to the Schedule of -Regulations, ordered that a fine of $20,00 per day will become effective if not corrected in 30 days, Mrs, Burch seconded the motion, and it passed by Unanimous roll call vote, 5. HEARING, CASE N0.3021 BUSINESS FROM RESIDENCE 9430 BISCAYNE BLVD OWNER: CHRISTINE MITCHELL Ms Chris Mitchell was sworn in, She was also represented by Attorney, Robert E, Gluck, Mr, Trumble stated he was in on the Police action in the house, Mrs. Mitchell is guilty of fortune telling, palm -reading, etc, which.is prohibited in 'Miami Shores, Mr, Robert Gluck, her attorney -stated he wanted tomeet the police officer involved and cross examine him, Mrs! Burch moved to continue this:ease to the next'meeting, seconded by Mr, Stokesberry, it passed by unanimous roll call vote, 6. HEARING, CASE NO.2891/2892 UNSIGHTLY 'FASCIA SOFFIT, HOUSE EXTERIOR 1020 NE 98th STREET OWNER; GUMMI 'UNA - WI TCEI,RR No onewag present to represent Dorothy Gaviea. Mr. Herrera 'moved .to postpone the cases to next wont,, seconded by Mr, Stokesberry, the motion passed unanimously, .. 7, HEARING, CASE NO, 29.90 UNAUTHORIZED CONSTRUCTION/ALTERATIONS 10516 NAT 2nd AVENUE OWNER; ANGELINE ,TERN -BAPTTSTR Mr. Trumble explained this was a case, of rerroofing without a permit, Mr. LuBien indicated that he deserves an explaination, Mr. Stokesberry moved for Finding of Fact and Conclusion of Law a violationexists to 8eotivn 6-.4, :-order:ed_•tb.at if a permit is not obtained in 30 days, a fine of $25.00 per day will become effective, 8. HEARING, CASE NO, 2995 UNSIGHTLY FASCIA, SOFFIT, HOUSE EXTERIOR 10326 NW 1st AVENUE OWNER: CAROLYN J, FERNANDEZ Mr. Trumble stated the house is in deplorable condition, the garage roof is caved in. He read a letter written to him from Joseph Pierre, Mrs, Burch moved to grant.a 30day extension in both cases, seconded by.Mr. Owens the motion pasted unanimously, 10. HEARING, CASE NO 3027 GENERAL UNSIGHTLINESS 130 NE 98th STREET OWNER: JOSE GROSSO Mr. Garcia noted this property is overgrown, Mrs, Gross said she cant correct the violation because of hardship. Mr. Caldwell moved for Finding of Fact and Conclusion of Law a violation exists to Sec 10-1 if not corrected in 45 days a $20,00 per day fine will become effective.
