MAGUIRE Mr, Tremble and Mr, LuBien were sworn in for their testimony of the evening, Mr, Maguire refused to be sworn in, Mr, Caldwell told hi -m that he could not present his case if he is not sworn in, Members want to hear the truth from each side, Mr, Trumble presented the case, He said Mr. Maguire is working on the house,, but as of today, the work is incomplete, Mr, Maguire decided to be sworn in, under protest, Mr. Maguire.t.alked about his low cost Ioan3.his roof; and his heart problem, Mr. Asmus asked how long it will take him to completethe job, Mr. Asmus made a Motion for Finding of Fact and Conclusion of Law a violation does exist to Sec 12.433 of the. Code:and.if the violation is not corrected in 30 days, a fine of $25,00 per day will be levied, The motion was seconded by Mr, Stokesberry and passed by unanimous roll call vote, Mr. Asmus explained Members action to Mr, Maguire, Mr. Asmus then took the gavel, 3. HEARING, CASE NO. 002917 MAINTAINING A NUISANCE 853 NE 96th STREET - OWNER: GEORGE W. BURNS & H, BROGGER The case was introduced by Mr. LuBien, Mr. Trumble presented the case. He stated there was a violation but todayls inspection showed the pool cleaned and empty. Mr. Walter Margicin was sworn in to represent Mr. Burns, who is in a nursing facility, Mr, Margicin stated he is a Real Estate agent and a friend of Mr, Burns, The pool is cleaned and empty and is expected to remain this way, Mr. Stokesbe.rry made a motionto dicmfss the case, seconded by Mr, Owens and passed 6/1, Mrs, Burch voted No, • • CODE ENFORCEMENT BOARD REG MTG -2- 4. HEADING, CASE NO, 002933 MAINTAINING A NUISANCE 560 NE 103rd STREET -- 0 JACQUES LORENCEAU 12/3/92 Mr, Tremble presented the case, He stated the house is -vacant. The yard has not been cut and the pool is unsightly, No one was present for this case. Mr. Stokesberry moved for Finding of Fact and Conclusion of Law that a violation exists to Sec 10-5 of Miami Shores village Code ofOrdinances, Ordered that the violation be corrected in 30 days or a $25,00 per day fine will be levied, The motion was seconded. by Mr. Caldwell and passed unanimously. 5. HEARING, CASE NO, 0.02945 INOPERABLE VEHICLE ON PREMISES 20 NE 104th STREET OWNER; FRANCINE PIERRE LOUIS This case .was presented by Mr. Trumble, Members reviewed pictures of the violation. 19'r. Trumble stated that the vehicle has an expired tag. There was no one present to represent the owner, Mrs. Burch made a motion for Finding of Fact &: Conclusion of Law a violation does exist to Sec 13-1 and if not corrected in 30.days a fine of $25.00 per day will become effective. Mr. Stokesberry seconded the motion which passed by unanimous vote, 6. HEARING, CASE NO. 002950 HEDGE/FENCE BEYOND HEIGHT LIMITATIONS 141 NW 103rd STREET OWNER: ABEL FINANCIAL CORP Members reviewed pictures of the violation, Mr. Tremble presented the case, He stated a tree.fell on the fence, a result of Hurricane Andrew, and Abel. Financial has been trying to find someone to repair the fence, Mr. Jeff Nu -Fr of Abel Financial Corp, has tried to get someonein to repair the fence, but all in vain. Be said he would be pleased to give'Membersc names and phone number of people he called, He wants to correct the violation, but is having difficulty getting a fence company, Mr. Caldwell moved to table the case to the next meeting, seconded by Mr. Stokesberry. Mx. Caldwell amended his motion to read, the case be tabled to the next meeting and that Jeff Muir be in touch with the Village at least once a week to inform them of any progress. Mr. Stokesberry accepted the amendment and it passed by unanimous vote. The meeting adjourned at 8;10 P,M, Approved Barry" Asmus, irman.
