Shores Village Code Enforcement Board was held on Thursday, January 7, 1993 at 7:30 P,M, at the Miami Shores Village Hall. The meeting was called to order by Mr, Thomas Caldwell, Vice Chairman, with the following members. present: Thomas J, Caldwell, Vice Chairman Margaret Burch Prospero G. Herrera TI Daniel B. Owens John L, Patnik, Jx, John L, Stokesberry Absent Barry K, Asmus Also present: Richard Trumble., Code Enforcement Inspector Frank LuBien, Director of Code. Enforcemet 1, MINUTES DECEMBER 3 1292 The minutes of the meeting of December 5, 1992 were approved by a motion made by Mrs, Burch, seconded by Mr, Owens, and passed 2, HEARING, CASE NO 0.02227 UNAUTHORIZED CONSTRUCTION/ ALTERATIONS �420.:NE 95th. St, OWNER: JAMES E. GOLDSTEIN as written, unanimously, Mx, Tremble and Mr. LuBien were sworn. in for their testimony of the evening, Michelle Goldstein also was sworn in, Mr, LuBien introduced the case, Mr, Trumble presented the facts, stating that the violation is now corrected, Mr, LuBien noted that a tree in the way may have delayed compliance. Mrs, Goldstein had no comment except that she is in compliance, Mrs. Burch.made a motion to dismiss the case, seconded by 1Mr, Owens and passed:.by unanimous vote, 3, REQUEST FOR RELIEF, CASE NO. 002837 0Pn1Nk i ROGER F . BRADLEY, 899 NE 92nd St, Mr, Bradley wrote a letter requesting relief, a copy of which was given to each Member of the Board, Mr, Bradley was sworn in, Aa Mx, LuBien introduced the. case, Members reviewed,pictures of the viola=- tion, Mr. Tremble presented the facts stating that Mr.. Bradley is in compliance, Mr, Bradley noted also that he is now in compliance, Mr, Stokesberry made a motion to waive the fine, seconded by Mrs, Burch.. and passed by a 5/1 vote, Mr, Patnik voted No, 4. HEARING, CASE NO 0029_64. GENERAL UNSIGHTLINESS OWNER: JOSE RODRIGUEZ III, 823 NE 96th. St, Members looked at the pictures as Nr,. Trumb.le presented the case, Penny Robinson who lives in the house was sworn in. CODE ENFORCEMENT BOARD REG MTG -2-- JAN 7, 1993 Nr, Trumble stated there is much work.to be done, Mrs, Robinson said, she purchased a weed eater and tried to correct the violation, but she needs a Landscaper ,to bring the place in compliance, Mrs. Robinson, in response to query, further noted she is waiting for a Landscaper,because of a good repu- tation and he comes .from the school where Mr. Rodriguez works,,. Following further discussion, Mr. Stokesberry made a motion for Finding Of Fact and Conclusion of Law a violation exists to Sec 10-1, ordered that if the violation is not corrected in 30 days a.$25.00 per day fine will become effective, The motion. was seconded by Mrs. Burch and passed unanimously. 5. HEARING' CASE NO 002950 HEDGE/FENCE BEYOND HEIGHT LIMITATIONS 141 NW 103 St. OWNER: ABEL FINANCIAL CORP. Nr, Jeff Muir was sworn in. Mr. LuBien introduced the case, which was presented by Mr, Trurble, Mr, Tremble stated the case was continued from last month.. It is now in compliance. Mr. Muir stated since he was unable to get a contractor be had to do the work himself, and what a job,it was. Mrs. Burch moved to dismiss the case, seconded by Mr, Stokesberry and passed unanimously. 6, HEARING, CASE NO 002848 UNSIGHTLY FASCIA, SOFFIT, HOUSE EXTERIOR OWNER: Sc'EL. H. WRIGHT, 795 NE 95th St. Nr. LuBien antrodce.d the case, Members: looked. at. pictures as Mr, Trumb.le presented the facts. He stated that Mr. Stobs, of the Construction Industry is somebow involved in the case but has refused to do anything to correct the vio- lation, The house needs a roof repaired or replaced, One continuance• was granted and now another its needed, Mrs, Burch moved for Fonding of Fact a-.- i.olation eXistso Conclusion of Law thats i:s a vtolat±on of 12,133 of the Code, ordered that if the violation is not corrected in 30 days a fine of $25,00. perday will go tato effect, The motion was seconded by' Mr. Stokesberry and passed unanimously, 7, HEARING, CASE NO 002894 =SIGHTLY FASCIA, SOFFIT, HOUSE EXTERIOR OWNER: ANDRE DORNUS, 101 NW 106th. St, Nr, Tremble presented thecase as. Members lookedat,pictures .:.of the. violation, He stated, Mr. Roach originally wrote this violation, It is not in . compliance, Mr. Stokesberry made a motion for Finding of Fact, a violation exists, Conclusion of Lawthis is a violation of Sec 12-133, ordered that if not in compliance a $25.00 per day fine Will become.effective.in 30 days, Mrs, Burch seconded the motion and it passed by unanimous vote, 8, HEARING, CASE NO 002895 UNSIGHTLY FASCIA, SOFFIT, HOUSE EXTERIOR OWNER: ANDRE DOB US, 101 NV 106th St, Mr. Tremble stated _this case appears to definitely need a continuance, No contact with the owner has been made, Mrs. Burch moved for Finding of Fact and. Conclusipn of Law a violation exists to Sec 12133 of Miami Shores Village . The motion was seconded by Nr, Patnik and passed unanimously. 9. HEARING, CASE NO; 002924 UNAUTHORIZED CONSTRUCTION/ALTERATIONS OWNER: THOMAS A. MURPHY TENANT; PELL FENDER 1001 NE 96th St. Nr. LuBen introduced the case,. It was presented by :7r, Trumble, who stated Mr, Murphy, the owner came into the office and in the interest of time said he would fax a letter requesting an extension of time, but no letter had come in. Nr. Stokesberry made, a motion for Finding of Fact a violation does pxlst, Conclusion of Law this violation is against Sec 6-4 of the Code, ordered if the violation is not corrected in 60 days a $25,00 per day fine will become effective. The motion was seconded by Er. Patnik and passed unanimously,, 10, HEARING, CASE NO 002958. INOPERABLE VEHICLE ON PREMISES OWNER: YVAN FREDERIC, 9325 NW 2nd Ct. Mr. Trumble stated, the vehicle is an inoperable vehicle, Mrs. Frederic called to state the violation was corrected, He went out to check, but the violation continues, Mrs, Burch moved for Finding of -Fact and Conclusion. of Law a violation exists to Sec 13.1 of Miami Shores Village Code of Ordinance, ordered that if the violation is not corrected in 30 days, a fine of $25,00 per day will be charged, The motion was seconded by Nr. Stokesberry and passed by a unanimous vote, 11, HEARING, CASE NO 002966 FAILURE TO OBTAIN AN OCCUPATIONAL. LICENSE OWNER: HONE SAVINGS. OF AMERICA TENANT; LAWRENCE R, ARIN 10669 NE 10th P1 Mr. Trumble in presenting the. case stated that Nr, Arin is a tenant, No occupational license has been issued, Mr, Owens moved for Finding of Fact and Conclusion of Law' a violation does exist to Sec 14-17 of Niami Shores Village Codes, ordered that if the violation is not corrected in 30 days, a fine of $25,00 per day will become effective, The motion was seconded by Mr, Stokesberry, and passed unanimously. 12. HEARING, CASE NO 002971 HEDGE/FENCE BEYOND HEIGHT LIMITATIONS OWNER: NANCY C. APPLETON, TRUSTEE, 65 NE 107th.
